As a property owner in the Hawaiian Acres Subdivision, your deed provides for ownership in common with 3,944 other property owners of Road_ Lot 6213 as shown on Map 49 of Land Court Application 1053. The road section which is being acquired by the County of Hawaii is further identified as Parcel 6213-A, Land court Application 1053, Tax Map Key 1-6-13:18 (Third Division). An environmental assessment per requirements of Hawaii Revised Statutes, Chapter 343, and finding of no significant impact was obtained on May 8, 1996, from the Office of Environmental Quality Control. The County also intends to introduce to the Council a resolution, included with this letter as Exhibit 2. That resolution is made pursuant to Section 264-1 of the Hawaii Revised Statutes, which states, in relevant part, that surrender of public highways shall be deemed to have taken place if no act of ownership by the road's owner has been exercised for five years, and the County adopts a resolution claiming ownership of the road. The County wishes to introduce this resolution as soon as possible in order to expedite the completion of the Puna Emergency Access Road.
