<br /> r. <br /> other portions to be planted in transgenic plants for buffer <br /> zones, with provisions for the size and configuration of buffer <br /> zones; <br /> (b) reasonable control of noxious weeds, trees and <br /> other plants from the Premises; <br /> (c) erosion control measures to be maintained on the <br /> Premises; <br /> (d) location and type of buildings (if any) and <br /> improvements constructed or to be constructed on the Premises; <br /> and <br /> (e) a time schedule for completion of clearing <br /> preparation and planting of the Premises. <br /> 4.05 Cultivation of the Premises. <br /> (a) Implementation of the Quarantine Program and the <br /> Crop Development Plans. On or before March 31, 1997, Lessee will <br /> cause Permittees to complete clearing, preparation and planting <br /> of the Premises in accordance with the Quarantine Program and <br /> approved Crop Development Plan. <br /> (b) Continued Cultivation. Following completion of <br /> clearing, preparation and planting, Lessee will at Lessee's own <br /> expense, at all times during the Term (except for fallow periods) <br /> cause Permittees to cultivate and keep all of the Net Area <br /> planted in papaya pursuant to the Quarantine Program and the Crcp <br /> Development Plan. If Lessee shall at any time during the Term <br /> fail to cultivate and use the Premises in the condition and for <br /> the purposes set forth in this Lease, or to correct any Event of <br /> Default thereof by Lessee during such period as may be permitted <br /> by Lessor in writing, but in no event less than the period <br /> specified in Section 10.01 of this Lease, Lessor may at Lessor's <br /> option terminate this Lease pursuant to Section 10.02 of this <br /> Lease. <br /> 4.06 Good Husbandry. Lessee will cause Permittees to <br /> prepare, plant, cultivate, maintain, harvest and replant the <br /> Premises in accordance with the Quarantine Program and the Crop <br /> Development Plans using methods and practices of good husbandry <br /> generally recognized as appropriate for the species selected and <br /> planted, the climatic, soil and other environmental conditions of <br /> the Premises as compared to lands similarly situated or subject <br /> to similar conditions. Lessee will keep the Premises in a good <br /> cultivated condition reasonably free from weeds and other noxious <br /> growth. Lessee will comply with county grading codes and <br /> ordinances, Lessee will consult with the NRCS and will by proper <br /> construction and use of drainage ditches and cultivation <br /> practices take all reasonable precautions to prevent or arrest <br /> loss of soil by erosion. Lessee shall provide any buffer strip <br /> required by Lessor for the protection of any agricultural crops <br /> on the Premises at Lessee's own expense within the Premises, and <br /> GLS 081997 12548.6 GLS 2002 064 11 <br /> <br />
