I enjoyed listening to your concerns and the opportunity to meet with you. The results of HHA's survey project have been compiled and are currently being evaluated. I am concerned about your perception that there is a lack of respect and regard for the community by our management company. The Authority has held subsequent meetings with the president of Urban Real Estate Company to share these concerns noted in the survey. The Authority has also expressed to Urban Real Estate Company a desire for the management to have greater visibility on the project sites, as well as improve communications in the area of service. Within the next two months, the Authority expects positive actions to occur. We are making concerted efforts to address maintenance, management and other concerns brought up at the resident meeting. Of particular note is a utilities assessment to explore ways to become more energy cost efficient; and an officer in residence program through the County of Hawaii Police Department. We anticipate these topics to be addressed within the aforementioned time frarxle. Again, thank you for your feedback and ideas. Although the Authority's basic mission is to provide safe, decent, and sanitary housing,. we value customer service as an important component in the way we conduct business. I plan to return to Kona to meet with you in approximately May 1998 to give you the opportunity to once again share your concems. Housing Management Branch Administrator, HHA Meeting to Gather Information to Present to HCDCH Neighborhood Place July 29, 2003 1:00 p.m. I. Present: Rodelle Smith (Ka Hale Kahalu'u), Lucy Pinto (Kaimanlino), Gavin Thornton (Legal Aid), Julie Russell (Nani Olu), Mark Fiewosta, Mara Lynn Amone (Ka Hale Kahalu'u), Patricia Oliveira (Prosecutor's Office), Mel Fujino (Prosecutor's Office), Virginia Isbell, Linda L. Cullen (Solid Rock Ministries), Gina Ready (Kaimalino), Francis Jung (HCDCH), Lynenese Acia (Ka Hale Kahalu'u), Wally Lau (Neighborhood Place) & Susan Berman (Hale Hookipa) II. History: A. 5-23-02 Hawaii County Mayor Harry Kim, South Kona Council member Nancy Pisicchio, along with the Hui Laulima Council, which consists of 25 community agencies, groups, businesses and individuals, met through the assistance of Senator Russel Kokubun, with HCDCH Executive Director, Sharyn Miyashiro, her staff, and the housing manager with Urban Real Estate Company. B. On June 20, 2002, Ann Peterson, Community Empowerment Organization (CEO) Facilitator, met with the Community Oriented Prosecutor (COP) and Investigator to discuss mismanagement and safety issues at Ka Hale Kahalu'u housing. Ann presented pictures depicting the deplorable conditions of the units and common areas. C. On July 5, 2002, Wally Lau, Jack Ferguson, Pastor James Texiera, ' Rodelle Smith, Lynnese Acia, Mel Fujino, Ann Peterson, Pat Oliveria, Virginia Isbell, & Jan Marrack met to share information and strategize as to how to best work together to improve the conditions at Ka Hale Kahalu'u housing. D. On July 29, 2002, the Office of the Prosecuting Attorney sent a letter with copies of the pictures to Mr. Michael Flores requesting a site visit and follow-up planning meeting. E. August 7, 2002, Bob Hall contacted the Prosecutor's Office and represented that the board of directors met and that he would be handling the situation at Ka Hale Kahalu'u. At this time, a team from Oahu was in the process of assessing the housing property and units during the day. Mr. Hall will review the report from today's assessment and begin to make the necessary improvements. Private contractors will be hired to speed up the process. F. In a letter dated August 8, 2002, Michael Flores, Senior Operations Specialist, from Housing and Urban Development, informed the Prosecutor's Office as follows: 1. Mike Hee visited Ka Hale Kahalu'u on August 7, 2002 to address the physical problems with the buildings and units as depicted in the photographs provided; 2. On August 13 and 14, HCDCH staff will inspect 100% of the units at Ka Hale Kahalu'u and 5% of the units at Hale Hookipa, Kaimalino, Kealakehe, and Nani Olu and other developments in the area managed by Urban Real Estate Company; 3. Mr. Hee will be attending the August 7 meeting with the residents and Hawaii County Police; 4. As the owner of Ka Hale Kahalu'u, HCDCH is responsible for ensuring that the development provides decent housing and a safe environment for the residents; 5. Mr. Bob Hall, Executive Assistant at HCDCH, has been appointed by Mr. Wes Segawa, Chairman of the Board of Directors of HCDCH, to ensure that the community concerns are addressed and resolved; and 6. "It is necessary and important, therefore, that if the community believes its concerns are not being addressed adequately or timely by the on-site management staff, it contact Mr. Hall immediately so that he can take appropriate action." G. August 28, 2002, a meeting was held at the parking lot at Ka Hale Kahalu'u. Present were the residents of Ka Hale Kahaluu, Community Policing Officers, Urban Real Estate Company, Bob Hall, Prosecutor's Office, Jan Marrack, Virginia Isbell, & Wally Lau. The purpose of this meeting was for HCDCH to inform the residents on what they were doing, HCDCH's plans for the future, and to obtain input from the residents. It was agreed that the residents would meet on a separate date to identify their concerns and feasibility of their requests. H. Bob Hall responded to the Prosecutor's July 29, 2002 letter in his letter dated September 5, 2002. HCDCH represented the follcwing: 1. drug use and dealing is not tolerated in HCDCH projects; 2. funds exist to provide equipment for neighborhood watch programs as well as funds from HCDCH Resident Services Section for physical improvements of projects to prevent crime; 3. will work with results of police assessment on lighting conditions; 4. inspection completed on occupied units and findings were submitted to the agent for repairs; 5. maintenance staff has begun the process of rehabilitating twenty- two of the twenty-three vacant units; 6. managing agent indicates that if all the materials can be acquired, all the vacant units should be completed by September 30; 7. placement of new residents is ongoing; 8. managing agent is in the process of acquiring the services of a pest control company; 9. holes have been patched in the exterior of the building to prevent rodents from entering the building; 10. HCDCH has no plans to alter the onsite office space; 11. In lieu oaf the open patio, HCDCH is working to submit a plan to the Federal Government to deprogram a housing unit to provide a place for service providers to bring activities to the project; and 12. possibility of working with the residents to plan an open pavilion for residents to use for activities. I. September 7, 2002, residents of Ka Hale Kahalu'u met at the Keahou Shopping Center to identify and prioritize issues, and organize a resident association. Top priorities are: 1. more responsible management and more maintenance inside and outside of the units; 2. action to eliminate the drug and alcohol problems; 3. Tie: A) safe lighting around the public areas and on the buildings and B) advice on how to help get management changed. 