<br /> L. <br /> (f) Addii.ional Environments Assessment. Lessee may <br /> at Lessee's sole cost and expense cause ar. environmental engineer <br /> or consultant selec_ed by Lessee to perform further document at:d <br /> data base reviews, examinations and tests to determine the <br /> environmental condition of the Premises and all buildings, <br /> improvements, structures, and equipment located on the Premises <br /> and the presence of Hazardous Materials on the Premises in <br /> addition to Baseline Assessment. Any supplement to the Baseline <br /> Assessment shall include, but not be limited to: <br /> (A) an environmental site assessment <br /> conducted in accordance with the then current standards of the <br /> American Society for Testing and Materials; and <br /> (B) sampling and testir_g of the Premises <br /> based upon conditions revealed by the environmental site <br /> assessment, including, without limitation: <br /> (1) an asbestos survey conducted <br /> according to the standards of the Asbestos Hazard Emergency <br /> Response Act protocol; <br /> (2) testing for polychlorinated <br /> biphenyls of any transformer on the Premises; and <br /> (3) soil and groundwater sampling to <br /> measure the effect of any Hazardous Discharge on the Premises <br /> revealed by the environmental site assessment, and such other <br /> sampling and testing reasonably necessary to determine the <br /> environmental condition of the Premises on the date of this <br /> Lease. <br /> (ii) The environmental consultant shall prepare <br /> such written reports as necessary to document the environmental <br /> consultant's findings and conclusions therefrom. Lessee shall <br /> cause the environmental consultant to repair any damage caused by <br /> the investigation to the Premises. Lessee shall acknowledge in <br /> writing any conditions cited in the supplement to the Baseline <br /> Assessment of the Premises. <br /> (g) Lessor's Obligation to Remove Hazardous Materials. <br /> Lessor shall conduct any remediation required by any Hazardous <br /> Materials Laws as a result of the presence of Hazardous Materials <br /> on the Premises prior to the Commencement Date and will indemnify <br /> and hold Lessee harmless for such remediation. Lessee shall not <br /> be responsible for remediation or removal of any condition cited <br /> in the Baseline Assessment. Lessor shall not be required to <br /> remove any Hazardous Materials present on the Premises prior to <br /> the Commencement Date unless such Hazardous Materials are <br /> required to be removed by law or applicable governmental agency. <br /> 5.02 Payment of Rent. <br /> (a) Payment. Lessee will pay rent in lawful money of <br /> the United States of America at the times and in the manner <br /> GLS 081997 12548.6 GLS 2002 064 14 <br /> <br />
