Mcasa9c: I understand now Mrs. Matsumoto is going to deed the road
parcel to the County. Be advised under the terms of the recorded
Road Maintenance Agreement paragraph 8 on page 6, Mrs.
Matsumoto cannot give the road parcel to the County without the
Matsumoto Subdivision owners agreeing to it. These are the same
people who have a 25% interest in road parcel 101. I am also
sending you copies of the following:

RE: Keokeo/Holu Street Traffic Barricade
Dear Harue Matsumoto,
I understand the County wants to remove the barricade again and may ask you
to dedicate the roadway lot identified as Tax Map Key 7-3-005-1'I 1. The majority
of the subdivision owners are still against the removal of the barricade due to
safety, liability and other concerns. I am writing to remind you that you are
obligated by the recorded Road Maintenance Agreement not to dedicate the road
to the County until all parties to the agreement unanimously vote to do so.
Paragraph 8 of the Roadway Maintenance Agreement states "Termination........
Harue Matsumoto agrees not to voluntarily dedicate the Roadway Lot to the
County of Hawaii."

Please be advised that my office has been retained by 3rian
McCOUrt regarding concerns as to the status of the barriers on tre
roadway accessing his residence, TMK 7-3-5-104. We remind you that
a Roadway Maintenance Agreement was recorded in the Bureau of
Conveyances on July 22, 199'?, as prepared by Sanford K. OkLra,
which requires among other things that there was an agreement to
maintain, repair and preserve the roadway lot and that an agre=_mer~
to terminate the roadway maintenance agreement will require a
declaration confirming said termination signed by all parties to
the Roadway Maintenance Agreement.
The Roadway Maintenance Agreement further states at Para glaFn
8: "Termination. Harue Matsumoto agrees not to voluntarily
dedicate the Roadway Lot to the County of Hawaii." My client ha.s
purchased his parcel with the full expectations that the terms and

public hearing regarding the private portions of Keokeo Street owned
by you and The Harry Foster Trust that was held in Kona. We were
infiormed that the Hawaii County Council received a letter from you or
your representative stating that you are willing to cooperate with
the County in regards to the opening of Keokeo Street for public use.
Z would like to remind you that you are bound by the recorded Road
Maintenance Agreement Contract not to dedicate the road to the Co~rty
until such time that the parties to the agreement unanimously vote tc
do so.
At this time none of the Subdivision Owners want to dedicate the read
to the County.
I strongly suggest you consult your attorney; not your son; about the
legal consequences of dedicating the road to the County.
