No. 409-06 PLACE: Council Chambers TIME: 8:30 a.m. Council Chair and Members Hawaii County Council Hilo, Hawaii 96720 Your Committee on Finance, to which was referred Resolution No. 409-06, reports as follows: Resolution No. 409-06, transmitted by Council Vice Chair Virginia Isbell, via Communication No. 979, dated July 3, 2006, directs the Clerk of the County of Hawaii to take necessary action to place the charter amendment proposed by Ordinance No. 06-95 on the 2006 General Election Ballot. The proposed measure relates to Ordinance No. 06-95, which proposes an amendment to the Hawaii County Charter proposed by Ordinance No 06-95, to change the title of the County's fire department from "Fire Depaztment" to "Hawai`i Fire Department," as the official title of the department. The proposed resolution is required by Section 15-2, Article XV, Hawai`i County Charter, entitled, "CHARTER AMENDMENT OR REVISION" relating to the Fire Department. Also, the proposed measure directs the Clerk of the County of Hawaii to take all necessary steps provided for in all applicable provisions of the Hawaii County Charter and the Hawaii Revised Statutes, within the prescribed time limits, for placing the Charter amendment proposed by Ordinance No. 06-95 on the 2006 General Election ballot for approval by the voters of the County. It also states that those actions include but not be limited to submission of the ballot question to Dwayne D. Yoshina, Chief Election Officer of the State of Hawaii, prior to 4:30 p.m., September 8, 2006, pursuant to Section 11-119(b), Hawaii Revised Statutes, and publication of the full text of the Charter amendment proposed by Ordinance No. 06-95 in the Hawaii Tribune Herald and the West Hawaii Today, two newspapers of general circulation in the County, prior to Saturday, September 23, 2006, the forty-fifth day prior to the 2006 General Election, pursuant to Section 15-2, Hawaii County Charter. Pursuant to Section 15-1, Article XV, Hawai`i County Charter, an ordinance proposing a Chazter amendment be adopted after three readings on sepazate days and passed by the affirmative vote oftwo-thirds of the entire membership of the Hawaii County Council.
