RESOLUTION NO. 321 06
RESOLUTION AUTHORIZING THE OFFICE OF THE MAYOR TO ENTER INTO
AN AGREEMENT WITH THE STATE OF HAWAII, HAWAII TOURISM
AUTHORITY, PURSUANT TO HRS 46-7, FOR A WAIPIO PARK RANGER PILOT
PROGRAM
WHEREAS, the State of Hawaii, Hawaii Tourism Authority has authorized funding, through
its Natural Resources Program, to the Department of Research and Development for the start of a
Waipio Park Ranger Pilot Program; and
WHEREAS, with the Waipio Valley being a very popular tourist destination, the County will
be using the grant funds to develop, plan and implement a one (1)-year pilot program to contract
rangers to staff the county park at the Waipio Scenic Overlook to monitor commercial and visitor
activity, report any illegal activity to law enforcement, serve as educational resources for the public,
enhance the visitor experience, and protect the environment; and
WHEREAS, destructive and illegal activities in the valley and at the scenic overlook have
increased over the past few years and concerns have been raised by community members, park
staff, and landowners that these activities are damaging the environment, creating safety hazards,
tarnishing the visitor experience, and offending the host culture; and
WHEREAS, the pilot program strives to ensure the safety of all visitors and residents at
Waipio Valley, enhance the visitor experience by providing education about the area's natural and
cultural histories and resources; enhance the reputation of legitimate businesses in the tourism
industry; and enhance the appearance of the County Park located at the Waipio Scenic Overlook;
and
WHEREAS, the expected outcomes of this pilot program are 1) an educated resident and
visitor base will protect the natural and cultural resources of the Waipio valley; 2) visitors will have
an enhanced visit because they will learn about the cultural and natural history of the area; and 3)
there will be enhanced safety for visitors and resident; and
WHEREAS, Hawaii Revised Statutes, Section 46-7, requires that county departments
obtain the consent of the council to enter into agreements with the federal or state governments
respecting action to be taken pursuant to any of the powers granted by law to furnish, expend, and
receive any funds or other assistance in connection with projects being or to be undertaken
pursuant to those powers.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF
HAWAII, in accordance with section 46-7, Hawaii Revised Statutes, that the Mayor of the County
of Hawaii is authorized to execute, on behalf of the County, a Contract for Goods and Services
with the State of Hawaii, Hawaii Tourism Authority, attached hereto and incorporated herein by
reference as Exhibit "1 to enable the County of Hawaii to use these funds for the Waipio Park
Ranger Pilot Program.
BE IT FURTHER RESOLVED that the Mayor of the County of Hawaii is authorized to sign
the above-referenced agreement and any related documents on behalf of the Office of the Mayor
and the County of Hawaii pursuant to the Hawaii County Charter.
BE IT FURTHER RESOLVED that the County Clerk of the County of Hawaii shall transmit
copies of this resolution to the Office of the Mayor, the Finance and Research and Development
Departments, and the State of Hawaii, Hawaii Tourism Authority.

RECITALS
A. The STATE is in need of the goods and services, or both, described in this
Contract and its attachments. The CONTRACTOR is agreeable to providing the goods and services,

NOW, THEREFORE, in wnsideration of the promises contained in this Contract, the
STATE and the CONTRACTOR agree as follows:
1. Scope of Services. The CONTRACTOR shall, in a proper and satisfactory
manner as determined by the STATE, provide all the goods or services, or both, set forth in Attachmcnt-
S1, which is made a part oC this Contract.

2. Compensation. The CONTRACTOR shall be compensated for goods
supplied or services performed, or both, under this Coolracl in a total amount not to exceed

Payment Schedule set forth in Attachment-S2, which is made a part of this Contract.
3. Time of Performance. The services or goods required of the CONTRACTOR
under this Contract shall be performed and completed in accordance with the Time of Perfomance set
forth in Attachment-S3, which is made a part of this Contract.

