EXTENSION OF OPERATIONS
As you aze awaze, the County of Hawaii is involved in the process of selecting a
replacement technology to take the place of the subject landfill upon tazgeted closure in October
1996. Unfortunately the final selection process has been delayed and our window of opportunity
to have the new facility operating prior to October 1996 has been lost.
This letter is to notify you of our present situation and initiate a request for extending the
operation of the South Hilo Landfill for six months to a yeaz after October 1996. W"e aze not
familiar with the procedure to follow to allow the extended operation to occur, therefore, I an3
requesting procedural instructions from you on this matter.
Since time is of the essence, we await your attention to this critical request. The County
will be procuring the assistance of a consultant for major portion of compliance requirements,
however, we need to know how the start up procedure and the necessazy sequenced steps to
follow.

SUBJECT: SOUTH HILO SANITARY LANDFILL
REQUEST FOR EXTENSION OF CLOSURE DEADLINE
In accordance with 40 CFR, Part 256, Subpart H, Section 258.16 (b), the
County of Hawaii requests that the Director of Health approve an
extension for the closure of the South Hilo Landfill from October 9, 1996
to December 31, 1997. This request is based on the following:
(1) There is no available alternative disposal capacity.
The only available disposal facility on this island is the West
Hawaii Landfill at Puu Anahulu which is approximately 80 miles from
the existing landfill at Hilo. If our entire island, which spans
over 4,000 square miles, is forced to haul all refuse to Puu
Anahulu, we will most certainly experience a tremendous increase in
illegal dumping which would cause grave environmental concerns and
degradation to our island ecosystem. The County is dilligently
pursuing an alternate facility to replace the South Hilo Landfill
which will probably include a materials diversion facility and a
long-haul transfer station. Until this facility is operational,
there is really no feasible alternative available and therefore, we
feel this temporary extension is necessary.
(2) There is no immediate threat to human health and the environment.
The South Hilo Landfill is currently operating in accordance with
the requirements of Federal (40 CFR 258) as well as State (11 HAR 58)
laws. Operating procedures are outlined in detail in the South Hilo
Landfill Operations Manual dated March 1994.

The County also prepared an Interim Groundwater Monitoring Plan, and
is in the process of producing a final plan for approval. Results
of the initial groundwater samples, as detailed in the installation
report submitted in November 1995, show that none of the 47 volatile
organic compounds and 15 metals for which the samples were analyzed,
are above EPA maximum contaminant levels for drinking water. The
County will continue monitoring and analyzing the groundwater
samples as required by the State Department of Health.
The County has also contacted major airlines which utilize the Hilo
Airport and has received confirmation that there have been no
problems with birds interfering with the active runways.
Based on the above, the County feels that an extension to the deadline
for closure of the South Hilo Landfill should be granted. We would
appreciate an expeditious review and response so that we may plan our
resources for the coming year. We will continue to work with the
Department of Health in coordinating our efforts to close the Hilo
Landfill and to provide alternatives for diversion activities as well as
disposal. Thank you for your assistance. Please contact me should you

Subject: Request for Extension of Hilo Landfill Operations
Beyond October, 1996
The Office of Solid Waste Management (OSWM) has reviewed your response, of
March 12,1998, to our request for specific information regarding East Hawaii's
lack of alternative disposal capacity and the current impacts of the existing South
Hilo Landfill on health and the environment. Based on the subject submittal and
the satisfaction of the following conditions, the Department, under the authority of
Chapter 58.1-13 (h) 11) & (2) [Closure of Existing MSWLF UnitsJ, approves the
County's request for an extension of landfill operations through December 31,
1997.
1. The County shall submit the required permit filing fee of $1000 as required
as pert of its application for permit renewal. We are returning your check for $50.
2. The County shall submit, within 30 days of the receipt of this letter, a
implementation strategy and timetable indicating the solution to the issue of future
disposal capacity for the Hilo area. That solution should indicate how the proposal
will enable the County to meet the diversion goals of the State ahd County's
Integrated Solid Waste Management Plans and the County's plan to achieve the
required greenwaste diversion rates as specified.in Chapter 58.1-65 (b) Hawaii
Administrative Rules (enclosed).
3. The County shell immediately implement an interim groundwater monitoring
program in conformance with the existing County groundwater plan submitted for
review and the Department's Draft Technical Guidance Manual as discussed on
May 10, 1996, with your consultants, Harding Lawson and Associates. The

