the necessary consents and approvals are obtained at comparable lease rates now <br /> being paid by the University of Hawaii until the 20,000 square foot building can be <br /> constructed on the State land at Applicant's expense. Applicant shall commence <br /> construction of the building, or assure its construction by a bond or other security <br /> accepted by the Planning Director and the Chancellor of Hawaii Community <br /> College, before the issuance of a certificate of occupancy for any building, other <br /> than the DOE building, or final subdivision approval for any subdivision creating <br /> single-family residential lots. Applicant shall complete construction of the <br /> University building no later than two (2) years after the issuance of a certificate of <br /> occupancy for any building, other than the DOE building, or final subdivision <br /> approval for any subdivision creating singe-family residential lots. The location <br /> and design of the building (interior and exterior) and related improvements will be <br /> on terms determined by the University of Hawaii. The University of Hawaii shall <br /> consult on design of said building with Applicant. <br /> <br /> FF. Applicant shall enter into an agreement with the DOE, in accordance with the terms <br /> of the State Land Use Decision and Order (Docket No. AO3-744) dated May 19, <br /> 2005. If Applicant's agreement with the DOE is later amended, Applicant shall file <br /> a copy of such amendment with the Planning Department and shall comply with the <br /> terms of the amended agreement. Applicant shall contribute to the DOE an 8,000 <br /> square foot building within the project site to use for a period of twenty (20) years, <br /> subject to the following conditions: <br /> 1. No rent or common area maintenance fees will be charged to the DOE. <br /> 2. The building will be used as instructional and office space for the school <br /> complexes located in West Hawaii. <br /> 3. The building will meet DOE facility standards, with finished classrooms, <br /> workshops and offices. <br /> 14 <br /> <br />
