It is our understanding that Bi11 <br /> 80 is now under consideration by your Committee. <br /> As you may be aware, adoption of the aforementioned <br /> Bill would violate the lot owners' rights, as contained in <br /> the Development Agreement that the County of Hawaii has <br /> signed with 1250 Oceanside Partners. Our clients are the <br /> intended and third-party beneficiaries of that Agreement, <br /> and the adoption of Bill 80 would prohibit certain elements <br /> contained in the Development Agreement if Bi11 80 applies <br /> to the Hokuli'a development.
