MtY Of y O' "y L~~Irgy, COUNTY OF HAWAII STATE OF HAWAII ~r~ aF ~wi.M RESOLUTION NO. 3G3 ~J6 RESOLUTION AUTHORIZING THE PAYMENT OF FUNDS OF A LATER FISCAL YEAR AND MORE THAN ONE FISCAL YEAR FOR AMULTI-YEAR LEASE OF REAL PROPERTY FOR THE PROSECUTING ATTORNEY'S KONA OFFICE WHEREAS, Section 10-11 of the County Charter requires that any contract, lease, or other obligation requiring payment of funds from the appropriations of a later fiscal year and more than one fiscal year be approved by resolution; and WHEREAS, the five-year lease of the Prosecuting Attorney's Kona Office, located at the Kealakekua Business Center, 81-190 Haleki'i Street, Kealakekua, expires on June 30, 2006; and WHEREAS, the Office of the Prosecuting Attorney wishes to extend the lease for another five years, for the presently occupied space of 6,432 square feet (lease to begin on July 1, 2006) and for an additional 1,450 square feet (lease to begin on November 1, 2006) in the same building; and WHEREAS, the Kona office has been at this site since its renovation in 1991 and this location is well established with the public and is in close proximity to the courts; and WHEREAS, the cost to relocate would be prohibitive since retaining the same location would eliminate the need to incur expenses for moving, setup of network, telecommunications and video conferencing infrastructure and re-printing of letterhead, envelopes, and business cards; and WHEREAS, the County wishes to enter into amulti-year lease with Hawaiian State Enterprises, Ltd., through Clark Realty Corporation, for five (5) years beginning on July 1, 2006 for the presently occupied space of 6,432 square feet and on November 1, 2006 for the additional 1,450 square feet of office space.
