Most of these group homes serve people with <br /> disabilities, and the courts have ruled that such people have special need for group <br /> <br /> homes. Local governments must make "reasonable accommodations" so that such group <br /> homes can be established. A limit such as the "five unrelated persons" rule in the current <br /> <br /> Hawaii County zoning code can be struck down by the court if the court finds that it has <br /> the effect of limiting group homes, and that increasing the number of persons allowed <br /> <br /> would be a reasonable accommodation. <br /> RECOMMENDATION <br /> <br /> For the reasons presented above, the Planning Director is initiating this <br /> amendment to the Zoning Code and recommends approval of the change by the Planning <br /> <br /> Commission and the Hawaii County Council. The accompanying draft bill to amend <br /> Chapter 25 (Zoning Code) is provided for your favorable consideration. <br />
