No. 408-06 PLACE: Council Chambers TIME: 8:30 a.m. Council Chair and Members Hawaii County Council Hilo, Hawaii 96720 Your Committee on Finance, to which was referred Resolution No. 408-06, reports as follows: Resolution No. 408-06, transmitted by Council Vice Chair Virginia Isbell, via Communication No. 978, dated July 3, 2006, directs the Clerk of the County of Hawaii to take necessary action to place the charter amendment proposed by Ordinance No. 06-96 on the 2006 General Election Ballot. The proposed measure relates to Ordinance No. 06-96, which proposes an amendment to the Hawaii County Charter proposed by Ordinance No. 06-96, removes the requirements of social security numbers and mailing addresses and amends the number of days the County Clerk has to verify and certify petitions without these requirements. The proposed resolution is required by Section 15-2, Article XV, Hawai`i County Charter, entitled, "CHARTER AMENDMENT OR REVISION" relating to verifying and certifying petitions for initiative and referendum. Also, the proposed measure directs the Clerk of the County of Hawaii to take all necessazy steps provided for in all applicable provisions of the Hawaii County Charter and the Hawaii Revised Statutes, within the prescribed time limits, for placing the Charter amendment proposed by Ordinance No. 06-96 on the 2006 General Election ballot for approval by the voters of the County. It also states that those actions include but not be limited to submission of the ballot question to Dwayne D. Yoshina, Chief Election Officer of the State of Hawaii, prior to 4:30 p.m., September 8, 2006, pursuant to Section 11-119(b), Hawaii Revised Statutes, and publication of the full text of the Charter amendment proposed by Ordinance No. 06-96 in the Hawaii Tribune Herald and the West Hawaii Today, two newspapers of general circulation in the County, prior to Saturday, September 23, 2006, the forty-fifth day prior to the 2006 General Election, pursuant to Section 15-2, Hawaii County Charter. Pursuant to Section 15-1, Article XV, Hawai`i County Charter, an ordinance proposing a Charter amendment be adopted after three readings on separate days and passed by the affirmative vote oftwo-thirds of the entire membership of the Hawaii County Council.