monitoring program shall include quarterly monitoring events beginning July 1,
1996, and a statistical review of the findings shall be submitted to the OSWM
following one year's sampling.
4. The County shall, by October 1, 1996, clear up ell the payment of all past
due assessments of the State Solid Waste Disposal Fea Surcharge and future
payments shall be kept current as a condition of the renewal of the Hilo Landfill's
operating permit.

As a follow up to our August 19, 19981etter, we wish to submit the information listed below in
compliance with Condition 15 of the subject permit. Our current strategy to address the future
disposal of East Hawaii refuse is to construct a Long Haul Transfer Station & Material Recovery
Facility (MRF) complex near the Hilo Landfill. The MRF, the proposed C & D landf..:..;.:...
adjoining green waste operations should divert a significant percentage of the waste stream to
minimize the solid waste to be transported to the West Hawaii Landfill for disposal. We
anticipate planning, design and construction to take approximately three years, where upon we
will begin long haul operations.
The documents listed below are attached to detail what we propose as our strategy and timetable
to implement this plan.

Prior to starting the Study and Master Planning phase of the Long Haul Transfer Station project,
we intend to conduct a feasibility study to consider other technologies, specifically awaste-to-
energy alternative. This effort is to ensure we have examined all viable technologies and aze
selecting the most suitable means of handling the East Hawaii solid waste. Should we change
our current plans to pursue an option other than a MRF, we will submit a revised strategy and
implementation schedule.

