No. 107/Bill No. 31 <br /> PLACE: Council Chambers <br /> TIME: 1:10 p.m. <br /> Council Chair and Members <br /> Hawaii County Council <br /> Hilo, Hawaii 96720 <br /> Your Committee on Planning, to which was referred Communication No. 10"7 and Bill No. 31, <br /> transmitted by Vlayor I-tarry Kim, dated February 8, 2005, regarding a State Land Use Boundary <br /> Amendment request by Puaa Development, LLC, at Puapua'aiki Is` and Puapua`anui Is`. North <br /> Kona. Hawai'i,'I'MK: 7-5-17:1 reports as follows: <br /> Bill No. 31 seeks to change the State Land Use District Boundaries Map, H-7 and H-8, by changing <br /> <br /> the District Classification of approximately 14.973 acres of land from Agricultural to Urban District. <br /> Communication No. 107 reports the Hawaii County Planning Commission, as required by the <br /> Hawaii County Charter, Chapter 4, Section 6-43(C), considered the above request and <br /> <br /> accompanying Bill No. 32 on January 21, 2005. At this meeting, the Commission's vote to approve <br /> <br /> the Planning Director's favorable recommendation was recorded as three "ayes" to two "noes". <br /> Because there was not five affirmative votes, the vote constitutes a "no action" and, therefore, is <br /> <br /> recorded as an unfavorable recommendation. Communication No. 107 also transmits the favorable <br /> <br /> recommendation of the Planning Director; Communication No. 107 reports, in synopsis, the <br /> <br /> following: <br /> I . 'The applicant, Puaa Development, LLC, is requesting a State Land Use Boundary <br /> amendment for 14.973 acres from the Agricultural District to Urban District. <br /> 2. The subject property is located along the west (makai) side of the Hawaii Belt Road <br /> (Highway 11) and across from the Pualani Estates Subdivision. <br /> 3. "fhe applicant is also requesting a concurrent change of zone (Bill 32) from an Agricultural <br /> 5-acre (A-Sa) to a Neighborhood Commercial - 20,000 foot (CN-20) district. Because the <br /> County administration is trying to promote housing in the Kailua-Kona area, one proposed <br /> condition of zoning would require some units of housing to be developed onsite (housing is a <br /> permitted use in a CN zone). <br /> 4. The applicant proposes to develop a neighborhood commercial shopping center. <br /> 5. The reclassification action will not be inconsistent with the County General Plan as the <br /> request conforms to the Economic and Land Use goals and policies of the Plan and also <br /> conforms to the General Plan Land Use Pattern Allocation Guide (LUPAG) Map which <br /> designates the area as lJrban F.,xpansion Area. <br /> PC REPOR"1' NO. 26 <br /> <br />
