Dear Council Members- We are very concerned about the development that is proposed for 57 homes and 16 affordable housing units with the Salvation Army facility, day care center and possibly a ehun1i. The concern is the egress and ingress plaza provided for the proposed development that will add to the traffic problem that already exists in Kona. It has been brought to my attention that there will be only one way to access the proposed develnpment from Malulani Drive off of Queen Kaahumanu Highway and the bypass road from Henry Street between Lowes. The proposed development will most likely create two hundred and fifty vehicles per day, 73 family homes owning 2 vehicles and service centers opened to the public would attract as many as IOU or more vehicles. This increase would deadlock traffic on Kaahumanu Highway and Henry Street and as far into Kona as K,uakim Highway and Falani Road. The Police department and Fire department are not in favor of this lack of ingress and egress of this proposed development due to safety issues. There must be an additional access road from the upper section of the proposed development to mitigate these issues. I would like to express that I am in favor of providing low density housing for our community and to support the growth of our community. With the right plan that will benefit all concerned. Let's not make another mistake for Kona and it's already existing problems. Let's as a group plan well and develop well for the future of Kona. Of course, this comes as no surprise to anyone living on the west side of the island, which is a community of roads that go nowhere and where variances are handed out freely to developers, who want to get around the County's subdivision requirements. Earlier this year there was a lot of talk about slowing down the development pace in West Hawaii until the infrastructure caught up with the needs of the community At that time, I thought if any proposed subdivision would not be approved because of the extensive traffic in the area, it would be. the so called Kona Coffee Estates. After all, it is located right in the heart of Kona and would dump more traffic into what is undoubtedly the most congested area on the island. Boy, was I wrong! It seems the County Council and Planning Commission have never met subdivision they don't like, regardless of what the people, who live in the arrawant. I attended several of the so called, neighborhood meetings with representatives of the Stanford Cart Development Company and expressed my concern about the traffic situation and suggested that they if they build a subdivision in this area, they should provide a mauka exit and needed improvements along Valant [toad to accommodate the increased traffic it will bring to the area Their answer was that they had no intention of doing so. " It would cost too much." Well, the cost isn't going to go away in the future. It will just be passed on to the taxpayers who will some day have to pay the bill to bring the propLrwd subdivisiun wads up to swndanta and to construct a otauka connector road. I also attended the meeting at which the Planning Commission voted to forward the project to the County Council with an approval recommendation despite testimony from the chairman of the County's own Traffic Safety Committee. He testified against the proposed subdivision because of the impact it would have on traffic in the area and concerns expressed by Police and Fire about emergency service access. The Planting Commission wasn't interested in what he had to say. They were more concern ed about how the developer might get around the need to construct the roads to county standards. This is the second time I have tried to make my voice heard by time in government who are supposmto serve the people who elected them, not the developers who are only interested in making a quick buck and getting out of town. This proposed subdivision is an example of what happens when bad planning takes place. The Lowe's development was not the development approved by the Land Use Commission. The Hawaiian Development Company created such a monster when they prepared the site, that they decided to bail. Now, the new developer is attempting to salvage at a minimum expense what is not salvageable, I know we can't stop all growth. But we can demand more of the developers. If they can't afford to build here because of our high standards. So be It. It's our community, not theirs. Any change of zoning should with the change, record conditions for potential development that would provide neighborhood compatibility. Once a simple change of zoning has been approved, later Councils may feel obligated to accept any different make up of development that complies with the new zone, no matter what impact it then has on Arliaeent existing property. Ideas presented at this zoning hearing may seem reasonable as is, but there is potential for serious negative impact that must be considered before granting a change based on the present suggested scheme. 2. Traffic in general, in and around Kailua-Kona, must be considered before any zone change that will increase that burden is approved. Every developer must contribute to the mitigation of that problem, not exacerbate it. Thal said, the uumbei. of day-trips likely from any finure development in the new zone should be limited to that considered at the time of the zone change approval. That is, if the zone change is granted based on thoughts of all one acre, single family lots, fixture changes to higher density use should be prohibited, by recording that consideration now. 3. Traffic and Safety within Malulani Gardens must not be negatively impacted by future developments that might later be permitted due to the re-zoning adjacent property. Malulani Gardens is a gated community. This design of our development was granted and approved by this County. Our streets and gate are maintained by our association. It should be made a part of the record in considering any change of zone, that there will be no intrusion of traffic from adjacent developments onto the streets of Malulani Gardens. 