MAHUNA, POLICE CHIEF SUBJECT POLICE DEPARTMENT FISCAL YEAR 2007 BUDGET COUNCIL BUDGET HEARING QUESTIONS This is in response to questions raised by Ms. Virginia Isbell, County Council Finance Committee Chair, at the March 29, 2006, Council Budget Hearing. In addition to the following responses, attached are also our department's responses to the March 16, 2006, correspondence from the Legislative Auditor's Office, with questions for the Police Department on our Fiscal Year 2007 Budget. 1. High School Cadet Program Staff has organized a curriculum for the cadet program that identifies the locations of the classes, class courses, instructors, and time element for each class. Position descriptions for the Cadet Coordinator and Police Cadet have also been drafted. Additionally the Cadet Mentor position descriptions have also been drafted for the following areas/section that the Police Cadets will be working in, Criminal Investigation Section; Community Policing; Central Communications Center (Dispatch); Driver Licensing Section; Juvenile Aid Section; Patrol, and the Records & Identification Section. Partnerships with both the Hawaii Community College and University of Hawaii at Hilo Criminal Justice programs have already been established and both are willing to participate in the program and assist us. Staff will be scheduling meetings with them during April 2006, to discuss their assistance with our program, reseazch possible scholazships for the program, and other possible sources of those needing financial assistance. tt,, Issues that still need to be resolved by staff include, Comm. ()df~i SUBJECT POLICE DEPARTMENT FISCAL YEAR 2007 BUDGET COUNCIL BUDGET HEARING QUESTIONS PAGE 2 Any compensation that will be provided to Police Cadets, i.e. educational assistance, payroll, etc. The entry criterion; specifically the type of written examination to be administered and any physical requirements that may be imposed. Minimum educational requirements, allowing those interested in the program, however are not enrolled in a college or training institutions/programs due to financial hardships. The transition from a Police Cadet into a Police Officer I position. Additional personnel assigned to the Training Section to coordinate and manage the program and the funding source. Uniforms (purchase/selection) and equipment. Note: Staff has begun looking into this issue. 2. Laptop Computers For Field Reporting Refer to Attachment 1 (Legislative Auditor's Questions) Item #15 3. Capital Improvement Project, Towers for Microwave After approximately 2 1/2 years of planning, environmental assessment, site acquisition and permitting, the new microwave system will become a reality in October 2006. A burn-in period of 60 days will ensure reliability and continuity of the new system, and enable dispatching to be seamless and dependable. 4. Capital Improvement Project, 700 MHZ Communication System Refer to Attachment 1 (Legislative Auditor's Questions) Item #13 5. Capital Improvement Project, S. Koua Police Station In response to your request concerning the acquisition of the South Kona property, the latest update is that Major John Dawrs attended a meeting between Joe Alban and Finance Director William Takaba on March 22, 2006. Alban is aware of our interest in obtaining 3.5 acres of the north end of the property, to include the warehouse. Alban plans to establish a coffee shop in the former Mune's gas station and a new renovated health food store within the warehouse. SUBJECT POLICE DEPARTMENT FISCAL YEAR 2007 BUDGET COUNCIL BUDGET HEARING QUESTIONS PAGES Alban submitted a sketch of the property, whereby a 60-foot frontage would be available for the Police Department at the north end of the property and property extending south in back of the warehouse and gas station. In reviewing the sketch, I find that it is not a viable option, as visibility to the South Kona Police Station would be completely lacking. The second option was presented that would locate the South Kona Police Station in the location where the Kona Theatre is presently situated. This would require demolition of the structure; and due to the fact that some of the residents feel that this Theatre is a historical land site, it is felt that the added cost of demolition and the negative publicity that the demolition of the Kona Theatre would entail make this site also not feasible. A third option was presented for the County to lease the property. Takaba felt that purchasing the property would be a clear advantage for the County, and it would not remove the negative publicity that the demolition of the old Kona Theatre would entail. A fourth option was presented by Alban and this was constructing the facility in almost the same location. Takaba along with the Police Department feel that this would also not be a recommended option. You had inquired if the Department had any other parcels of land in the South Kona azea that we would be considering. The most salient property would be the property formerly owned by the Jack B. Greenwell Trust, which has most recently been purchased by the Church of Jesus Christ of Latter-Day Saints. This piece of property is located on Highway 19 above the Konawaena Elementary School, a quarter mile south of the Konawaena High School road intersection. At this point in time, it is not known if the new owners have any intention of utilizing the property. Assistant Chief Ronald Nakamichi will be contacting the new owners to see if they would consider selling the property so that the new South Kona Police Station could be built there. 