No. 906Bi11 No. 289 <br /> PLACE: Sheraton Keauhou Bay Resort and Spa <br /> TIME: 10:30 a.m. <br /> Council Chair and Members <br /> Hawaii County Council <br /> Hilo, Hawaii 96720 <br /> Your Committee on Planning, to which was referred Communication No. 906 and Bill No. 289, transmitted <br /> by Mayor Harry Kim, dated May 8, 2006, regarding a State Land Use Boundary Amendment application by <br /> Scott T. Nakahara, at Ouli, South Kohala, Hawaii, TMK: 6-2-9: l7 reports as follows: <br /> Bill No. 289 seeks to amend the State Land Use District Boundaries Map for the County of Hawaii, by <br /> changing the District Classification for approximately 5.9 acres of land from the Agricultural District to <br /> Rural District. <br /> Communication No. 906 reports the Hawaii County Planning Commission, as required by Chapter 4, <br /> Section 6-4.3(C), Hawaii County Charter, considered the above request and accompanying Bill No. 290 on <br /> Apri121, 2006. The Commission concurred with the Planning Director's favorable recommendation on this <br /> matter. Communication No. 906 reports the Planning Director's findings and recommendations as the <br /> following: <br /> 1. The property is owned by the Scott T. Nakahara Trust and the Susan S. Nakahara Trust. The <br /> applicants are requesting a State Land Use Boundary Amendment for 5.9 acres from the Agricultural <br /> District to the Rural District. <br /> 2. The subject property is located along the south side of Kawaihae Road with access from Kanehoa <br /> Place, Kanehoa Estates Subdivision, Ouli, South Kohala, Hawaii. <br /> 3. The applicants are also requesting a concurrent Change of Zone (Bi11290) from the Agricultural 5- <br /> acre (A-Sa) to the Residential and Agricultural 2-acre (RA-2a) zoned district. <br /> 4. The applicants are requesting the State Land Use Boundary Amendment and the Change of Zone so <br /> that they may subdivide the property into two residentiaUagricultural lots. There are two existing <br /> single-family residence currently on the property, one on each of the two proposed lots. According to <br /> their change of zone application, the owners state that these two residences will be retained in their <br /> ownership if their land use requests are approved. <br /> 5. The subject property was part of the original 27-lot Kanehoa Estates Subdivision that was created in <br /> 1985. <br /> 6. The approval of the reclassification from the State Land Use Agricultural District to the Rural <br /> District will not be violative of Section 205-2, Chapter 205, Hawaii Revised Statutes, nor will it be <br /> inconsistent with the Land Use Commission Rules, Rule 13 of the Planning Commission Rules of <br /> Practice and Procedures, the Hawaii County General Plan and the Hawaii State Plan based on the <br /> following: <br /> PC REPORT N0. 90 <br /> <br />