4. TratTie and Safety entering and exiting Malulani Gardens is difficult and dangerous at present. The traffic signal at Queen K. and Malulani dr. will help to a degree. Future development of property within this proposed Kona Coffee Estates however, could make our problem much worse. 05/16/2006 10:48 3265697 KCO PAGE 11 Before granting a zone change, a requirement must be recorded now, that will route traffic directly to Palani, not down to Queen K. past our gated entrance. Out gate timing could hold up a series of residents or trades people entering Malulani (hardens, when controlled by the new traffic signal. Any additional traffic from future development above Lowes would add to that line entering. Exiting Malulani Gardens would become more dangerous and difficult, as others trying to make the signal would tend to rush past our exit, or block our exit while waiting for the light. A chained gate, emergency-vehicle-only access could be maintained, with an unimproved road into the back of that finure development. This oaold meet. fire marshal concerns without impacting our existing property. Having served ten years as a Planning Commissioner in a mainland city,l realize land use planners are concerned with trying to please both developers and existing property owners, while complying with existing laws and regulations. Sometimes suitable compromises can be reached. I have found that petitioners for zone changes and developers have the burden of demonstrating that their changes will not adversely affect existing restrictively zoned properties. Land use regulators are required to consider reasonable concerns of affected property owners. Traffic and Safety are legitimate concerns. I could support the proposed zoning change, if it were approved, subject to a recorded mandate that traffic from future development on that property would not and could not be routed into or past the gate of Malulani Gardens. The traffic situation at Henry St. intersection with the Queen K Hwy is gruesome. And, entrance to and egress from Malulani Gardens onto the Queen K Hwy is not a simple task, unless some kind motorist motions us through, or there is a rare break in the ongoing traffic. That this situation will improve, even slightly, with the construction of the new traffic signal, we can only hope. To build multifamily housing and an additional 57 homes on the adjacent lot, would only serve to exacerbate the situation. This is especially true as there is no other access road planned for the development. The Salvation Army campus would increase traffic even more, with a constant flow of patrons uniting to and going from the various facilities thore. That is, if the Salvation Army is even going to follow through on a "verbal agreement' regarding building anything on that site. I understand that said construction had a positive influence on the initial approval of this development. Construction of the planned community in this area would have a very negative impact on the overall quality of life for all residents of this area, w well as a very negative impact on the traffic situation. Since there is basically no other route from Kona (dud areas south) to'Waikaloa (and other mien north) we would experience increasing gridlock for all the cu mrulms, tourists and everyday errand-mmnors. Additionally, another community is planned just a few miles south of here, across from Pua Lani homes. The traffic from there will increase the current problem; I hate to think what the situation will be like in several years. Please seriously reconsider your decision to approve this development. Doing so would have a very negative impact on the quality of life in Kona. Let us look at recent events: The Mohala Village concept, a group of small stores/cafes to fit in with the existing stores. However, after rezoning was accomplished it seems that the developer then had the right to do whatever he wanted with no oversight from the County Planning Department or the County Council. The consequences are now apparent. We now have a fifty foot cliff blasted out of the mountain, a fifty foot wall known as the Great Wall of Kona, to accommodato a big box store that has now obstructed any mauka access for future development. We are opposed to the proposed Kona Coffee Estates development for the following reasons: The Traffic generated by this proposal will have very serious safety effects on Malulani Drive and its intersection with the Queen Konhumanu Highway. Under the current proposal there would be 57 homes in this development. Presuming a conservative two can per family, this would add 114 additional cars at least twice a day to Malulani Drive. If you consider the proposed Salvation Army Day Care Facility, up to an additional 150 can would be added. Add in the staff, visitors and other activities and the county can expect at the minimum an additional 300 cars per day on Malulani Drive just from this development alone. When Malulani Drive is opened to Lowe's (and any new business there) thus creating a connection with Henry Street, all bets are off. I can easily foresee the total impact of this exceeding 500 uus per day. Simply put, Malulani Drive was never designed to handle this level of traffic. It is a small street which serves Malulani Gardens adequately. Five Hundred (or more) extra cars will do for more than inconvenience the current residents of Malulani Gardens, it will create a major safety nightmare for the county and those of us having to enter or exit Malulani Gardens while dodging the traffic created by this ill conceived cut de sac like subdivision. The stop light being put in at the intersection with the Queen K will do little to solve this