Final Plan Approval for the proposed developmert was issued by thie ofl9ce on <br /> November 30, 1990 and a building permit was issued on January 25,1991 in compliattce with <br /> conditions of approval. The proposed cvmdominir~ project was never constructed. <br /> By letter datod February 10,1999 to Libby ICemiatrgi, we confirmed the validity of SMA Use <br /> Permit No. 276, provided that a review of say changes to the physical con5gmratioon of the <br /> proposed project be conducted by the Kaiw Village Design Comroiwion. Such roview occurred <br /> on April 13, 1999, with the Kailas Village Design Commission voting to recomm~d its <br /> approval subject to conditions. <br /> In direct rosponse to your question, SMA Use Permit No. 276 remains valid and will permit the k <br /> wnstrnction of a 48-unit condominium development and its related improvemoots provided that ~ <br /> the scope of the project is generally consistent with the scope of improvements approved by the ~'j <br /> Piatming Commission in 1989.
