<br /> September 29, 1997 <br /> . - ` ~ RECENED ~ <br /> 1Lm <br /> Regarding: Bill 129 -Amending the South Kona Zone Map -7--r Bv,------------------- <br /> D°"' <br /> We, the neighbors of Ka'awaloa Orchards subdivision ("neighbors") with lots 46, ~u~ C$~q~l <br /> 76, have a vested interest in providing safety, security, and limiting liability for ourselves and <br /> our families for the maintenance of and access to the private road serving the Ka'awaloa <br /> Orchards subdivision ("subdivision"). <br /> In multiple conversations between the neighbors and Seamount Enterprises owned by <br /> Christopher Norrie, and his representative, Sally Rice, Mr. Norrie has made verbal <br /> commitments to the neighbors regarding the repair of and limiting access for the private <br /> road to the four (4) existing lots and the proposed seven (7) lots of the subdivision you are <br /> considering in Bill 129 (maximum 11 lots). The private road has already sustained damage <br /> beyond normal wear and tear caused by heavy vehicles used for Mr. Norrie's businesses and <br /> now will have to support excessive construction activity with the Agricultural Project District <br /> application. Recently, Mr. Norrie has verbally reneged on his promise to repair the existing <br /> damage caused by both heavy construction and agricultural equipment between lots 4B, 5B, <br /> 6B, 7B. <br /> Sandra Pechter Schutte in representing Seamount Enterprises, LLC has represented to Mr. <br /> Galen Kuba, Department of Public Works, and Ms. Virginia Goldstein, Planning Director, in <br /> letters dated May 29, 1997, that "there will not be any further roadway connected to this <br /> private road." Recently, Mr. Norrie has admitted verbally that an additional eight (8) lots <br /> owned by Mr. Norrie immediately adjacent to the subdivision have the right to use the private <br /> road. These eight (8) lots are 5 acres or larger and with ohana housing can thereby add <br /> sixteen (16) more houses for a potential total of twenty-seven (27) families using the already <br /> existing and damaged private road. <br /> Therefore, it is imperative that as a condition of approval and construction that: <br /> 1. Use of the private road be limited to the existing neighbors and the subject expansion of <br /> the Ka'awaloa Orchards subdivision for a total of eleven (11) lots. <br /> 2.
