REPORT OF THE <br /> COMMITTEE ON PUBLIC WORKS AND <br /> INTERGOVERNMENTAL RELATIONS <br /> DATE: April 18, 2006 RE: Comm. No. 804/Res. No. 309-06 <br /> PLACE: Council Chambers <br /> TIME: 5:25 p.m. <br /> Council Chair and Members <br /> Hawaii County Council <br /> Hilo, Hawaii 96720 <br /> Your Committee on Public Works and Intergovernmental Relations, to which was referred <br /> Resolution No. 309-06, reports as follows: <br /> Resolution No.3091-06, transmitted by Assistant Corporation Counsel Gerald Takase via <br /> Communication No. 804, dated Apri13, 2006, authorizes dedication of Road Lot 51 (Eleele <br /> Street), Lot 52 (Haena Street) and Lot 53 (Haena Street) in Kilohana Kai at Waikoloa, Phase 1, <br /> from Cleazly Waikoloa Limited Liability Company. <br /> Clearly Waikoloa Limited Liability Company has constructed all subdivision improvements and <br /> received subdivision approval, and is desirous of dedicating the subject roadways, including all <br /> subdivision improvements thereon, to the County of Hawaii for road and drainage purposes. <br /> Section 23-10 of the Hawaii County Code prohibits the council from receiving by dedication any <br /> streets in any subdivision platted after December 2, 1966, except upon full compliance with the <br /> provisions of Chapter 23 of the Hawaii County Code. The subdivision improvements have been <br /> inspected and approved by the County of Hawaii Depaztment of Public Works and the Planning <br /> Department. The subdivision improvements aze in acceptable condition for dedication, and aze in <br /> full compliance with the provision of Chapter 23, Hawaii County Code. <br /> Article XIII, § 13-12 of the Hawaii County Charter provides that the Council may accept gifts <br /> which include the dedication of land on behalf of the County of Hawaii. <br /> There was no testimony from members of the public regarding the proposed acceptance.