6. Humane Society Budget Refer to attached memorandum to Council Chair Stacy Higa, in response to letter from Ms. Josi Morgan, Hawaii Island Humane Society. 7. Distribution of personnel Refer to Attachment 2, Personnel Distribution April 1, 2006 8. Subsidized rentals in South Kona for housing (i.e. subsidized vouchers); consultation with SHOPO The idea of providing a subsidy to make living in the Kona area more attractive to officers is commendable. However, I feel that this subsidy program may be problematic as the SUBJECT POLICE DEPARTMENT FISCAL YEAR 2007 BUDGET COUNCIL BUDGET HEARING QUESTIONS PAGE 4 difference in the average cost of living between Area I and Area II is in constant flux, and equality may be something that will be hazd to determine. As such, the subsidy provided may also be problematic as it maybe something that changes according to the average cost of living between Area I and Area II. Once the County embarks on providing this subsidy, it will be very difficult to remove such a subsidy even when economic times are not as positive as they are now. Additionally, is it the intent of providing this subsidy for all officers or it is confined to officers basically working within the Kona district? I would recommend that the Department of Finance do a projection of the differences in the cost of living between Area I and Area II, and also one specifically for the Kona and Waimea districts as I feel that the cost of living in these two districts are much higher than other districts in Area II, such as North Kohala and Kau. The County will then have a better idea as to the amount of subsidy that should be provided to each officer. This of course would also have to be provided to officers that already are working in Area II or the Kona district. 9. Breakdown of current (42) sworn vacancies, how long have these positions been vacant Refer to Attachment 3 -Vacancy Report 10. Respond to questions from Legislative Auditor Refer to Attachment 1 11. Hale Halewai facility -manpower (i.e. sworn position and clerk) to staff the facility, allowing it to remain available to public. The Department has contacted the Deparhnent of Parks and Recreation, and they have offered for the Department's use an office approximately 12 by 17 feet. We would equip this site with a radio transmission base station, a minimum of two Records Management System linked computers, and a workstation for community policing officers. This site would be accessible for the public to file complaints and seek information and for officers to conduct any other police business. This substation will be utilized a minimum of eight hours per day, seven days a week and property signage and a lighting system will increase the visibility of this substation. It is hoped that by placing this substation in this location, it will mitigate many of the problems including drug dealing, prostitution, and hazassment/assault of visitors to the Kailua-Kona area. 12. Explain cost item JPO supplies Account 010.201.5215.03 JPO Supplies for $1,200 is used to purchase uniform and equipment for JPOs. JPOs are still utilized at the following school campuses: Waiakeawaena, Waiakea Elementary, Honokaa Elementary, Kaumana Elementary, Keaukaha Elementary, Pahoa Elementary, Keaau Elementary, and Holualoa Elementary. 13. Explain cost item Crossing Guard training Account 010.201.5215.01 Crossing Guard Training represents a grant that the Department received in the past to pay for overtime incurred by Department staff to conduct training. 14. Explain drop in funding for CPO program Account 010.201.5216.16 Community Policing Program represents grant funds received by the Department. The large decrease in the budgeted amount from $400,000 to $83,600 is due to the fact that the seven (7) Ice Task Force positions were only funded for 2 years. Since the funding for these positions originates through the Office of Justice Programs, Community Policing Program and is only managed by the Hawaii Community Foundation, the funds are identified under this account number. The FY 2007 Budget includes funding for these positions upon the expiration of the grant. Should you have any questions, please feel free to contact me at 961-2244. Attachment ATTACHMENT 1 HAWAII POLICE DEPARTMENT FY 2006-07 OPERATING BUDGET & PROGRAM REVIEW Response to March ] 6, 2006, correspondence from Legislative Auditor's Office: 1. Is the Police Department strategically based and equitably staffed throughout the County? The response to both of these questions is yes, however, staffing is below what was projected during our department's strategic planning process as being the optimal staffing level. 