potential traffic problem. It might, in fact, compound the problem by causing traffic to back up past the entrance to Malulani Gardens effectively making the residents prisoners in their own bubdivision. There has been at least one fatality on Malulani Drive, do we need to add others to that ledger? Neither my wife nor myself are opposed to responsible development in Hawaii County. We arc, however, opposed to irresponsible development which has a negative impact on the county, Kailua town and our home. The current county council may very well be the last council which has the opportunity to prevent Hawaii County from becoming "Los Angeles on an Island." We are concerned that approval of this development in its present form will be another step towards that fear becoming reality. The developer of Kona Coffee Estates needs to do more than offer up land for a Salvation Army Center to pain approval for this development. They can start by considering the effect their proposal has on the area and mitigating the impact their development has on their neighbors by having access away from the congestion of Henry Street and the Queen. Additional development adjacent to those intercessions will dramatically impact public safety and will result in more lives lost and Increased automobile insurance fates for everyone. 3) I laving a high density housing develupruent as a cul de sac subdivision immediately next to Malulani Gardens that Includes low income housing and a rehabilitation center will cause an Increase in crime in Malulani Gardens and the surrounding areas. 4) This development will also cause a direct decrease in the home values of Malulani Gardens, thus decreasing property tax revenues for the County of Hawaii. 5) The increase of population In an area with limited traffic Infrastructure creates a significant danger to the general puhlic and the residents due to traffic congestion during a fire or other dimetor, ouch ac that which was experienced by Waikolos residents during the recent fire and evacuation attempt. Residents of Malulani Gardens and the Kona Coffee Estates would not be able to evacuate the area in a timely manor due to traffic congestion. Also, as a cul de sac subdivision, the one way In and one way out creates a danger to the residents of both subdivisions in the event of a fire or natural disaster that would close the road or make It Impassable. 6) The water supply for the majority of Malulani Gardens residents are at the minimum pressure level for appliances to function correctly. Most homes have an external pressure of only forty five pounds per square inch (45psi) . Additions demand on this limited resource will cause the water pressure to drop below the minimum level. 7) The lack of water pressure also creates afire hazard. There Is Insufficient water resources to fight a fire within the development. This existing danger will be compounded by any adjacent homes and high density housing. e) Access to Lowes from Highway 11 through Malulani Drive was blocked due to the public safety hazard that the Increased trafflc from Lowes and cross traffic would cause. The countyis hoping to alleviate this by the addition of a traffic signal. However, the increased traffic caused by this proposed subdivision will only Increase the existing hazards. An Impact of this type can dearly be seen, already, by those traveling between the airport and Kailua -Kona, due to the new light at the intersection leading to the Kona Police Department and the Transfer Station. During rush hour, it can take twenty (20) minutes to get from the turn lane on Henry street to the entrance of Malulani Gardens. The combined traffic signal and anew subdMslon will only compound this Issue due to the restriction of the flow of traffic proceeding south and the lack of a multiple lane highway extending from Kailua-Kona to Captain Cook. Adding more congestion will cause a severe problem to become impossible for all West Side Residents. 10) Residents of the West Side of Hawaii must be afforded the time and opportunity to comment an any and all planned development without the need to travel to Hilo to have their voices heard. Traffic! We all know that Kona already has a problem with traffic. The Queen's Hwy In the afternoon can be totally stopped up. Soon there will be a traffic light at the Hwy and Malulani Intersection I can not imange what will happen if all of the residents of Malulani Gardens, the proposed Salvation Army complex along with all of the parents dropping off and picking up there children, the residents of the proposed Kona Coffee Estates, and of course the cars making the "short cut"thru to Henry street to continue up Palani, this will be one busy LITTLE street. Aside from that try to pull up to the gate a Malulani Gardens and even as a resident who can push the opener and the gate promtly opens- just try to have a large suv and keep you entire car out of the lane of traffic..... or say you are not a resident and you have to park your car go to the key pact call who you are visiting and wait for the gate to open...... with the amount of traffic this new development will create I see a back up to the Hwy. Or worse yet accidents 2. Because of the situations mentioned above I feel like this is a very big saftey issuelI I do not want to be taking my life In my own hands just to come and go from my home. This street in not in anyway large enough to handle this kind of traffic. Our only access to this Subdivision is at the foot of Malulani Drive where it joins with the Queen's Highway. It is my understanding that the proposed large building project is to also have only one access. That access is the same as the one for Malulani Gardens. Even at the best of times it is ditticult to get onto or off of the highway. If there were several hundreds of more cars using that access it would be nearly impossible to get out ofMalulani Gardens.
