CONDITIONS TO BE DELETED <br /> 12. The following conditions are proposed to be deleted as they are no longer <br /> applicable or have already been satisfied (refer to draft ordinance for wording <br /> of the conditions): <br /> Conditions B, C, D, E, F, G, H, I, 7, K, O, P and Q. <br /> CONDITIONS TO BE RETAINED <br /> 13. The following conditions will be retained (refer to draft ordinance for wording <br /> of conditions): <br /> Conditions A, L, M and N. <br /> EFFECTIVE DATE OF ORDINANCE AMENDING ORDINANCE NO. 93 45 <br /> 14. In order to preserve the existing land use entitlements for the Hiluhilu's property <br /> currently granted under Ordinance No. 93 45, this amendment shall become <br /> effective only upon the adoption of the Hiluhilu Project District Ordinance. <br /> RECOMMENDATION <br /> Ordinance No. 93 45 includes the Makalei Estates Subdivision (272+ acres) and <br /> approximately 450 acres of land owned by Hiluhilu. As stated earlier, should the <br /> accompanying change of zone application filed by Hiluhilu be approved by the County <br /> Council, the land owned by Hiluhilu has to be deleted from Ordinance No. 93 45. <br /> Makalei Estates Subdivision would then be the only area covered under Ordinance No. <br /> 93 45. Consequently, all conditions that would no longer be applicable to the remaining <br /> azea covered under the ordinance or have already been satisfied should be deleted. In <br /> essence, the proposal to amend the ordinance by deleting the area proposed for a Project <br /> District development by Hiluhilu and to delete certain conditions that would no longer be <br /> applicable to the Makalei Estates Subdivision should the Project District application be <br /> granted can be considered merely "housekeeping changes". It should be noted that some <br /> of the deleted conditions, particularly with regard to the construction of certain roadways, <br /> are proposed for inclusion in the Hiluhilu Project District Ordinance. <br /> Finally, the Planning Director is also proposing that the date of this amendment <br /> <br /> become effective only upon the adoption of the Hiluhilu Pro}ect District Ordinance by the <br /> County Council. <br /> 3 <br /> <br />