4. Tie: A) management to rid the units of various vermin; including, mice, termites, scorpions, black and red ants, roaches, and centipedes and B) a residents association to be formed. J. On October 8, 2002, a follow up meeting was held at the Ka Hale Kahalu'u parking lot. Bob Hall represented that he would get back within a week to advise of the feasibility and time line to complete the requested repairs ident~ed from the September 7, 2003 meeting. The September 7, list was previously provided to Mr. Hall. K. On October 23, 2002 the residents met and identified the specific concerns they had for each of their units, and the overall concerns for the facility. They also reviewed a draft of the by-laws needed to ratify the creation of a resident association. L. On November 8, 2002, the residents ratified their By-laws fcr Ka Hale Kahalu'u Resident Association. M. A letter dated November 12, 2002, was sent to Mr. Hall informing him that we had not heard from him since the October 8, 2002 meeting. Again, a request was made to have the light bulbs changed in the common areas was made. N. A letter dated November 12, 2002, was sent to Mr. Wesley Segawa, Chairperson for the Board of Directors for HCDCH requesting that any plans to extend or approve any management contract be held in abeyance and to have representation in the selection of management. O. On December 23, 2002, Mr. Bob Hall responded to the November 12, 2002 letter and indicated that a clarification is needed as to why the units have been vacant. The explanation was that Urban Management did not become responsible for the processing of applicants until February of 2002. Since that time, they have processed several hundred applicants. Further, "HCDCH admits that the condition of the vacant units was disappointing even allowing for vandalism, however our inspection team (HUD, to our knowledge did not send any inspectors) noted some repairs that are normally beyond the scope of project maintenance staff.... The lack of activity is a result of scheduling the trades and delays in the procurement of the cabinets that had to be fabricated. The cabinets will be delivered by the end of December and installation will commence." "HCDCH is reviewing the specifics of the tenant regarding the timeliness and adequacy of project maintenance." P. On December 23, 2002, Ka Hale Kahalu'u residents elected their officers and directors. O. On July 21, 2003 Neighborhood Place held a meeting to update everyone on the status of Ka Hale Kahalu'u and other projects managed by Urban Real Estate. III. Reports: A. Ka Hale Kahalu'u 1. Virginia Isbell reports that the initial complaint was that there was no circulation. In February of 1998 residents were approached by Sharon Yamada. The office now occupied by Urban Real Estate use to be the Community Center. Virginia has been actively involved with helping the residents for many years. 2. Linda Cullen reports that in December 2001 they became aware of the conditions at Ka Hale Kahalu'u from the kids at Kahakai Elementary. Solid Rock approached Lisa from Urban Real Estate and they took food and toys to the children. Solid Rock was surprised at the condition of the place and they took pictures and videos. The stairs needed to be repaired, as they were rotten and unsafe. By January of 2002, Lisa no longer welcomed Solid Rock to come and assist. They had to submit letters and they were forbidden to enter and fix the apartments. One unit, which was occupied by two babies with asthma, had mold. While new appliances were observed to be housed in vacant units on the premises, all of the occupied units had used or unusable appliances. Lisa threatened to get Temporary Restraining Orders against them. As recent as March of this year, Lisa refused to allow food disbursements. 3. Recent identified problems: 1. Lisa denied a tenant with arthritis and a doctor's letter supporting her requests to relocate to an available first floor unit. Tenant subsequently broke her leg while accessing her second story residence. 2. Leasing a promised de-programming unit, which was promised to the residents. 3. Fixing fire alarms and charging residents $22.50 per hour and not aallowing the residents to complain about the their satisfaction with the repair/service provided. 4. Residents feel unempowered and intimidated by management. B. Hale Hookipa 1. No grip strips on stairs. 2. 13 apartments without hot water 3. Approximately 5 months passed before water line was fixed. 4. It took 1 year to fix a leaking ceiling. 5. Threatened with eviction notices. 6. Most of the residents are disabled and elderly. 7. Residents are intimidated by management. C. Nani Olu 1. Approximately 2 years ago, the water heater broke on a Saturday and flooded two apartments. The fire department, police, and Red Cross showed up. Photographs were taken. One of the residents lived in the community room for 10 days because management said that they could go back to the apartment, which was not livable. 2. Three washing machines for 32 units. One has been broken for two years now. The second is broken since March of this year and the third recently broke in July. The washing machines have not been fixed. The residents have had to go and have someone drive them to get their laundry done. 3. Most of the residents are disabled and elderly. 4. Residents do not want to report incidents because they are afraid and intimidated by management. D. Kaimalino 1. On May E, 2003, the residents voted to form an association. 2. On July 17, 2003, election was held to elect officers/directors. 3. Buildings are not numbered and the concern is that in the event of an emergency the rescue personnel will have a difficult time finding a unit because lack of identification of each separate building. 4. One of the residents broke her foot by stepping into an open water valve hole, which is still not fixed. 5. It took two weeks to respond to a resident's request to fix her oven. Sean told her that a regulator was needed. After a month passed, the resident called and Sean came to fix the oven. The repair was not done right and flames were shooting off the sides. The resident feared that the gas stove would be a safety hazard and did not want to use the over. Resident felt that Sean is unqualified to do some of the repairs. 