8. Notices. Any written notice required to be given by any party to [his Contract

CONTRACTOR shall be sent to the CONTRACTOR'S address indicated in the Contract. A notice shall
be deemed to have been received three (3) days after mailing or at the time of actual receipt, whichever
is earlier. The CONTRACTOR is responsible for notifying the STATE in writing of any change of
address.
IN VIEW OF THE ABOVE, the parties execute this Contract by their signatures, on the

"Agency" means and includes the State, the legislature and its committees, all executive
departments, boards, commissions, committees, bureaus, offices; and all independent

ATTACHMENTI
SCOPE OF SERVICES
The COUNTY shall perform and provide, in a satisfactory and proper manner as
determined by the STATE, all goods and services described below and in the
CONTRACTOR'S accepted proposal dated December 30, 2005 ("PROPOSAL"),
attached hereto and incorporated herein as Exhibit A, including the following:
1. The CONTRACTOR shall develop, plan and implement a one (1)-year
pilot program to contract rangers to staff the county park at the Waipio
Scenic Overlook to monitor commercial and visitor activity, report any
illegal activity to law enforcement, serve as educational resources for the
public, enhance the visitor experience, and protect the environment; and as
further described in the PROPOSAL (hereinafter referred to as the
"PROJECT").
2. STATE funds shall be used for expenses related to the PROJECT within
the context of the CONTRACTOR'S budget, attached hereto and
incorporated herein as Exhibit B. Any change to this budget shall require
prior written approval by the STATE.
3. The CONTRACTOR shall use its best efforts to perform the goals and
objectives stated in its PROPOSAL.
4. The HAWAII TOURISM AUTHORITY shall be credited as a sponsor on
all advertising and promotional materials. The CONTRACTOR shall
consult with the STATE'S marketing contractors to coordinate marketing
efforts as appropriate including, to the extent possible, listing any public
events on web sites and calendars of events, and participating in the
"Hawai`i Knowledge Bank" program. If applicable, the CONTRACTOR
shall submit a final schedule and copy of all advertising and promotional
activities with the final written report to the STATE.
5. Prior to the release of STATE funds, the CONTRACTOR shall submit
proof of matching funds as specified in the budget made a part of this
Contract and attached hereto as Exhibit B. Cash contributions shall be
demonstrated in the form of receipts of deposits or binding letters of
commihnent.

6. The CONTRACTOR shall prepare and maintain financial records which
sufficiently and properly reflect all income and other sources of funds, and
all direct and indirect expenditures of any nature related to the
CONTRACTOR'S performance of this Contract. These records shall be
subject to any inspection, review or audit by the STATE.
7. The CONTRACTOR shall submit a financial report to the STATE upon
completion of the PROJECT and prior to the completion of the contract
period. The financial report shall include, but not be limited to, a
certification by the CONTRACTOR that all financial statements
represented in the report are accurate and that STATE funds allocated
under this Contract have been expended in accordance with the provisions
set forth in this Contract, including the budget made a part of this
Contract. The report shall also specify the expenses for which STATE
funds were utilized. All STATE funds not expended in accordance with
the provisions set forth in this Contract and the budget shall be returned to
the STATE.
8. The CONTRACTOR shall complete and submit a final written report to
the STATE prior to the completion of the contract period and final
payment by the STATE by using the "Hawaii Tourism Authority Natural
Resources Program Final Report Form," attached hereto and incorporated
herein as Exhibit C.
9. The CONTRACTOR shall provide any progress report requested by the
STATE describing the status of all work required to be completed under
this Contract and as maybe required in Attachment 2. The
CONTRACTOR shall furnish any additional reports or information that
the STATE may, from time to time, require or request.

