That resolution is made pursuant to <br /> Section 264-1 of the Hawaii Revised Statutes, which states, in relevant part, <br /> that surrender of public highways shall be deemed to have taken place if no <br /> act of ownership by the road's owner has been exercised for five years, and <br /> the County adopts a resolution claiming ownership of the road. The County <br /> wishes to introduce this resolution as soon as possible in order to expedite <br /> the completion of the Puna Emergency Access Road.