6. A resident's bathtub has masking tape and water backs up. 7. Smoke detectors not working. The ones that are fixed a bill is sent to the tenant. Lisa denied resident's request to not have to pay the 16.00 bill. Frank Jung paid the resident's $16.00 so the resident could pay for the bill. IV. Next Steps: A. Virginia Ist~ell will assist in organizing and getting photographs from the various housing units. B. Mel FujinolPat Oliveira/Wally Lau will organize a PowerPoint presentation for the HCDCH board of directors. V. HCDCH board of directors will meet on August 21st and 22nd &6-03 MuvuT>as Kahatu'n Housing Svhcommittee Hui Lav Lima July 5, 2002 Present: Wally Lau, Jack Ferguson, Pastor James Texiera, Rodell Smith, Lynnese Acia, Mel Fujino, Ann Peterson, Pat Olivenia, Virginia Isbell, Jan Marrack Purpose of the meeting was to have those involved in various initiatives at Kahalu'u Housing meet each other, share information, and strategize as to how to best work together to impmve the conditions at Ka Hale Kahalu'u. Pat with Community Empowerment under the Prosecuting Attorney's Office has put together a flow chart to help clarify the service delivery to Ka Hale Kahalu'u This chart was circulated. Michael Hee is the cormact administrator and is directly under E.D. Sharyn Miyashiro. Jack has been trying to get a copy of the property management contracts, both the current contract with Urban Realtyand the previous contract with them. Mel said that he had talked to Keith Oda who will send a copy of the current contract and documents for the three-yeaz management renewal. Once these contracts have been reviewed, a letter will be sent to The Board of Directors at HCDCH with copies to Mike Flores at HUD. Letters of support are welcome and can be sent to Mel's office. Pat is going to follow up an the $50,000 grant from HCDCH to the Ili County Police to provide activities for youth at Kahalu'u and other low income housing. It may also be available to help set up community associations. The grant has been available for at least two years, and only ante has there been an activity at Kahalu'u. What exactly is this grant for and who is monitoring this grant? It has to have been approved by the County Council. Ann is working with Lynnese Acia io set up a Resident Association. Bob Young and Lee Afuvai with Resident Services at HCDCH Dame over to assist Property Manager, Lisa Faleafine, was not available. A representative from a Resident Association in W. Hi is eligible to sit on the Resident Advisory Boazd of HCDCH. Ann will review policy to find out if Urban Management can use the tenant's Recreation Room as an office. Pat will check on laws regarding nepotism. Virginia said they,should be in the State HRS. Pastor Tex says they are working at Kahalu'u every third Saturday. In July they will pick up kids who need a ride to get free school supplies. His volunteers have attempted to improve the property, but there has been confusion about the approval process. They have worked ou the grounds and have painted the laundry room. Volunteers with Solid ~H1B1T c" Rack Ministries are insured for liability. It was suggested that Ka Hale Kahalu'u could come under the umbrella of the insurance policy if liability was an Issue preventing access to the property. Tex said that the church has a recently approved non-profit affiliate -Island Providers Community Development Corporation. Roden Smith was just named Neighborhood Watch Coordinator. She will begin to organize the community with the support of Elaine Watai active with Neighborhood Watch in Kealakehe and Chuck Adams, Community Policing Officer. They aze concerned with illegal tenants, lighting, drugs and other safety issues. Ann will check to see if part of the $50,000 grant to the police can be used for lighting. There was discussion as to who was on the Board of Directors for HCDGH and who was the Sig Island Representative: Those present felt that communication should be directly with the BOD. Virginia said Wesley Segawa was the Chair. She wiII try to reach him to see if he has continued as the Chair into the new fiscal year. She will also confirm that he is-the Big Island representative. Virginia made a call to Mr. Segawa's office before the meeting was-adjourned and found that Mr. Segawa is in Europe. He is still on the BOD. She said that Ralph tljifu on Maui used to head HHA and is a contract specialist and a possible resource. Virginia brought up the Rental Housing Taut Fund. It was established to build mare apartrnenis and to improve existing ones. The fund makes loans and is well funded. Perhaps a grans would be available from the Trust Fund to help with repairs at Ka Hale Kahalu'a According to US Attorney, Ed Kubo, Weed and-Seed money is available. He has suggested combining housing units together and focusing on drugs and maintenance. There was discussion about what we should call our committee.lt was decided that we should be asub-committee ofHui Lau Lima. Then there would be several organizations behind our efforts -Hui Lau Lima, the Prosecuting Attorney's office, Island Providers Community Developmem Corporation and the local chapter of the National Association of Social Workers. Hawaii County Mayor Harry Kim, South Kona Councilwoman Nancy Pisicchio, along with the Hui Laulima Council, which consist of 25 community agencies, groups, businesses and individuals, met through the assistance of Senator Russel Kokubun, with HCDCH Executive Director, Sharyn Miyashvo, her staff, and the housing manager on May 23, 2002. Although this was a good first step, much concerns and work remains and we are hopeful that your office will be able to provide assistance and guidance in addressing the following identified problem areas. A review of the attached photographs, depict the deplorable conditions of the units and common areas. This is just a sampling of the full spectrum of concerns at the housing project which include but are not limited to the following: • daily drug use and drug dealing in the public areas • lack of lighting in public areas • lack of proper management and maintenance throughout the facility • rodent infestation • a high number of empty and unlivable units • use of the recreational hall by management as an office We invite you and others that you deem appropriate to come to Ka Hale Kahalu'u for a site visit. You will then be able to assess for yourselves the conditions the residents face everyday. Following this site visit, a meeting with your staffwould be welcomed to address these issues. A comprehensive plan could be developed and instituted immediately to address these concerns. We look forward to hearing from you to arrange a site visit and follow-up planning meeting. I plan to use that visit to the big island to see the Ka Hale Kahaluu development. I will also be encouraging the HCDCH staff and its private management agents to attend the training so that we can discuss how to deal effectively with the issue of drug use and drug dealing at Ka Hale Kahaluu. I would like to recap items discussed at our meeting on August 27, 2002 at the 'project site. 1. Drug use and dealing is not tolerated in HCDCH projects, however law enforcement is the responsibility with the civil authorities with the assistance of residents and management. Management and HCDCH are bound by rules and regulations that afford those that are accused of wrong doing due process. There is a hearings process where a hearings board of volunteer citizens determines whether the accused is to be evicted. Those ordered evicted by the hearings board have the right to appeal the system. HCDCH does not have any appeal rights in these matters. The police department and the residents with the assistance of management and HCDCH are in the process of initiating a neighborhood watch program. The police department is convinced that neighborhood watch programs, even in non- multifamily neighborhoods, is a great deterrent of criminal activity. 