MtY Of y <br /> O' "y L~~Irgy, <br /> COUNTY OF HAWAII STATE OF HAWAII <br /> ~r~ aF ~wi.M <br /> RESOLUTION NO. 3G3 ~J6 <br /> RESOLUTION AUTHORIZING THE PAYMENT OF FUNDS OF A LATER FISCAL <br /> YEAR AND MORE THAN ONE FISCAL YEAR FOR AMULTI-YEAR LEASE OF <br /> REAL PROPERTY FOR THE PROSECUTING ATTORNEY'S KONA OFFICE <br /> WHEREAS, Section 10-11 of the County Charter requires that any contract, lease, or other <br /> obligation requiring payment of funds from the appropriations of a later fiscal year and more than one <br /> <br /> fiscal year be approved by resolution; and <br /> WHEREAS, the five-year lease of the Prosecuting Attorney's Kona Office, located at the <br /> Kealakekua Business Center, 81-190 Haleki'i Street, Kealakekua, expires on June 30, 2006; and <br /> WHEREAS, the Office of the Prosecuting Attorney wishes to extend the lease for another five <br /> years, for the presently occupied space of 6,432 square feet (lease to begin on July 1, 2006) and for <br /> an additional 1,450 square feet (lease to begin on November 1, 2006) in the same building; and <br /> WHEREAS, the Kona office has been at this site since its renovation in 1991 and this location <br /> is well established with the public and is in close proximity to the courts; and <br /> WHEREAS, the cost to relocate would be prohibitive since retaining the same location would <br /> eliminate the need to incur expenses for moving, setup of network, telecommunications and video <br /> conferencing infrastructure and re-printing of letterhead, envelopes, and business cards; and <br /> WHEREAS, the County wishes to enter into amulti-year lease with Hawaiian State <br /> Enterprises, Ltd., through Clark Realty Corporation, for five (5) years beginning on July 1, 2006 for <br /> the presently occupied space of 6,432 square feet and on November 1, 2006 for the additional 1,450 <br /> square feet of office space. <br /> <br />
