No. 906Bi11 No. 289 PLACE: Sheraton Keauhou Bay Resort and Spa TIME: 10:30 a.m. Council Chair and Members Hawaii County Council Hilo, Hawaii 96720 Your Committee on Planning, to which was referred Communication No. 906 and Bill No. 289, transmitted by Mayor Harry Kim, dated May 8, 2006, regarding a State Land Use Boundary Amendment application by Scott T. Nakahara, at Ouli, South Kohala, Hawaii, TMK: 6-2-9: l7 reports as follows: Bill No. 289 seeks to amend the State Land Use District Boundaries Map for the County of Hawaii, by changing the District Classification for approximately 5.9 acres of land from the Agricultural District to Rural District. Communication No. 906 reports the Hawaii County Planning Commission, as required by Chapter 4, Section 6-4.3(C), Hawaii County Charter, considered the above request and accompanying Bill No. 290 on Apri121, 2006. The Commission concurred with the Planning Director's favorable recommendation on this matter. Communication No. 906 reports the Planning Director's findings and recommendations as the following: 1. The property is owned by the Scott T. Nakahara Trust and the Susan S. Nakahara Trust. The applicants are requesting a State Land Use Boundary Amendment for 5.9 acres from the Agricultural District to the Rural District. 2. The subject property is located along the south side of Kawaihae Road with access from Kanehoa Place, Kanehoa Estates Subdivision, Ouli, South Kohala, Hawaii. 3. The applicants are also requesting a concurrent Change of Zone (Bi11290) from the Agricultural 5- acre (A-Sa) to the Residential and Agricultural 2-acre (RA-2a) zoned district. 4. The applicants are requesting the State Land Use Boundary Amendment and the Change of Zone so that they may subdivide the property into two residentiaUagricultural lots. There are two existing single-family residence currently on the property, one on each of the two proposed lots. According to their change of zone application, the owners state that these two residences will be retained in their ownership if their land use requests are approved. 5. The subject property was part of the original 27-lot Kanehoa Estates Subdivision that was created in 1985. 6. The approval of the reclassification from the State Land Use Agricultural District to the Rural District will not be violative of Section 205-2, Chapter 205, Hawaii Revised Statutes, nor will it be inconsistent with the Land Use Commission Rules, Rule 13 of the Planning Commission Rules of Practice and Procedures, the Hawaii County General Plan and the Hawaii State Plan based on the following: PC REPORT N0. 90
