<br /> <br /> <br /> <br /> <br /> <br /> <br /> s~~r <br /> <br /> <br /> County of Hawaii <br /> PLANNING COMMISSION <br /> Aupuni Center • 101 Pauahi Street, Suite 3 • Hilo, Hawaii 96720 <br /> Phone (808) 961-8288 • Fax(808)961-8742 <br /> September 27, 2006 <br /> <br /> <br /> <br /> <br /> Stacy Higa, Chairman <br /> and Members of the County Council <br /> County of Hawai `i <br /> 25 Aupuni Street <br /> Hilo, HI 96720 <br /> Dear Chairman Higa and Council Members: <br /> <br /> Planning Director Initiated <br /> Amendment to Chapter 25 (Zoning Code), Article 1, Section 25-1-5(b), <br /> Of the Hawaii County Code 1983 (2005 Edition, As Amended), by Amending <br /> The Definition of "Family" <br /> <br /> The Planning Commission at its duly held public hearing on September 7, 2006, <br /> considered the Planning Director's request for an amendment to Chapter 25 (Zoning <br /> Code), Article 1, Section 25-1-5(b) of the Hawaii County Code 1983 (2005 Edition, as <br /> amended), by amending the definition of "family" to read as follows: "Family" means an <br /> individual or two or more persons related by blood, state-sanctioned adoption, foster <br /> parentage, guardianship or marriage, or a group of not more than five unrelated persons <br /> (excluding servants), occupying a dwelling unit. The term includes individuals in larger <br /> group living situations described as group living facilities and family child care homes[.] <br /> and a group of not more than eight unrelated persons plus any program staff, living in a <br /> facility licensed by the department of health." <br /> <br /> A motion was made to send a favorable recommendation to the County Council. There <br /> were three votes in favor of the motion and three against. Therefore, the motion did not <br /> pass. No other motions were made. <br /> <br /> The three to three vote constitutes a "no action" by the Planning Commission because of <br /> the lack of the five affirmative votes required by Hawaii County Charter, Section 13-4(I). <br /> Under Section 25-2-42(d)(3) and Planning Commission Rules 11-3(b)(2), the Planning <br /> Commission's non-action constitutes an unfavorable recommendation. This unfavorable <br /> recommendation is being forwarded to you, along with a copy of the hearing transcripts, <br /> draft bill, and background report. <br /> <br /> Hawaii County is an Equal Opportunity Provider and Employer <br />