PROJECT DESCRIPTION

LONG HAUL TRANSFER STATION & MRF COMPLEX
SOUTH HILO, HAWAII
1. General Project Description
The project consists of providing the following major components to support solid waste
operations in East Hawaii:
• Long Haul Transfer Statio~i (150 tons per day)
• Material Recovery Facility (25 tons per day)
• Green Waste Diversion Operations (25 tons per day)
• Purchase and delivery of Truck Tractors and Trailers for long haul operations
The facilities will be designed and constructed to accept approximately 200 tons per day of
combined commercial and residential solid waste. Provisions shall be included for future
expansion capability without interruption of service to ongoing operations. The above
components will be sited neaz the existing South Hilo Sanitary Landfill and Hilo Transfer Station
complex. During the Study and Master Planning phase of the project, a review of technologies
in addition to a Material Recovery Facility shall also be conducted concurrently.
2. Specific Project Scope
The following aze detailed descriptions of the major components and associated work needed to
complete the project.
a. Feasibility Studv & Master flan: Conduct a feasibility study of diversion systems
to promote recycling and reuse of municipal solid waste for East Hawaii. Plan and
develop a conceptual master plan for an approximately 20 acre site to accommodate
the construction of an Access Road, Scale House, Long Haul Transfer Station,
Material Recovery Facility, Green Waste Diversion Operation and Baseyazd Off ce.
Scope shall also include future development for facilities to accommodate
sludge/animal rendering to support a composting operation, construction and
demolition waste, metal reclamation, tire shredding and battery storage area.
b. Access Road and Utility System Upgrades: Design and construct an access and
circulation roadway network to support the new Long Haul Transfer Station/MRF
complex. Including any realignment and improvements to existing roadways. This
also includes all necessary upgrades to existing utilities necessary to support the Long
Haul Transfer Station, with means of future expansion to support future facilities
without interruption to service. Utility system upgrades include, but are not limited
to, electric, telephone, water (for potable use and for fire protection), drainage and
wastewater requirements.
c. Lone Haul Transfer Station and Basevard Office: Design and construct a long
haul transfer station adjacent to the Hilo Landfill. The facility will be comprised of a
completely enclosed and covered facility to receive refuse from residential and
commercial vehicles. Either a tip floor or direct dump operations shall be provided to
load refuse into long haul trailers at agrade-separated drive through roadway. The
project shall include all necessary improvements, fixed or portable equipment that
will accommodate the following requirements:
(1) Serve to replace the existing residential transfer station at Hilo and to accept all
commercial solid waste.
(2) Be capable of handling 150 tons per day (average) of refuse.
(3) Facility shall operate seven (7) days/week, 10 hours/day, 365 days/year.
(4) Permit the routine inspection of loads for hazardous material.
(5) Interior facility requirements and equipment to facilitate operations of receiving
refuse, bulk sorting, directing residential and commercial users, and any
equipment needed for the safety of transfer station personnel and customers in
operating the transfer station.
(6) Office space to support approximately 18 baseyazd personnel. With space for
dispatch, a supervisor's office, atraining/conference room, a break room with
complete kitchen facilities (including appliances), safety equipment storage and
personal equipment lockers, sepazate men and women's shower and restrooms..
(7) Pazking for assigned personnel.
(8) Scale and Scale House facility fully outfitted for operation with restroom
facilities.
(9) Security fencing, alarm monitoring for all facilities and landscaping
improvements as required.
d. Material Recovery Facility: Design and construct a covered and enclosed space for
private operation for a Material Recovery Facility. The facility shall be made an
integral part of the transfer station to permit efficient operation. The facility shall be
initially sized for 25 tons per day operations with expansion capacity to 50 tons per
day.
e. Long Haul Tractors and Trailers: Purchase and delivery of tractors and trailers
compatible with the transfer station operations and in sufficient quantities to handle
hauling 200 tons per day from the East Hawaii Transfer Station to the West Hawaii
Landfill, with one spaze trailer unit.
f. Transfer Station Equipment: Purchase and delivery of heavy equipment to operate
the Transfer Station, such as Front End Loaders or Backhoes.
g. Demolition of Existine Hilo Transfer Station and Offices: Demolish the existing
Hilo Transfer Station and Baseyard Office buildings. This shall include the
dismantling of compaction equipment for reuse by the Solid Waste Division and
delivery of the equipment to the Schultz Siding Baseyazd. Restoration of the site to
match the surrounding grade, to include regrassing of the azea. Consideration shall
also be given to converting these facilities for other uses that could supplement
recycling or other solid waste operations.
h. Permits, Operations Manual & Training: Secure all necessary permits and
approvals to design, construct and operate the Long Haul Transfer Station/MRF
complex. In addition; prepaze the necessary Operations and Safety Manual for the
transfer station and MRF operations. Including the training of Solid Waste Division
personnel.

