Please do NOT pass this bill <br /> Dear Council Members: <br /> <br /> This is testimony regarding Bill 246, "Amendments to the Subdivision Code." <br /> My testimony OPPOSES this Bill, and I request you do NOT pass it. <br /> <br /> My reasons are as follows: <br /> <br /> 1. The Supreme Court has found in the case of Leslie (Ki'ilae) that <br /> my/our Planning Department has acted illegally in not following the t <br /> Subdivision Code. - <br /> 2. It may seem like an easy fix to change the code so these illegal - <br /> actions can be "covered" and the Planning Departmnent can go its merry <br /> way. <br /> 3. The provision in question is a fundamental issue of open information <br /> and full public participation. The provision requiiring complete <br /> information to be provided with subdivision applications is one I <br /> whole-heartedly support. Yes, it takes time. But the issues in <br /> development in our County require this information for adequate <br /> consideration of decisions. <br /> 4. The County should NOT move incomplete applications forward. If <br /> anything, the County should be an examplar of diligence in being sure the <br /> applications are full and complete. <br /> 5. Passing this Bill gives the appearance of indifference to traffic, <br /> sound development, water resources, infra-structure, and many issues that <br /> need review before a sub-division is approved.
