Tyler III [jct3kona@hawaii.rr.com] <br /> <br /> Sent: Tuesday, June 14, 2005 12:21 PM <br /> <br /> To: County Council Tx <br /> Subject: Bills 29, 30, 31, 32 (6-14-05 Planning Committee Mtg) <br /> <br /> Aloha Co-Chairs Hoffmann & Pilago and members of the Planning Committee, <br /> In the past I have provided you with testimony in support of these <br /> bills due to their consistency with the General Plan, proposed <br /> improvements to address infrastructure concurrency, and avoidance of <br /> urban sprawl. My position remains unchanged. <br /> It has also come to my attention that your committee also will be <br /> <br /> considering Communication 106.52, which proposes amendments to Bill 30. <br /> I have reviewed this communication and offer the following comments for <br /> <br /> your consideration: <br /> I. Proposed amendments to Conditions F, G, I and the new J clearly <br /> relate to improving concurrency of roadway <br /> infrastructure/interconnectivity and public safety and significantly <br /> improve the bill, especially in light of previous public testimony. <br /> II. The addition of new condition I and amendments to old condition L <br /> are appropriate since they timely addresses flooding issues prior to <br /> occupancy and will be in the interest of public safety. <br /> III. The addition of Condition U proposing a land set-aside for a <br /> school site and up to $600,000 in building or other structural <br /> improvements thereon and the facilitation of the opening of a school <br /> prior to occupancy of any rezoned area is quite astonishing, and its <br /> authors and the developer are to be commended for their willingness to <br /> explore this obvious community benefit. One further comment: due to the <br /> proximity of Kahakai Elementary School, I believe the right of first <br /> refusal to utilize this site/facility should be given to an existing - <br /> Kona public charter or private school that is in need of such space. <br /> c_ <br /> IV. The proposed amendments to new condition V, granting additional <br /> <br /> fair share credits for some of these proposed improvements seem <br /> appropriate, especially given the significance and magnitude of the ~ <br /> improvements. <br /> <br /> V. The proposed amendments to old condition U (renumbered to X) which <br /> provide specific percentages of housing for 80% of the median income <br /> and not to exceed 120% of such income are also commendable and should <br /> be incorporated as well. They address a true public need. <br /> While I recognize that some members of the Kona community may still not <br /> feel comfortable with these proposals, it is my personal feeling that <br /> such proposals do establish a new paradigm and standards which will not <br /> only improve the standard of living for those who will occupy the <br /> residential units, but, more importantly, at least in my mind, improve <br /> the quality of life for those and many other residents who will benefit <br /> from the proposed infrastructure improvements. <br /> Thank you for the opportunity to provide these comments and your <br /> careful consideration of them ComM.