GREEN WASTE DIVERSION PLAN R'gjt~..
SOUTH HILO SANITARY LANDFILL
A. BACKGROUND:
During a 1996 Waste Composition Study done by the Rural Community Assistance
Corporation, the Hilo Sanitary Landfill was receiving the following tonnage of green
waste from July 1, 1995 through June 30 1996.
Residential Green Waste 7,860 tons/yeaz
Commercial Green Waste 2,280 tons/vear
Total 10,140 tons/yeaz
In January 1997 the Department entered into a contract with Renew Hawaii to divert
green waste from the Hilo Landfill In their first yeaz of operation, approximately 1,498
tons of green waste was diverted. This represented a 66% reduction in commercial green
waste. Renew Hawaii has entered into a new contract with the County to provide
additional services that will hopefully increase the amount of green waste being diverted
from the landfill.
Residential green waste is still being disposed of at all transfer stations except the Hilo
Transfer Station. Renew Hawaii leas recently set up a roll off container at the Hilo
Transfer Stations and has started diverting approximately 20 tons per month, projected to
be about 240 tons per year.
B. EXISTING RESTRICTIONS
1. Commercial Green Waste:
Tree Trimmings & Other Clean Material: Restricted from landfill. All diverted
to Renew Hawaii.
2. Residential Green Waste:
Hilo Transfer Station: All green waste diverted to Renew
Hawaii roll off container.
Other Transfer Stations: No restrictions, except waste cut to
4-foot lengths.
C. DIVERSION PLAN:
L Commercial Green Waste Diversion:
Current Diversion Rate: 66%
Desired Diversion Rate: 75%
The existing green waste diversion contract with Renew Hawaii accounts for 66%
diversion of green waste. Loads of commercial green waste are still being taken to the
landfill because they aze contaminated with other refuse. The following is a projected
plan to further reduce the commercial green waste going to the landfill.
FY 1998/1999 Increased education by County and Renew Hawaii for
commercial and government agencies.
FY 1999/2000 Introduce ordinance to ban all commercial green waste
from the landfill
2. Residential Green Waste Diversion:
Current Diversion Rate: 3%
Desired Diversion Rate: 50%
The Department is investigating establishing green waste diversion operations at all rural
transfer stations in East Hawaii. We have significant concerns about security at these
transfer stations that have prevented the timely implementation of this proposal. For
years the rural transfer stations have been ungated and aze monitored periodically during
the day. Gating these transfer stations would be a major social change in how residents
dispose of their refuse. We anticipate that vacant lots and remote roadways would
become littered with trash when the transfer stations are gated creating a health hazard.
However, the Department plans to initiate the following actions to meet the goals
established in Chapter 58.1.
Initiate a CIP Project to Gate all Transfer Stations February 1999
RFP for Green Waste Diversion at Rural Transfer Stations May 1999
Design Complete August 1999
Begin Public Education for Green Waste Diversion October 1999
Construction Complete January 2000
Initiate Green Waste Diversion at Transfer Stations January 2000

Landfill (MSWLF?, Application No. LF-0039-98
The Department of Health, Office of Solid Waste Management (OSWM) acknowledges
the receipt of the approval by the Federal Aviation Authority (FAA) of your
demonstration that the landfill does not pose a bird hazard to the Hilo Airport. In
addition, we have received the draft response relating to the development of alternative
waste management capacity for East Hawaii as required under Special Condition II-15 of
the existing permit. As such, we have determined that your application is complete and
are initiating review.
Currently, the facility is operating under the conditions established within permit number
SW-0002-86 which expires on October 9, 1998. Hawaii Revised Statutes (HRSI,
Chapter 342H-4(el allows an applicant for renewal of a permit to continue operations
"during the pendency of the applicant's application provided that the applicant acts
consistently with the permit previously granted, the application, and all plans,
specifications, and other information submitted."
Our preliminary comments relating to your submittal are as follows:
1 . The time frame proposed for the planning and implementation of alternative waste
management capacity, as required under Special Condition II -15, is not
consistent with previous commitments made by the County. While we recognize
the delays in the implementation of the alternative capacity caused by the landfill
privatization issue, they should not have warranted the County in halting the
entire planning process. The proposed assessment of technologies should have
been completed prior to the permit renewal.

As discussed in our letter of September 15, 1998, the Department will be limiting
the subject permit renewal to two additional years, with the potential for
extension based on the County's performance. Should the development of the
alternative waste management capacity, required under condition II-15, need
additional time, the Department will consider a request for an extension only if the
County can demonstrate significant progress in providing the required alternative
capacity.
In addition, Specific requirements for the proposed transfer station, materials
recovery facility, and greenwaste diversion program will be included within the
new permit conditions.
3. The permit renewal review process requires that the owner/operator provide
public notification of the intended action. The goal of the public notification
process is to inform the public of your plans and to allow for the exchange of
ideas. The OSWM strongly believes that the community should be actively
engaged in the development of your waste management plans. We therefore
request that public informational meetings be held within the community, prior to
the formal public notice required as part of the permit renewal. Please provide us
with a schedule of the proposed informational meetings so we may observe the
proceedings.

