LIY~N CIH <br /> June 16, 2006 <br /> s-_. <br /> Council Chairman Stacy Higa <br /> Hawaii County Council ~j^ ~ <br /> County of Hawaii <br /> 25 Aupuni Street _ F.., <br /> Hilo, Hawaii, 96720 cry <br /> RE: Contribution of Land for portion of New Mauka/Makai Roadway <br /> Within TMK (3) 7-2-6:009 ~ <br /> J <br /> Dear Chairman Higa: _ <br /> Pursuant to our meeting held on June 7, 2006 in your office between you, myself and <br /> Tom Yamamoto of my office, this will confirm our willingness to give the County aright-of-way <br /> (approximately 88' wide) for the mauka/makai road within our property identified as TMK (3) 7-2- <br /> 6:009. As we understand it, the mast mauka section of the proposed road would connect to <br /> Mamalahoa Highway and wind makai through State lands and then through the Hiluhilu <br /> development to Queen Kaahumanu Highway. <br /> We understand the benefit this brings to the Kona community as well as the entire island <br /> as a network of highways are planned and built. We are prepared to make this contribution <br /> without payment from the County. However, should any future development occur on our <br /> property we ask that the value of this contribution be credited to any fair share contributions that <br /> may be assessed against our development. Several connections to the roadway may be <br /> required due to the roadway bisecting the property as it winds up the slope maintaining <br /> acceptable grades. Also, certain portions of the land now zoned A-1a will need to be relocated <br /> to make way for the proposed alignment. <br /> We are currently working with Hiluhilu regarding the alignment as well as preparing <br /> archaeological, cultural, botanical and other related studies necessary to complete an <br /> environmental assessment for the roadway. <br /> Once the studies have been completed, the right of way identified and designed, we will <br /> make the right of way available to the County or to another entity for construction which will <br /> subdivide and dedicate the roadway to the County. <br /> Lynch Investments, LLC I lynch Neal Estate Services, Inc.