ATTACHMENT2
COMPENSATION AND METHOD OF PAYMENT SCHEDULE
Notwithstanding the amount requested in the PROPOSAL or representations to
the contrary, the total compensation for services to be provided by the CONTRACTOR
under this Contract shall be the sum of money not to exceed SIXTY THOUSAND AND
NO/100 DOLLARS ($60,000.00), tax inclusive. Payment shall be made by the STATE
to the CONTRACTOR in accordance with paragraph 17 of the "General Conditions,"
and shall be subject to the following provisions:
1. TWENTY THOUSAND AND NO/100 DOLLARS ($20,000.00) within
30 days after the Contract is fully executed, the CONTRACTOR has
received a notice to proceed from the STATE, and upon the STATE's
prior receipt and approval of an original invoice for said amount; a current
work plan describing tasks to be completed, including a revised timeline,
if applicable; and proof of the required matching funds as specified in the
approved budget made a part of this Contract and attached hereto as
Exhibit B.
2. TWENTY THOUSAND AND NO/100 DOLLARS ($20,000.00) on or
about August 1, 2006 and upon the STATE's prior receipt and approval of
an original invoice for said amount and a written progress report
describing the status of all work required under this Contract.
3. FIFTEEN THOUSAND AND NO/100 DOLLARS ($15,000.00) on or
about February 1, 2007 and upon the STATE's prior receipt and approval
of an original invoice for said amount and a written progress report
describing the status of all work required under this Contract.
4. FIVE THOUSAND AND NO/100 DOLLARS ($5,000.00) upon the
STATE's prior receipt and approval of an original invoice for said
amount, all required final financial and written reports, a final schedule
and copy of all advertising and promotional activities, if applicable, and
satisfactory completion of all services in accordance with this Contract.

Progress payments shall not be construed as final acceptance of services required
under this Contract. The CONTRACTOR acknowledges and agrees to perform all
services in accordance with this Contract for an amount not to exceed SIXTY
THOUSAND AND NO/100 DOLLARS ($60,000.00), specified above, and subject to the
availability of funds.

TIME OF PERFORMANCE
Performance of services by the CONTRACTOR shall commence on the effective
date of this Contract and all services required under this Contract shall be completed by
July 1, 2007 unless this Contract is sooner terminated as hereinafter provided. This
Contract maybe amended to extend the time of performance upon prior written approval
by both the CONTRACTOR and the STATE.

SPECIAL PROVISIONS
Notwithstanding any provisions or representations to the contrary, any conflict
among the various provisions of this Contract shall be resolved by allowing the various
provisions in the following documents, in order of priority, to control:
1. This Contract and Attachments 1 to 4;
2. The General Conditions, attached hereto and incorporated herein;
3. The CONTRACTOR'S budget (Exhibit B); and,
4. The CONTRACTOR'S accepted PROPOSAL, dated December 30, 2005
(Exhibit A).

1. Description of the Organization
This pilot program is amulti-departmental project of the County of Hawai i. Lead roles in the
program's oversight will be taken by the Department of Research and Development's (R & D), Department
of Parks and Recreation (P & R), Hawaii Police Department (HPD), and the Department of Public Works
(DPW).
R & D's mission is to improve the quality of life for the people of Hawaii County through economic
development programs in agriculture, tourism, new industry, energy, and film; and information resources.
The Department also manages the Hawai i County Resource Center (HGRC). The mission of HCRC is to
serve Hawaii Island communities and county departments, fostering increased collaboration and capacity
through training, technical assistance, facilitation, and access to resources. The staff of R & D is
committeed to community building and community-based economic development in a manner that is
culturally and environmentally beneficial.
P & R provides a wide variety of recreational and cultural programs while operating and
maintaining over 140 sites throughout the island. The department's mission is to provide a wide array of
services for the public with excellence, integrity, and aloha. HPD's roles are to reduce crime in general,
inhibit the growth of drug trafficking and usage on the Big Island, and reduce traffic fatalities. DPW is
responsible for a broad range of functional areas: repair and maintenance of county vehicles and
equipment; public and private building construction and inspection; engineering services; construction,
inspection, and maintenance of over 900 miles of public streets, highways, and bridges; acquisition of
properties for public purposes; design, installation, operation and maintenance of traffic control devices and
streetlights; and provides key support functions during Civil Defense emergencies.