2. How many police officer positions are vacant? What is being done to mitigate staff shortages? Staff, in conjunction with the Department of Civil Service participating in job fairs and cazeer expos for Police Officer I positions; in addition, paid advertisements in newspapers and radio ads. 3. What vacant positions will not be filled in FY 2007? Our department is continuously striving to fill all of our vacant positions, therefore, could not speculate as to what vacant positions will not be filled during FY 2007. We are currently screening two groups (at different phases in the process) of candidates to fill our vacant Police Officer I positions. We are targeting a May I, 2006, for the first group to start the next Police Recruit Class, to consist of twelve (12) Police Recruits. The other group being screened, consisting of twenty-five (25) candidates would comprise the next Police Recruit Class, targeted for September 2006. In addition, during the month of April, the Department of Civil Service will be administering the Physical Performance Test for yet another group of Police Officer I applicants. 4. How effective is the "War on Ice" program? Overall, the department's Ice Task Force and Drug Interdiction Task Force have been very successful in their mission to identify, prosecute, and ultimately dismantle street; mid- and upper-level drug trafficking organizations dealing crystal methamphetamine ("Ice"). There have been significant seizures of crystal methamphetamine, resulting in a reduction in the supply of the illegal drug, which is evident by the rise in prices as the drug becomes more difficult to obtain. Our enforcement efforts have also caused the dealers to be more innovative in thinking of new ways of smuggling drugs into the state, stressing the importance of the continuous training for our personnel. As long as the demand for the drug is there, police will continue their efforts to apprehend the suppliers and reduce the supply of Ice. In addition to the department's efforts, the community support and involvement have been key factors in combating crystal methamphetamine. The community has responded to this threat by providing information on suspected distributors and suspicious activities, via our department's "Ice Hot-line" and Crime-Stoppers programs. 5. How effective is the Marijuana Eradication program? This program has proven to be highly successful with apprehending and deterring individuals involved with the cultivation and distribution of marijuana, which is evident by the decline in the number and size of marijuana growing operations in recent years. The program is only successful with the support from Federal funding that provides the necessary resources for our department to conduct eradication missions, provide for training, and community education. In addition, the program could be much more successful with the unequivocal support of all of our elected officials. FY 2006-07 OPERATING BUDGET & PROGRAM REVIEW PAGE 3 If it appears that the Hawaii Police Department stands apart and alone on this issue (and it must sometimes appeaz to be so), then we will never have the support of the public that is essential to any enforcement program. 6. Police Administration Division OCE, Mileage and Auto Allowance expense (5203.02.111) increased by $342,588 to $2,967,600. What is the reason for this increase? 1) During last budget sessions, Council removed funding for 31 Group I positions and six (6) Group II positions (totaling $256,452), but in FY07 the Department requested and County Administration returned the funding. 31 positions x $587/month x 12 months = $218,364 6 positions x $529/month x 12 months = $38,088 2) SHOPO Bargaining Unit calls for an increase in FY07's monthly caz allowance amounts totaling $58,800. (282 + 31) positions x ($599-$587) x 12 months = $45,072 (98 + 6) positions x ($540-$529) x 12 months = $13,728 3) Captain position missed last FY = $540 x 12 months = $6,480 4) New Sergeant position for Dispatch granted last FY but no car allowance budgeted = $540 x 12 months = $6,480 7. What does your Department consider the most pressing issue facing the County? Aside from the issues involving manpower shortages, our most pressing issues involve the maintenance of our current facilities and construction of new facilities to meet the public's demand for police services. 8. Explain Cell Block Security expense (5207.02/$362,085 & 5112.02/$204,000)? 1) Account in budget is 5212.02 not 5112.02. 2) Guards for both the Kona and Hilo Cellblocks aze contracted from a private security company. Each day at a minimum, Hilo uses 2 guards per shift and has 3 shifts per day. Each day at a minimum, Kona uses 1 guard per shift and 3 shifts per day. 9. Explain Police Fleet Transition expense of $1,000,000 (5215.17)? The money is set aside in order to appropriately fund the County Administration's recommendation to the County Council. This recommendation will take into account the Fleet Transition committee report, meetings and eventual proposal of the State of Hawaii Organization of Police Officers, along with the management of the Police Department and other County Agencies, such as the Department of Finance. FY 2006-07 OPERATING BUDGET & PROGRAM REVIEW PAGE4 10. What is the status of the Records Management System, and has it improved the Department's efficiency (Part I, Volume II, page 192, Operations Bureau Highlights)? The Records Management System (RMS) is still being tuned and developed to suit our needs. Much of the ongoing development involves identifying and clazifying those processes, which deliver the actual reports, so as to streamline those processes and ensure adequate control of accuracy and timeliness. Part of the problem we are encountering relates to the needs and expectations of other end users of the product, primarily the public, but also other