2. Along with funds to provide equipment for the neighborhood watch program, HCDCH's Resident Services Section (RSS) has funds for physical improvements of projects to prevent crime. At a previous meeting with management and the neighborhood watch police, we requested input for lighting improvements for Ka Hale Kahalu'u. HCDCH has inspected all the occupied units at Ka Hale Kahalu'u and have submitted our findings to the agent for repair. We informed the residents that they need to report maintenance requests to the office so a work order can be generated and follow up of repair requests are documented. Many tenants indicated they mentioned problems to the maintenance staff, but failed to have a work order initiated. The maintenance staff has begun the process of rehabilitating twenty-two of the twenty-three vacant units. Units will not be fully completed until materials such as floor tiles ahd kitchen cabinets are acquired. Additionally some of the maintenance work needs to be done by skilled journeymen such as plumbers and electricians. These services are in the process of being acquired in accordance with state procurement codes. The managing agent indicates that if all the materials can be acquired, all the vacant units should be completed by September 30. Placement of new residents is ongoing. 4. The managing agent is in the process of acquiring the services of a pest control company to address the rodents and other pests as indicated by the residents at the meeting of August 27. Management has indicated that they have patched holes in the exterior of the building to prevent rodents from entering the buildings, but because the project is surrounded by vacant properties, the rodent problem may be ongoing. 5. There has always been an office at the project, but when Urban Management assumed the management of the project, HCDCH consciously decided that there was a need to maintain the management office on site. The existing office was expanded into what currently exists. HCDCH has no plans to alter this intended use. In lieu of the open patio HCDCH has been working to submit a plan to the Federal Government to deprogram a housing unit to provide a place for service providers to bring activities to the project. The space can also double as meeting and activity. Another proposal that was brought up at the meeting was the possibility of working with the residents to plan an open pavilion for the residents to use for activities. We will keep you updated to progress of the remedial efforts and any changes. A follow up meeting is planned with the tenants at the end of September. The purpose of the Subcommittee is to be involved in various initiatives at Ka Hale Kahalu'u Housing, to slTaze information, and to work together to improve the conditions at Ka Hale Kahalu'u. As you aze well aware, twenty-three units at Ka Hale Kahalu'u have been unoccupied for a substantial period of time due to poor management that has allowed the units to become unlivable and dilapidated. After HUD became involved and inspected the units, work was started to upgrade these units. A lot more work needs to be done and at present all constructions and renovations have ceased. Residents are waiting to hear back from Mr. Bob Hall regarding HCDCH's plans to improve the living conditions and structure changes as well as holding management accountable for their inactions. As for residents, they have worked together with KHKHS to develop a set of By-laws which was ratified on November 8, 2002. A Nomination Committee has been formed and Election of Officers will beheld on December 23, 2002. The residents and KHK]HS, therefore, request that HCDCII hold in abeyance any plans to extend or approve am? We believe clarification is needed as to why the units have been vacant. As explained previously, 'ban Management did not become responsible for the processing of applicants until February of 02. Since that time they have processed several hundred applicants and processing of applicants is .,n going. Many applicants on the wait list cannot be placed because they do not meet HCDCH's screening criteria or because they do not have the financial resources to meet their lease obligations. HCDCH admits that the condition of the vacant units was disappointing even allowing for vandalism, however our inspection team (tiUD, to our knowledge did not send any inspectors) noted some repairs that are normally beyond the scope of project maintenance staff. These repairs including correcting loose subfloors, new cabinets and refinishing and replacement of the rusted bathtubs, necessitated procurement of the services of specialty tradesmen and special ordering of materials. The lack of activity is a result of scheduling the trades and delays in the procurement of the cabinets that had to be fabricated. The cabinets will be delivered by the end of December and installatic~ ~ will commence. HCDCH is reviewing the specifRcs of the tenant regarding the timeliness and adequacy of project maintenance. The procurement of management services for HCDCH is governed by State procurement code and at present does not include selection by residents. The Youth Council young girls gave a report of activities for the year and the fact that they were recognized by the Red Cross at the annual Heroes Breakfast for their many achievements including neighborhood clean-up (three times) and work with Neighborhood Watch. They would like to put. in garden plots for the residents and fruit trees in the area between makai side of Ka Hale Kahalu'u and the private land. The plot plan was displayed and the basic plan has been approved by Lisa and HCDCH. However, because HELCO and Verizon have a need to access the area occasionally, because of underground cables, the Youth Council needs to have movable picnic tables instead of permanent and bar-b-que areas strategically located. Looking for donations to begin the project(s). The Neighborhood W;atch report was given by Rodelle Smith. There has been a definite positive result of N-Watch patrols as the drug use has gone down considerably. Officer Haanio stated ~dhat Sgt. Sam Kawamoto has been transferred to another station so this was his first day as Community Officer working with the KHKRA and was just there to listen. There was much discussion about the