<br /> <br /> <br /> <br /> <br /> BSemcape-REZ 1047.jwd 03-23-06 <br /> <br /> COUNTY OF HAWAII PLANNING DEPARTMENT <br /> BACKGROUND REPORT <br /> <br /> <br /> SEASCAPE DEVELOPMENT, LLC <br /> CHANGE OF ZONE ORDINANCE 04-106 (REZ 1047) <br /> AMENDMENT TO CONDITION H <br /> Seascape Development, LLC (formerly Westpro Development, Inc.) has submitted a <br /> request to amend Condition H of Change of Zone Ordinance No. 04-106, which rezoned 10 acres <br /> <br /> of land from an Agricultural 5-acre (A-5a) to a Multiple Family Residential 4,000-square foot <br /> (RM-4) district. The property is located on the south side of Kona Palisades Subdivision, <br /> <br /> approximately 1,200 feet south of the Kaimiani Drive - Kakahiaka Street intersection, Ooma 1s' <br /> North Kona, Hawaii, TMK: 7-3-10: 51 (formerly portion of 3). <br /> <br /> APPLICANT'S REQUEST <br /> 1. Request: The applicant is requesting to amend Condition H of Ordinance No. 04-106, <br /> <br /> which states: <br /> The applicant shall construct the extension of Kakahiaka Street through the <br /> <br /> subject property (TMK:7-3-10:3) as a 50-foot wide street to dedicable standards <br /> with concrete curb, gutter and sidewalk improvements along one side of the road. <br /> <br /> The road shall be constructed in the manner specified by the Department of Public <br /> Works and shall be on an alignment meeting with the approval of the Planning <br /> <br /> Director in consultation with the Department of Public Works. The applicant <br /> shall construct all improvements prior to the issuance of a Certificate of <br /> <br /> Occupancy and dedicate them to the County upon request. <br /> <br /> <br /> The applicant has submitted an amendment to Condition H with the following suggested <br /> language (new items are underscored deleted items are braketed[]): <br /> <br /> The applicant shall construct the extension of Kakahiaka Street up to the driveway <br /> entrance of any development of the area covered by this rezoning ordinance [through the <br /> <br /> subject property (TMK: 7-3-10:3)] as a 50-foot wide street to dedicable standards with <br /> curb, gutter and sidewalk improvements along one side of the road. The undeveloped <br /> <br /> portion of this road extension shall be set aside as a fixture road reserve in conjunction <br /> with the subdivision creating the area covered by this rezoning ordinance.