2. Qualifications and Expertise
R & D's 14 economic development specialists and support staff member are managed by its
Director, Jane Testa, and her Deputy Director, Diane Ley. During the fiscal years 2000 through 2005,
R & D provided financial assistance through grants in the amount of approximately $2,663,267 to a broad
range of organizations to fund rural agricultural projects, tourism projects, and community-based
entrepreneurial endeavors. In addition, $300,000 was granted to 110 small non-profit and grassroots
community-based organizations to combat drug abuse and to raise social capital in communities across the
island. Most of the financial assistance promoted community and economic development. R & D financial
assistance is limited to relatively small amounts but is used to leverage much greater amounts from private
and state funds.
P & R led by Director Patricia Engelhard, and Deputy Director Pamela Mizuno manage a budget of
over $17,500,000 and up to 650 employees in ten divisions. P & R manages 140 parks, which include
beach and neighborhood parks, senior centers, and community centers, ball iields, soccer iields, gyms,
swimming pools, tennis courts and rodeo arenas. P & R is responsible for special purpose facilities and
programs such as the Hilo Drag Strip, skeet range, equestrian center, the Pana'ewa Rainforest Zoo, the
Hilo Municipal Golf Course, Culture and Arts program, and Senior employment, nutrition, and services
programs, County and West Hawaii bands, and Alae and Veterans cemeteries in East and West Hawaii.
Under Chief of Police Lawrence Mahuna, and Deputy Chief Harry Kubojiri, HPD managed a budget
of $39,089,777 in Fiscal Year 2004-2005, and staff numbering 610. With its Community-Oriented Policing
program and the Community Relations Section, HPD is well positioned to conduct a training program to
ensure the safety of the Waipi'o Rangers and the Waipi'o community.
DPW Director Bruce McClure and Deputy Director Jiro Sumada managed a budget of $28,323,446
in Fiscal Year 2004-2005 and a staff of 360. DPW will assist with directional signage and other issues
related to the County road that leads into the Waipi'o Valley.

3. Description of Proposed Project
The County of Hawaii and its Department of R & D requests $60,000 to fund a pilot ranger
program for the Waipi'o Valley Overlook Park located in the Hamakua District. Destructive and illegal
activities at this site have increased over the past few years and concerns have been raised by community
members, park staff, and landowners that these activities are damaging the environment, creating safety
hazards, tarnishing the visitor experience, and offending the host culture.
Rangers will provide educational guidance for all who visit and use this popular park. They will
serve as the eyes and ears of law enforcement and contact the State Department of Land and Natural
Resources (DLNR) Division of Conservation and Resource Enforcement (DOCARE) and the Hawaii
County Police Department (HPD) as needed. Rangers will explain expected behaviors to park visitors and
monitor park use and trends. In addition Rangers will serve as visible guardians of Hawaii's natural and
cultural resources. Interpretive signage and educational materials regarding the natural and cultural
resources will be developed collaboratively with experts and practitioners within the community, under the
guidance of Sea Grant, Kamehameha Schools, Kohala Center, and University of Hawaii at Manoa School
of Urban and Regional Planning. The Department has applied for separate funding for signage and
educational materials from the HTA Hawaiian Culture program. Results of the one-year pilot program will
determine whether a permanent program should be implemented.
Complicated issues of access and of assigning oversight for public activity on private land in the
Waipi~o Valley, and within multi-jurisdictional areas, has been debated for years. Above the valley is a
scenic lookout and park maintained by the County of Hawaii. This popular stop has a shelter and facilities
for picnicking. A county road leads down into the valley. A State hiking trail leads into the adjoining valleys.
The open waters of the bay are regulated by the DLNR. The beachfront property in the valley is owned by
Kamehameha Schools (KS). A community of taro farmers, many descended from the valley's original

