I have reviewed Council <br /> member Pilagds transmittal letter and his amendment to Bill 162. I disagree with the <br /> amended language of Condition H in his Draft 2 of Bill 162. I feel that the requirements <br /> stated therein are excessive given the circumstances. <br /> Furthermore, I do not appreciate the misuse of my name in the transmittal letter. Mr. <br /> Pilago implies that I requested the excessive requirements of his Draft 2 amendment to be <br /> imposed upon the applicants. You will recall that during our discussion in the <br /> November 22, 2005 council meeting, I stated that Condition H needed additional <br /> language. However, at no time did 1 suggest, imply, or otherwise propose this <br /> unwarranted condition. My comment at the council meeting was to treat all applicants <br /> fairly. Therefore, the language I am proposing for Condition H, via Draft 3 of Bill 162, is <br /> lair to all applicants and is a standard requirement for subdivision approval <br /> My proposed amendment to Bill 162 is as follows: <br /> H. Prior to submittal of a subdivision application for the subject propertv, the <br /> applicant shall upon consultation with surroundine propertv owners and <br /> other concerned public agencies_,_prepare and submit a drainage plan <br /> relating to the proposed subdivision for review and approval of the <br /> Department of Public Works The approved drainage plan shall reflect all <br /> development venerated runoff to be retained or disposed of on-site and <br /> shall not alter anv existing water courses that may be entering or exiting <br /> the subject propertv or be directed toward anv adjacent properties. <br /> Furthermore the approved drainage plan shall be implemented prior to or <br /> in conjunction with the issuance of final subdivision approval. jtlll <br /> Cornm.