problems with Urban Real Estate Management. One problem that came up was the danger of exposed propane tanks that are a hazard since they are not protected and children climb on them. Solid Rock rep. menticmed that they had proposed providing barriers for them to Lisa several years ago but were told it would cost $200,000. When the residents included the cost of re-fencing the area the total costs were about $14,,000. The propane tanks, to this day, are still unprotected. Lynnese, President of KHKRA, stated that one-of the concerns of residents is that Management turns off the outside water main and makes it inaccessible with a lock system. In case of fire, this source of water would not be available to the residents. One former resident, now a landscape gardener, who was the third person that went to live at "Kahalu'u Housing° when it first opened, stated that the area was beautiful then with gardens and fruit trees on the mauka hillside. Also, the building with the Laundry on one end had a Community Center on the other end. It was never an office or closed off to the residents. It was mentioned that the HCDCH Board of Directors will be holding its monthly meeting in Kona in August and that the residents in projects under Lisa's management will be asking for a private meeting with the Board of Directors. Sharon Ackles suggested we should invite two or three of the HCDCH Board Members to come over earlier to see the way things really are so when the entire B/Directors come to Kona they will have had first hand look. It is expected that management is going to move quickly to "fix" things. Sharon said she will call the B/Directors Chair and find out when a few can came to Kona. Mel Fujino suggested that we prepare a good presentation for the full B/Directors when they come to Kana for their Monthly meeting. So there will be a preparation meeting next Tuesday, July 2P at 1:00 p.m. Neig"boyhood Place. Everyone was asked to bring all documentation, lists of complaints, serious problems, etc. and pictures. MeI has the equipment to do a Power Point presentation if the group will prepare it. Residents from all five projects managed by Urban Real Estate will be encouraged to attend. One of the issues that came up was: Lisa says that the Department of Health has no jurisdiction over the projects for problems relating to health (mold, stagnant water, toilets backing up into bathtubs, leaking plumbing, etc.) because it is Federal land so no need to call in DOH. Also, Lisa says the Fire Department has no jurisdiction to inspect or cite fire hazards because it is Federal land. That information raised a few eyebrows, so Pete Hendricks said he would check the legality of the Fire Department doing inspections "on federal land" and regarding, safety issues; Sharon Ackles said she will check with state DOH regarding health issues and get a determination as to whether those statements by Lisa are correct. One person commented that the land is not federal but was turned over to the state by Kamehameha Schools, Bishop Estate. It was also brought up that there are more and more pigs coming down to the cat-feeding area to eat the cat food. Bishop Estate feels that the complaints about cat feeding are legitimate and that they are a health hazard. They also climb on residents' cars and scratch the paint. I am the resident that told Mr. Edwards and Mr. Bunglicks guests that there were two laundry baskets in the trash bin azea that no one knew who owned it. - After they looked at it, they told me it wasn't their laundry. I then told them that_ anytime there is items left in the rubbish bin area, people could go tlu•ougli it and take whatever they could use and not be in trouble for it. They then took what they could use and put both the laundry baskets back into the rubbish bin area. They did not leave any mess and left the baskets as theywere found. Then two days later both laundry baskets were still sitting there and because the last two nights we had a lot of rain. I picked up both baskets and threw them into the rubbish bin myself. The only machine that had been working since March stopped Monday, July 21. The elderly and disabled without transportation are washing clothes by hand and drying in the one remaining dryer that works. Our laundry situation is desperate. Julie Russell talked to Sean, your husband who you know is the Head of Maintenance, on Ftiday when he was at Nani Olu. She asked if he knew the washer was broken, he replied, "No, I didn't know." She asked, "Can you help us? Some people thought maybe just the money needed to be taken out." He answered, "No, we don't own the washers." When she asked him who did own the machines, he replied, "I don't know, they're on some kind of contract." Also on Friday Julie called the office to report the washer not working. The call she asked Rochelle to ask you to make was not returned. Simple information on the status of the laundry machines would be a help, but it seems non-existent, even to the Head of Maintenance. Nani Olu has been operating with one washing machine and one and a half dryers since mid-March. This letter is to pursue how to expedite repairs or replacement of the broken machines. On June 3, 2003, Annette Tashiro was asked by residents, "Who owns the washers and dryers?" She replied that the machines belong to the Nani Olu project. Beatrice (Toni) Hoagland said you told her before that the man who fixed the machines went to Hilo and you couldn't find him nor the keys to open the machines. His calls to both the Urban Real Estate office at Kahaluu and Mr. Hee on Oahu have not been returned. As of today, June 11, Toni has tracked down the following information regarding repairing Maytag washing and dryer machines. She located ATS Company in Hawaii which handles Maytag. Carlos Ramos who works for the company on the Big Isiand has the keys to get into the machines and can repair them. When Toni spoke to him, he asked who he should call to get permission to repair the machines at Nani Olu. She told him to call you and gave him your number. Mr. Ramos can be reached at 896-3740. In addition, Jim Crawford, a Nani Olu resident, is a journeyman electrician willing to look into repairing the machines if he has the manuals. Are repair manuals available for these machines? He is located in Kailua-Kona and said he has worked on the Nani Olu machines under a previous company and is familiar with them. He charges $55 for an initial call and $20 for each additional machine he examines at that time, plus of course, parts. Unfortunately, he does not have a key to the lazge front-loading washing machine but does to the others. While he was very eager to begin work with the machines, Julie informed him that all arrangements would have to be made through you and for him to keep calling should he be unable to reach you. Picture below shows ceiling as it is today. Moldy ceiling removed. Sheet rock put up and sealed but leak continued and sealant fell out. Attempt to fix leaking roof used °Bondo" - no good. Then June 2002 put on 'Peel & Seal°. Many believe that the well-reported personal friendship between Mr. Robert Hall and Mr. Faelini of the management company (FMC), has allowed FMC to take advantage of the friendship to the determent of the tenants and this facility. The FMC has a history of intimidation against the tenants, which mainly are comprised of the elderly, the disabled and those economically sensitive tenants. As a result of these matters, I believe that Mr. Hall should recluse himself in all matters involving the FMC. Could you help us obtain copies of the following to be shazed with the housing association? 