settlers, also live and farm in the valley. An increasing number of visitors-a combination of tourists, Island
residents, and commercial tour groups--are taking rental, private and commercial vehicles down the steep
and winding county roadway to get to the black sand beach or to tour the valley. A spokesman for KS
reported that it is not unusual to see 20 vehicles on the beach atone time. Overnight campers have
become problematic for KS due to the lack of toilet facilities. KS installed portable toilets at their own
expense and still some visitors choose to use the bushes. The beach is the only public access beach in
the Hamakua District therefore attractive to district residents. The Valley of the Kings as Waipi o Valley is
known is aworld-famous vista and understandably a popular tourist destination.
The latest issue of National Geographic ADVENTURE magazine highlights the Waimea-Honoka'a-
Waipi'o region and includes a stunning bird's-eye-view photograph of Waipi'o Valley. The valley is a
magnet for photographers, surfers, four-wheelers, and hikers. Unfortunately many visitors are unaware of
how their activities affect the environment they came to enjoy. Careless behavior by uneducated visitors
can easily be interpreted as disrespectful. KS and the valley's residents are dismayed by the increasing
disrespect shown to this site that is so important culturally, historically, environmentally, and personally to
generations of Hawaiians and valley taro growers. At risk are the heiau and other cultural and historic
treasures; and the fragile environment is also at risk of degradation by uneducated visitors. For the
Hawaiian population and the residents that live off the land, the land itself is a cultural treasure.
One of the courses of action in the Hawaii County General Plan §12.5.5 is to encourage the State
to provide small recreation sites on the edge of Waipi'o Valley and to encourage the recreational
development of Waipi'o and Waimanu Valleys as natural and wilderness areas. At this point, stakeholders
have yet to arrive at a mutually satisfactory solution; therefore the proposed program in which Rangers staff
the scenic overlook and serve as educators to the public will stem the tide of more damage. Additionally the
rangers will be able to collect important statistical data to be used in future decision making.

R & D will facilitate a cooperative arrangement in which acommunity-based organization within the
affected community will manage the ranger program. Ajob description and roles and responsibilities will be
developed by the program manager with assistance from R & D, P & R, and HPD. Rangers will receive
first aid training and will be required to be certified in CPR. Program Manager will develop a basic training
program with HPD and DOCARE. Rangers will not have enforcement capabilities, but they will require
training in de-escalation techniques and surveillance techniques. Rangers will monitor commercial activity
and report questionable activity to law enforcement. Rangers will be responsible for surveying visitors
using asite-specific survey tool to be developed with the assistance of Dr. Luciano Minerbi from the
University of Hawaii at Manoa Department of Urban and Regional Planning. Rangers will be unofficial
County Ambassadors to the parks they are assigned and will develop comprehensive reports based on
their observations and experiences.
Near the close of the pilot program, a mufti-agency review of the pilot program outcomes will
suggest the next steps to be taken in this collaborative effort to protect Hawaii's resources and to provide
an enriching and rewarding experience for visitors and for residents.

Waipi'o Valley is a popular tourist destinations. Local tour operators and water sports instructors
provide a needed service for tourists, and if conducted legally and responsibly these activities enrich the
Hawaii visitor experience. This pilot program strives to ensure the safety of all visitors and residents at
Waipi'o Valley; enhance the visitor experience by providing education about the area's natural and cultural
histories and resources; enhance the reputation of legitimate businesses in the tourism industry by
identifying outlaw operators and controlling their illegal and hazardous activities; and enhance the
appearance (e.g. cleanliness, overall maintenance) of the County Park located at the Waipi'o Scenic
Overlook.
5. Environmental Connection
The naiural environment is the primary draw that brings visitors and residents to Waipi o Valley.
The valley's natural resources have been documented by the Hawaii Biological Survey of 2001, which
found six species of native fish, two species of native crustaceans, and one species of native mollusk in
addition to eight native species of plants. The Ranger project will be developed in large part to protect
these precious natural resources. The presence alone of a uniformed official will promote environmentally
sensitive behavior among all park and beach users and visitors to Waipi o Valley. Rangers will curtail
abusive commercial operations that appear to have little regard for the environment on which their
businesses depend.
6. Community Support and Involvement
Documentation of community meetings in Waipi'o Valley goes back to 1991 with the Friends of the
Future and as recently as last month when KS representatives met with Mayor Kim. KS and DLNR will
partner with P & R in the Waipi'o Valley Ranger program. Other support will come from the Waipi'o Valley
Community Association and the Waipi'o Taro Farmers Association.

responsible for conducting surveys and keeping records to document the results of the pilot project.