As a follow up to our March 9, 1999 meeting regarding the subject permit renewal,
attached is a milestone schedule of our plan to select an alternative means of managing
our solid waste in East Hawaii. The attached schedule allows us adequate time to work
towards acommunity-based understanding and support for an altemative to operations at
the Hilo Landfill. Therefore, we request approval to continue existing operations at the
South Hilo Sanitary Landfill until December 31, 2003.

design fora $5 million long haul transfer station facility immediately. In addition, we

update of Hawaii County's Integrated Solid Waste Management Plan will permit a mute
comprehenstve tevicw of alternanves to the sang haul option to make sure the alternative
selected will be a long term solution and not just a quick fix.

Subject: Permit Renewal for South Hilo MSWLF and
East HawaiPs Solid Waste Management Plan
Thank you for your interest in an issue that has been of continuing importance to the
Department of Health, Office of Solid Waste Management (OSWM). The pending
exhaustion of South Hilo Landfill's capacity, and the need for more definitive plans for
future waste management in East Hawaii have been of concern over the pest few
years.
Briefly, the original landfill p~-~ it for South Hilo Landfill expired on March 1, 1996.
Biased on estimateo remaining capacity at that time, an approval letter dated
May 15, 1996 was issued by the OSWM extending the expiration date to
December 31, 1997. The approval letter con4ained conditions that included:
1. The submission of an implementation strategy and timetable to address the
disposal capacity for the East side area within 30 days of receipt of the letter.
2. Implementation of an interim groundwater monitoring program to meet
regulatory standards in effect since October 1991.
We received a draft plan and implementation schedule in 1998 for a proposed
combination materials recovery facility, long haul and greenwaste facility, which was
scheduled for completion by June 2002. However, the plan did not address the
interim management of East Hawaii waste. The landfill groundwater monitoring
prograrrt has been implemented.
The County of Hawaii requested in a letter dated July 14, 1998 that the permit be
renewed to December 31, 2003. Since the County had a renewal application on file

with the OSWM when the original permit expired in 1996, the OSWM issued an
October 6, 1998 letter which stated that the County may continue to operate the
landfill. Please note that OSWM's letter was based on Hawaii Revised Statutes
342H-4(e), which allows the applicant for renewal of a permit to continue operations
_ "during the pendency of the applicant's application provided that the applicant acts
consistently with the permit previously granted, the application, and all plans,
specifications, and other information submitted."
In a December 14, 1998 letter, the County of Hawaii reported the remaining landfill
capacity was nine months. Thus, we expected the landfill to begin closure activities in
1999. However, the OSWM received a copy of a Draft Operations plan dated January
2000 that estimates landfill capacity to December 2003 with a landfill height of 60 feet
above grade, which has already been exceeded, or otherwise needs to be clarified.
This document, if it is to be finalized by the County, would need to be reviewed and
discussed with Mr. Lany Capellas, your Curcent solid waste administrator.
We understand from a January 10, 2001 telephone conversation between
Mr. Gary Siu of our staff and Mr. Capellas that the County intends to reevaluate all
landfill operations' remaining capacity and available options for future solid waste
management in East Hawaii. Thus, in light of the information received by the OSWM,
we would like to see more definitive plans for future waste management and proposed
landfill operations submitted and committed to, prior to the issuance of a written
permit.
The OSWM will be contacting Mr. Capellas with the intent to resolve the issues of
permit renewal and future solid waste management activities. We note that future
plans for East Hawaii's solid waste management activities have remained a pending
issue since 1996; meanwhile, landfill capacity is being consumed. We believe that
definitive planning of East Hawaii's solid waste management is critical.