1. "Project Rules" (State of Hawaii, Depart. Of Human Services, Hawaii Housing Authority) form DSSH 4111. 2. HCDCH management contract for this facility including job descriptions of FMC. 3. The recent physical needs assessment by the firm of `Building Inspection Service, Inc. 4. Tenants rights at HCDCH regazding local housing tenant rules. We have also learned that the handicap units and bathrooms aze not accessible, the laundry room is not accessible, ramps aze illegal and do not conform to the American with Disabilities Act (ADA). The failure to adequately oversee Independent Housing Contracts has led to many violations against housing applicants and tenants. Project mismanagement, faulty administration, housing applicant.processes, staff misconduct, inadequate maintenance and unauthorized uses had led to many discriminatory actions against persons with disabilities. The role of housing has increasingly been found to be critical in the recovery of persons with disabilities. Safe, decent, affordable housing for persons with disabilities is a goal of HUD, which is not being met here in West Hawaii due to the above listed violations. When a person with disabilities applies for housing here, the housing contractors meet them with an attitude of adverse selection. When a person with disabilities is an established tenant, they aze met with ridicule and verbal abuse. We respectfully are seeking housing relief for persons with disabilities and hope that a thorough review of all contracts, policies, procedures and mismanagement will be forthcoming. Problem with communication between offrce staff and Consumer. Untimely responses to phone calls, harassment, verbal abuse. Maintenance of the unit untimely. Verbal abuse from maintenance crew, unauthorized entry into unit, mildew on walls, broken refrigerator, sagging floors, clogged plumbing etc. Repairs were eventually completed, but within a (4) to (6) month span. Was told that maintenance would get to it when they can and that she needs to wait. Consumer has been living with this type of situation for (2) years and has not been able to receive fair treatment from management. Consumer has fried complaints with HUD, has made numerous contacts to Washington acrd rmmerous contacts to HCDCH. No satisfaction or action from either agency or contact. ` 2. (Kaimalino Housing 54 year old female. Made mrmerous complaints regarding the maintenance of her unit. After (4) months of complaints to management, repairs on holes in wall, leaking refrigerator, clogged plumbing, glass jalousies were completed Within the (4) months, she received no timely retunred calls, bad attitude and at times verbal abuse from administration. Also received verbal abuse from maintenance crew stating that she is just a complainer and old When fixtures were done, she received looks and bad attitude from maintenance crew. Was also told that maintenance would get to the fixtures when they can rnrd that she would just have to wait. 3. (xahale Kahaluu) 46 year old female. Site of apartment does not comply with applicable laws, rules, regulations and ordinance of governmental authorities governing maintenance. Appearance of the unit falls within endangering of the health and safety of the tenant. Reports were made for fixtures to be done with administration, but kept being put off per numerous reasons from maintenance. Very bad stench in unit, shower head leaking 24 hours a day causit:g rotting of the shower wall, excessive amounts of mildew due to moisture in the walls and the floor from bad plumbing, foul stench in carpeting believed to be due to plumbing under the unit. Broken window jalousies still have not been repaired. Consumer also has children, which makes this living situation a safety hazard. 4. (Kahale Kahalrru) 28 year old female. Made complaints regarding unauthorized vehicles and person(s) on the property. Also made complaints regarding illegal drugs within the complex. Tenant has also been treated unfairly by administration and maintenance crew. Tenant comes from out of state and is used to bad living conditions, brd stated that she world dike to hm~e a clernr bathroom free of the mildew, a working refrigerator that doesn't leak water aruf the ability to lock her doors acrd feel safe doing so. Tenant feels intimidated by management and maintenance and does not want to push any buttons. Tenant also had complaints regarding roaches and rats in the unit. 5. (Mani Olu) 64 year old female. Has been living within this complex for more than (4) years. She has not had arry run ins with administration ar mainterurnce prior to the her complaints within the past year. Tenant has filed complaints against administration and maintenance with HUD acrd HCDCH. She has also frle complaints with Washington. Tenant was removed from her unit due to flooding after dwelling in the unit for (2) months after the flooding. Tenants property was damaged due to the flooding, which occurred after a heavy rainfall. Roof started leaking. When she reported it, she was told that something would be done, but (2) months went by before something was done. She was then removed from her unit and given another unit until the previous orre was repaired. Tenant was given (2) days to remove her belongings from the date set forth by administration as her move out date. Terurnt did not feel that this was enough time for her to move her things because of her disability and moving things up acrd down stairs, so terurnt illegally entered the new unit without permission from administration and was rnrested for it. Tenant was taken to court. Due to this, tenants emotional and mental state was disrupted mrd landed her in a mental health facility at the hospital. Curnerrtly this tenant is again filing complaints regarding the administration and maintenance because she was tofd that her unit was repaired arul that she could move back in, but when she tried to do so, she was told that there were things that still needed to be dome and chat she couldn't move in just yet. Terumt is currently paying full rent on the apartment that she is currently in and also partial rent orr the apartment that is still being repaired Terrrn:t is currently in an writ that is more expenses than her old