AN ORDINANCE AMENDING CHAPTER 15, ARTICLE 1, SECTION 15-7, OF THE HAWAII COUNTY CODE 1983 (2005 EDITION), RELATING TO PARKS AND RECREATION. BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII: SECTION 1. The purpose of this measure is to amend Chapter 15 (Parks and Recreation) by removing imprisonment as a penalty, with a fine remaining as a penalty. SECTION 2. Chapter 15, article 1, section 15-7, of the Hawaii County Code 1983 (2005 edition), is amended to read as follows: "Section 15-7. Penalty. Any person convicted of violating any provision contained in this chapter shall be punished by a fine not exceeding $1,000 [or ~ ..,.,......,::t :et to e«,,,,°a <<- d y ' ~ ~ y u, er-~s~r,] and shall be adjudged to pay all costs of the proceedings. In addition to the penalties provided herein, the County may recover for damages to its property, the measure of which shall be the cost of repairing, replacing, or rebuilding the property injured or destroyed." SECTION 3. Material to be repealed is stricken and bracketed. In printing this ordinance, the brackets and bracketed material need not be included. SECTION 4. If any provision of this ordinance, or the application thereof to any person or circumstance, is held invalid, such invalidity shall not affect other provisions or applications of the ordinance which can be given effect without the invalid provision or application, and to this end, the provisions of this ordinance are declared to be severable. SECTION 5. This ordinance shall take effect upon its approval.