criminal justice agencies, and the press. The system is designed to provide a quantum leap in the level of information immediately available to our officers, and it does this quite well. But presently it does so at a cost, which is more time spent entering and confirming data. As the database expands, and officers become more adept at utilizing that information to their advantage, time spent inputting and correcting will diminish. We have also confirmed the need for more effective scrutiny by supervisors reviewing reports than which exists in the pre-RMS era, and until that is accomplished, we shall continue to experience delays in generating complete reports. But the wealth of information available is astonishing, and we would be happy to provide a confidential demonstration for members of the Council. 11. Vice Section Highlights section reflects marijuana, methamphetamine, cocaine, firearms, and cash are frequently seized together (Part I, Volume II, pages 203-205). Is there a reason why we see them together? It is evident that although crystal methamphetamine is the "drug of choice", marijuana is still a very popular drug that is used in conjunction with the use of other types of drugs. Police have encountered large-scale marijuana distributors/cultivators who utilize the mazijuana as a commodity, using it to generate large sums of money to re-invest in other drug operations, such as cocaine and ice. Police have also documented distributors trading "high grade" Hawaii-grown marijuana for other drugs. It is obvious that persons dealing in illegal activities need to have cash readily available for opportune drug transactions. In that the proceeds of these illegal activities need to be hidden from authorities, dealers usually "stash their money" at various "safe houses"; in most cases, at their residences. Recently, police have encountered an increase in firearms recovered during drug investigations; alot of money is involved in these illegal activities, therefore firearms are used by dealers/cultivators to protect their illegal enterprise. FY 2006-07 OPERATING BUDGET & PROGRAM RFNIEW PAGE 5 12. Traffic Enforcement Unit program highlights reflect 30 traffic fatalities during FY05, (Part I, Volume II, page 206), of which 53% were related to alcohol and 47% were related to illegal drugs. Do you foresee illegal drugs surpassing alcohol? It will eventually probably be equal to or slightly higher than alcohol. Some of the reasons may be the influx and availability of synthetic drugs (i.e., ecstasy, crystal methamphetamine, crack cocaine) over the recent years. Another factor for drug use and driving may be that persons using drugs may believe that the probability of being caught for driving under the influence of drugs would be less than that of alcohol due to the smell and other factors associated with alcohol use. Consequently persons may over indulge in drug use thinking that the police will not suspect anything, not realizing that their perception and reflexes would be impaired. 13. Capital Projects FY07 -What is the status of the Police 700 Megahertz Communication System ($4,000,000/Total project $21,000,000)? The status of the Police 700 Megahertz (MHZ) Communications System is that to date there has been no funding for this project. Our department has had preliminary talks with the State of Hawaii about forming a partnership for a system but without funding, we cannot proceed forward. The release of funds would trigger the need to have a consultant perform a study similar to the study performed in 1995 for the 800 MHZ system. Furthermore, the County should consider the hiring of a fulltime radio frequency engineer or an equivalent position to oversee this project. The continuous evolving technological changes in the communications architecture portents the need for a professional in the field to manage the project both to and beyond its completion. The 700 MHZ system should be designed to ensure access for the Fire Department and Civil Defense Agency in addition to the Police Department. Furthermore, this shared system will also ensure greater interoperability on the part of those agencies most likely to be utilized in both natural and unnatural disasters. 14. Capital Projects FY07 -What is the status of the new South Kona (Captain Cook) Station? This project is still pending identifying a suitable site for the construction of the facility. I5. Capital Projects FY06 -What is the status of the Police Data/Information Transmission System? The current status of the Police Data/Information Transmission is that we have had to refine the original specifications for the mobile data terminals (MDT) and Purchasing will be putting them out to bid. Once we receive the MDTs we will be able to start a limited connectivity pilot project. In order to expand beyond the limited pilot project we will require additional funding. FY 2006-07 OPERATING BUDGET & PROGRAM REVIEW PAGE 6 To date, funding has only been provided for the MDTs, which aze only a small part of the package. In order to be able to push the data through a mobile environment we will need funding for commercial wireless connectivity as well as associated hazdwaze and software applications. The best long-term solution for data/information transmission will be to utilize the available bandwidth from the 700 MHZ system once it is fully completed.
