<br /> ~ s <br /> §11-46-4 <br /> appropriate by the director. <br /> (c) Noise levels shall not exceed the maximum <br /> permissible sound levels for more than ten per cent of <br /> the time within any twenty minute period, except by <br /> permit or variance issued under sections 11-46-7 and <br /> 11-46-5. <br /> (d) For mixed zoning districts, the primary land <br /> use designation shall be used to determine the <br /> applicable zoning district class and the maximum <br /> permissible sound level. <br /> (e) The maximum permissible sound level for <br /> impulsive noise shall be ten dBA above the maximum <br /> permissible sound levels specified in Table 1 of <br /> subsection (a). This chapter shall not <br /> apply to the following: <br /> (1) Any authorized emergency vehicle or vehicles <br /> responding to an emergency call or acting in <br /> an emergency; <br /> (2) The sounding of any emergency signaling <br /> device, including but not limited to civil <br /> defense warning systems, burglar and fire <br /> alarms, sirens, whistles, or similar <br /> signaling devices; <br /> (3) Activities related to the emergency <br /> maintenance and repair of state and county <br /> highways, parks, and public utilities <br /> including but not limited to water, sewer, <br /> electric, gas, and telephone systems, <br /> provided the noise is confined to only the <br /> equipment in use; <br /> (4) Operation of emergency generators, when <br /> installed and used as required and necessary <br /> for the protection of public health and <br /> safety, provided the best available control <br /> technology is implemented; <br /> (5) Backup alarm devices on any vehicle, where <br /> such device is required by federal or state <br /> occupational safety and health regulations; <br /> (6) Construction and remedial activities related <br /> to the emergency repair of damages caused by <br /> 46-8 <br /> 1469 <br /> <br />
