The Secretary's Minutes of the Executive Committee Meeting of August 22, 1997 were approved and placed on file (attached for information). The Treasurer's report for August 1997 was approved and placed on file (attached for information). Under NACo reports, there was discussion whether the NACo dues increase provided fora 2.8% per yeaz increase in perpetuity or if there would be a reevaluation after the next census. President Mansho will send a letter to NACo requesting confirmation and clarification of this policy. It was also reported that Secretary-Treasurer Al Smith will be attending the next WIR Board Meeting in Santa Fe, New Mexico in place of HSAC President Rene Mansho. Each Board member is allowed to attend three Board Meetings at HSAC's expense. If the WIR board member fails to attend three board meetings, HSAC will consider reimbursement to the County of Hawaii for the Secretary-Treasurer's trip. Under Unfinished Business, action on items relating to United States-Air Rights Negotiations, Privatization, Counties to designate Enterprise Zones, a statewide uniform alcohol substance abuse testing policy, and the proposed Interim Amendments Dividing Duties of Secretary- Treasurer, were all deferced pending action by the other counties. The Proposal for Avionic/Aerospace Micro Industries was also deferred pending the receipt of additional information about the industry. Under New Business, the Hawaii Winter Baseball League made a presentation about their professional baseball league program and requested that HSAC support legislation asking the ~ ~a tRl, I... It was suggested, by the Executive Committee, that the league approach each individual County for support. Next, the Executive Committee discussed proposals for the 1998 HSAC Legislative Package. Items suggested for inclusion in the package were Privatization, Tort Reform, Transient Accommodation Tax, and the Indemnification of the Counties when issuing building permits on Hawaiian Home Lands. HSAC has requested that each County Council submit proposals for the 1998 Legislative Package (Communication Attached. Action Requested). Next under New Business, the Executive Committee reviewed the HSAC Legislative Program Policy Statement. Annually, HSAC adopts a program policy statement as a guide for its legislative program. The Policy Statement was referred to counties for consideration (Proposal Attached. Action Requested). Under announcements President Mansho informed the committee about aJapan-American Conference Of Mayors and Chamber of Commerce Presidents to be held November 10-13, ]997 in Honolulu. There being no further business, the meeting was adjourned. The next HSAC Executive Committee meeting is scheduled for November ] 4, 1997 at 9:00 a.m. in the Honolulu Council Committee Room. WIR Report Under WIR Reports, President Mansho reported that the next WIR Board Meeting will be October 8-I 1, 1997 in Santa Fe, New Mexico. President Mansho indicated that she intends to bring up the open skies and air rights issues at the WIR. Other issues or concerns for our National Legislative Package should be submitted to HSAC immediately. President Mansho also announced that future WIR Conference sites are Juneau, Alaska (1998); Concord, California (1999); and Boise, Idaho (2000). V. UNFINISHED BUSINESS A. United States Air Rights Negotiations The purpose of this item is to act on HSAC's proposal to support Honolulu Council Resolution 97-126, CD1, urging the United States Department of Transportation to recognize Hawaii's geographic constraints during air rights negotiations. This matter was deferred pending official action by Hawaii and Maui Counties. B. County Authority to Designate Enterprise Zones The purpose of this item is to act on HSAC's proposal to support Honolulu Council Resolution 97-212, urging the Hawaii State Government to comply with Section 209E-4 of the Hawaii Revised Statutes, which authorizes the counties to designate enterprise zones. This matter was deferred pending official action by Hawaii, Kauai, and Maui Counties. C. Request for Special Session to Resolve Issues Relating to Privatization The purpose of this item is to act on HSAC's proposal to request the Governor and the State Legislature to convene a special session to resolve matters relating to privatization. Maui County indicated that technically, they did not pass or approve this resolution, but indicated that the Maui Council is on record with all nine members and the Mayor have urged a special session. Honolulu Council reported that Honolulu Council Resolution 97-217 is still pending before it's Policy Committee. This matter was deferred pending further action. VI. NEW BUSINESS A. Statewide Uniform Alcohol and Substance Abuse Testing Policy 3 The purpose of this item is to discuss HSAC support of a Honolulu Council Resolution 97-217 urging the Governor and the four counties of the State to collectively establish a statewide uniform alcohol and substance abuse testing policy. This item is to be referred to the county councils for consideration. B. Proposed Interim Amendments Dividing Duties Of Secretary-Treasurer Communication from Al Smith, HSAC Secretary-Treasurer, to Rene Mansho, HSAC President, dated August 5, 1997 proposes interim amendments to the HSAC bylaws and policies dividing the duties of the Secretary-Treasurer into two separate Offices. The proposal also eliminates the Office of Second Vice President. After discussion, this item was referred to the county councils for consideration. C. Resolution on UPS/Teamsters Strike The purpose of this item is to discuss a resolution entitled "Urging United Pazcel Service and the Teamsters Union to Bargain in Good Faith to Resolve the Strike Quickly." This resolution was filed by the Executive Committee. D. A Conceptual Proposal for Avionic and Aerospace Micro Industries Secretary-Treasurer Smith submitted to the Executive Committee, a conceptual proposal for the location of avionic and aerospace micro industries in Hawaii. Mr. William Hachmeister, author of proposal, is offering HSAC an opportunity to become involved in national/international aviation safety security issues and is soliciting HSAC's support for his proposal. Mr. Hachmeister suggests that many of the electronic components used in avionics and aerospace aze subject to designs which will over stress when energized by a 55 volt pulse. He further submitted that electrical static discharge "ESD" can and usually does produce an electrical spike greater than 55 volts. Mr. Hachmeister proposes that the micro electronic industry which produces these components for avionics and aerospace be relocated from areas where the natural state ESD is present to areas where the natural state ESD is neaz zero. Mr. Hachmeister advises that Hawaii is one such location where the natural state ESD is near zero making it a prime site for such industry relocation. The Executive Committee expressed some interest in this matter, however agreed that more information was needed. It was suggested that this matter be deferred 4 and that Mr. Hachmeister be invited to provide a more detailed and definitive plan on this matter, either personally or in written format, for our next Executive Committee Meeting in September. E. Federal Empowerment Zones Councilman Tehada informed the Executive Committee that the U. S. Senate has just amended the eligibility criteria for Federal Empowerment Zones and Enterprise Communities so as to recognize the economically depressed areas and unique characteristics of Hawaii and Alaska. Since the establishment of this program, Hawaii and Alaska have not been able to access funds available to address serious condition of homelessness, substandard housing and lack of economic opportunity. Conference deliberations between the House and Senate on this matter will begin shortly. This matter was for information and placed on file. If your council would like to add any item to the HSAC Legislative Package for 1998, please submit it to me by October 31, 1998. 1998 HSAC LEGISLATIVE PROGRAM POLICY STATEMENT The Hawaii State Association of Counties (HSAC) shall be guided by the following policies during the 1998 legislative session: 1. The Executive Committee shall determine the strategy for HSAC's efforts during the Legislature. 2. An HSAC officer or designee shall testify before the Legislature on proposals in the 1998 HSAC Legislative Package and, with the consent of the Executive Committee, other measures that may impact the counties. 3. In response to emergencies or time constraints during the legislative session, the HSAC President or Executive Committee may take necessary actions: A. Supporting legislative proposals that are consistent with the HSAC Legislative Package; or B. Opposing legislative proposals that are detrimental to all counties or inconsistent with the HSAC Package. The HSAC President or Executive Committee shall not take an action under this paragraph if such action is opposed by at least one Executive Committee member or council.
