~l <br /> <br /> "'I`~ CITY COV,JCIL <br /> CITY AND COUNTY OF HONOLULU 9'7-339 <br /> HONOLULU, HAWAII NO. <br /> RESOLUTION <br /> REQUESTING THE GOVERNOR AND THE STATE LEGISLATURE TO GIVE <br /> PRIORITY ATTENTION TO ADDRESSING AND RESOLVING MATTERS RELATING <br /> TO PRIVATIZATION. <br /> WHEREAS, the counties of the State and other governmental <br /> agencies thereof have for many years provided public services <br /> through contracts with the private sector; and <br /> .WHEREAS, the recent Hawaii Supreme Court's opinion in the <br /> Konno v. County of Hawaii case, decided on February 28, 1997, has <br /> put the legality of some county contracts into question based on <br /> the Court's interpretation of State civil-service laws; and <br /> WHEREAS, the counties' system for contracting public <br /> services has been jeopardized by the Konno decision; and <br /> WHEREAS, the Konno decision has resulted in different <br /> interpretations by the counties and 'various governmental <br /> agencies, and has created confusion not only among county <br /> government agencies but also for private businesses, especially <br /> those that have contracts with the public sector; and <br /> WHEREAS, it appears that although most segments of the <br /> community believe privatization of government services can be <br /> appropriate in certain situations, previous understandings of <br /> those situations have been made uncertain; and <br /> WHEREAS, the Council finds it necessary to resolve questions <br /> surrounding the Konno decision and the provision of public <br /> services through contracts with private businesses; now, <br /> therefore, <br /> BE IT RESOLVED by the Council of the City and County of <br /> Honolulu that the Governor and the State Legislature are <br /> requested to give priority attention to addressing and resolving <br /> matters relating to privatization; and <br /> OC500918.R97 <br /> <br />