unit so this bears a finrnrcial hardship on this tenant whose source of income is SSDI 6. (Hole Hookipa) 61 year old Currently filing complaints against administration cord mrn:agement. Tenant feels that he is being treated unfairly. He has requested for things to be repaired in his unit siech as the refrigerator and his plumbing, but has not had anything done about it. An independent plumber looked at his plumbing a month ago, but nothing came out of that. Under sink is still leak:7rg so is shower. Executive Dimwr - of Hawaii - August 18, 2003 Dear HCDCH Board of Directors: I am writing to inform you of what I believe are serious problems with the management of Management Unit 43. With the addition of new staff in November 2003, the Legal Aid Society of Hawaii in Kona resumed taking cases in the area of housing law. Since then, we have been inundated with complaints from public housing tenants residing in Management Unit 43 projects. While attempting to resolve the residents' problems, some of which are described below, we have found management to be uncooperative, unreasonable, and deceitful. Management's actions and failure to fulfill its managerial duties have understandably led to discontent among residents. Furthermore, management's actions have wasted valuable HCDCH resources. We have tried to work through residents' problems with management in a diplomatic manner. However, due to management's lack of cooperation, we aze being forced use more effective, but more costly, alternatives. To illustrate the deficiencies of the current management, I have summarized a small sample of the cases that we are assisting public housing residents with. 1 have refrained from using the clients' names to preserve confidentiality. Case Summary 1 In Apri12003, I was contacted by a client who believed that her rent had been improperly calculated at her annual rent reexamination which was to become effective on May 1, 2003. I reviewed the client's income and found that she was going to be overcharged in excess of $300 per month, well over twice what her rent should have been. I notified Ms. Lisa Faleafine-Akana by letter informing her that I believed my client was going to be overchazged due in large part to a mathematical error made in her rent calculation, which I explained in detail so that the problem could be resolved quickly. In response, Ms. Faleafine-Akana could have corrected the errors immediately and in accordance with federal statutes and regulations by using the income figures that my client had provided at her annual rent reexamination. Instead, Ms. Faleafine-Akana scheduled an "interim rent reexamination" for May 2"d, where my client would be required to again provide information regarding her income. 1 Z9 39tid tiNO~i QIti ~ti93~ NS96bE£SN~ F~;:GL EtaR7JFURR At the May 2"" reexamination, management staff reviewed my client's income statements and requested additional documentation to verify those statements, which my client promptly provided. Over three weeks aRer the meeting, neither I nor my client had received any indication that the problem had been resolved. Thus on May 28th, I faxed a letter addressed to Ms. Faleafine-Akana inquiring as to the status of my client's rent adjustment. A few days later, my client received a letter from management that was purportedly written on May 27`h, but postmarked May 30s', t The letter, written almost a month after the interim rent reexamination, requested additional documentation to verify my clients income. After receiving the letter, my client again immediately provided management with the requested information. Instead of finally resolving the problem, management responded on June 12`h by sending a Notice of Proposed Termination of Rental Agreement signed by Ms. Faleafine-Akana for non- payment of an amount of rent which management by then was certainly aware that my client did not in fact owe. On June 30`h, my client and I attended a meeting with Ms. Faleafine-Akana regazding the Notice of Proposed Termination. At that meeting, it finally appeared as if the problem would be resolved: Ms. Faleafine-Akana agreed that errors had been made in the initial calculation of my client's rent and she stated that management would finish reviewing my client's rent within two weeks of the meeting. However, on July 24"', over three weeks after the meeting had taken place, I was forced to send yet another letter requesting a response from Ms. Faleafine-Akana since neither I nor my client had been informed of any resolution to the problem. Within a week, I received yet another back-dated letter from Ms. Faleafne-Akana. The letter was dated July 10`s, meter-stamped by management's postage meter on July 11`", and postmarked by the Postal Service 17 days later on July 28`h.r The letter stated that my client's rent was to be retroactively increased from May 2002 to Apri12003 and said nothing regarding the adjustment we had requested for April to July of 2003. The letter explained that the retroactive increase was due to "recalculations of [my client's] welfare assistance and child support." Such recalculations are not permissible under federal law unless inaccurate information was provided initially, which management has never alleged. Furthermore, the letter stated that my client now required a three bedroom unit instead of the four bedroom unit in which she currently resides, even though HCDCH's own Admissions and Continued Occupancy Policy ~ This is a reoccurring theme in otrr dealings with Ms. Faleafine-Akana. We receive backdated letters from her on a regular basis. Her letter will be dated and meter stamped by Urban Real Estate's postage meter with oae date, and postmarked by the U.S. Postal Service with a later date. In some cases, letters have been postmarked over two weeks later. The letters are postmarked by the Postal Service after deadlines have passed or after follow-up letters have been sent by us requesting long overdue responses, while the dates provided by Ms. Faleafine-Akana would have met the deadlines or preempted the follow-up letters. I have spoken with the U.S. Postal Service regarding this matter and was informed that it is very unusual for such a thing to occur and that Ms. Faleafine-Akana is most likely backdating hot letters and envelopes or waiting to send them until the later Postal Service postmarked date. r My client received a similar letter at approxitnately the same time. 2 E9 39t1d t~NO>I QI 117~J31 RCQ~bFFRUR F.C : ; T ~ GQ7ISlT /GQ requires that she remain in a four bedroom unit due to the dynamics of her family. I recently received a. certified letter from Ms. Faleafine-Akana (postmazked August 2"d) purporting to be in response to my Jnly 24s' letter and claiming that a letter regazding the rent review had been sent by management on July 10, 2003; presumably referring to the letters that my client and T received after July 28°'. This recent communication included a letter, also dated