'~f'S A RESOLUTION TRANSFERRING/APPROPRIATING AN APPROPRIATION OUT AND FROM THE DESIGNATED FUND ACCOUNT(S) AND CREDITING SAME TO A DESIGNATED FUND ACCOUNT(S) WHEREAS, Resolution 427-01, requested that the Mayor enter into negotiations for the acquisition of the Rice Parcel (TMK (3) 4-8-004:006) in Waipi`o was adopted on August 23, 2006; and WHEREAS, Hawaii Revised Statutes, chapter 343-5, subsection (a)(1) reads in part, "an environmental assessment shall be required for actions that: (1) Propose the use of state or county lands or the use of state or county funds, other than funds to be used for feasibility or planning studies for possible future programs or projects that the agency has not approved, adopted, or funded, or funds to be used for the acquisition of unimproved real property; provided that the agency shall consider environmental factors and available alternatives in its feasibility or planning studies"; and WHEREAS, Hawaii Administrative Rules (HAR) §11-200-5, Agency actions, states: "For all proposed actions that are not exempt as defined in section 11-200-8, HAR, the agency shall assess at the earliest practicable time the significance of potential impacts of its actions, including the overall, cumulative impact in light of related actions in the region and further actions contemplated"; and WHEREAS, the Department of Finance has requested funding from District I Contingency Relief account in the amount of $25,000 to be expended on an environmental assessment as required by the aforementioned statutes and rules governing the State and County of Hawaii. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII that the following amount is hereby transferred and appropriated as set forth below: FUND: General AMOUNT OF APPROPRIATION: $25,000.00 OUT AND FROM: 010.101.5101.91 Clerk-Council SVC -Contingency Relief $25,000.00