July 10'", that I had not previously received which stated that my client's current rent would be lowered by over $300 and she would be provided a credit for overcharges for the previous three months. However, my client's tent is still approximately $20 higher than it is supposed to be. Though management is aware that the newly adjusted rent is higher than the amount we believe to be correct, Ms. Faleafine-Akana provided absolutely no explanation as to Why my client's adjusted rent is not in line with our calculations and thus, the problem remains unresolved. This incident with management is particulazly frustrating because the situation could have been quickly resolved by correcting obvious errors made in the initial rent calculation. Instead, over three months after contacting management to try and resolve what appeazed to be a relatively simple problem, we now have three disputes with management instead of the initial one: my client is still being overcharged for her rent; she is being improperly charged for an unlawful retroactive increase in her rent; and she is unlawfully being required to move to a smaller unit. in response to management's actions, we have been forced to file a grievance and waste HCDCH resources. Furthermore, because of the egregious nature of this case and the apparent futility of obtaining an administrative remedy (we have heard nothing from HCDCH regazding the grievance that was filed a month ago) we have come to the realization that litigation maybe our only viable means of obtaining redress. Case Summar~2 In November 2002, a client that we were assisting with other matters informed us that he had an eviction hearing scheduled based on his "chronic rent delinquency." To assist the client one of our paralegals, Maile David, phoned Lisa Faleafine-Akana to discuss the matter with her. Ms. Faleafine-Akana assured Ms. David that because the client had paid his delinquent balance he did not have to worry about the hearing. She would help the client and thus it would be completely unnecessary for the client to be accompanied by someone from Legal Aid. However, when the client attended the hearing, Ms. Faleafine-Akana, contrary to her earlier representations, urged the Hearing Board to evict the client. Ms. Faleafine-Akana falsely alleged that the tenant had failed to pay rent when due since August of 2001. In August 2001, the client had been chazged a maintenance charge which, after questioning management, he was told he need not pay because the maintenance was for ordinary weaz and teaz. Thus, the hearing board based its decision on the belief that the client had been delinquent on rent for a full 8 months prior to the time he actually did miss a rent payment due to financial difficulty suffered when his ( 3 b9 3'JHd t1Nf171 (1TH -R:9~, ~a r_o[wccono cc err r~r,.» i.+r m., government assistance payments were improperly terminated a Based on Ms. Faleafine-Akana's allegation, the hearing board issued an order of eviction, which was fortunately deferred as long as the client continued to pay his rent on time. Case Summary 3 Irt January 2003, we began assisting a client who had received a repair charge for a window that had been broken by vandalism, An unlrnown third party had thrown lug nuts through the client's window. The client called the police, who came to the client's apartment and made a report. Management was aware that the damage was caused by vandalism and the head of maintenance, Shawn Akana, even chastised the client for reporting the incident to the police. Nevertheless, the repair charge for the window later appeared on the client's rent statement even though federal regulations and the client's rental agreement cleazly state that the tenant should be chazged for damage repairs only if the "Tenant, his household or guests" "wrongfully or negligently" caused such damage. On 7anuaty 14`", I went with the client's daughter (who has a power of attorney for the client) to meet with Ms. Faleafine-Akana at the Kahaluu Project Office to discuss the problem. Management had been aware the client was unable to attend meetings outside of the home due to her poor health because they had been provided with letters from the client's doctor. However, when we arrived at the meeting, management refused to resolve the matter without the client present even though the daughter had the necessary authority to act on the client's behalf. Management said that they would send a notice notifying us when a home visit was scheduled. Because management never followed through, we were forced to follow-up with our request for the meeting and did not receive notice of any such meeting until April 2"d, two-and-a- halfmonths after the initial meeting. The notice, which was purportedly written on March 17`", scheduled a meeting for March 24°h, but was not postmarked until April 1 ° ; 7 days after the meeting was supposed to have taken place. Because the client's health has further deteriorated and she has recently spent much time in the hospital, subsequent attempts to schedule home visits have been thwarted. In addition to the cases mentioned above, we have received numerous other complaints from residents ofManagement Unit 43 regarding improper repair charges, management's n I should also note that the federal statutes and regulations distinguish between maintenance charges and rent charges and require that the two be billed separately. while a public housing tenant maybe evicted for chronic rent delinquency, a tenant may not be evicted for failure to pay a maintenance charge unless it ie found to be a material violation of the rental agteoment, the rationale boing that public housing tenants are on s limited income and it may take time to save the extta money to pay charges beyond those required for their rent. 4 S9 3917d r,Nm~ nrr. Lr comparison to the overwhelming number of complaints originating from Management Unit 43, to my knowledge we have received only one complaint regarding Hawaii Affordable Properties, another management company involved in government subsidized housing in the azea. In that case, the staff at Hawaii Affordable Properties was eager to reach an informal resolution and resolved the problem amicably and within a matter of days. The experience was reassuring in that it is apparent problems between public housing residents and management companies can be resolved rationally and efficiently. However, it further emphasizes the need for drastic changes to take place within Management Unit 43. It is clearly not in HCDCH's interest to maintain the status quo in this situation. To continue to allow Lisa Faleafine-Akana and Urban Real Estate to retain their current position will only lead to greater fiustration within the community and an ever-increasing waste of IiCDCH resources as residents and their advocates are forced to abandon informal attempts to resolve their problems for more costly, but more effective alternatives.
