<br /> <br /> <br /> <br /> <br /> <br /> PETITION REQUESTING INSTITUTION OF.VRFF D~R <br /> FOR ESTABLISHMENT OF DISTIT <br /> PURSUANT TO THE COMMUNITY FACILITIES DISTRICT CODE <br /> (CHAPTER 32 OF THE HAWAI't COUNTY;-XD ) <br /> <br /> <br /> 1. Bridge Aina Le'a, LLC, a Hawaii limited liability company ("Bridge") submits <br /> this Petition to the Council pursuant to Section 32-19 of the Hawaii County Code (the "Code"), <br /> and avers as follows: <br /> <br /> <br /> (a) Bridge respectfully requests that the Council institute the procedure to establish a <br /> Community Facilities District ("District") pursuant to Chapter 32 of the Code. <br /> <br /> (b) The boundaries of the territory which is proposed for inclusion in such District are <br /> shown on the map attached hereto as Exhibit A and made a part hereof for all purposes, and <br /> the legal description of such territory is set forth in Exhibit B attached hereto and made a part <br /> hereof for all purposes. <br /> <br /> (c) The type or types of facilities to be financed by the District are more particularly <br /> set forth in Exhibit C attached hereto and made a part hereof for all purposes. <br /> <br /> (d) Bridge certifies that it is the owner of one hundred percent (100%) of the area of <br /> land proposed to be included within the proposed District, and that there are no lessees for the <br /> land to be included within the proposed District. <br /> <br /> 2. Bridge respectfully requests that the Council determine, pursuant to Section 32- <br /> 24 of the Code, that it is unnecessary to provide notice of hearing or to conduct a public <br /> hearing under said Chapter 32, and Bridge hereby expressly consents to the waiver of such <br /> notice and hearing. Bridge shall conduct a public informational workshop and provide a report <br /> to the Council prior to the adoption by the Council of an Ordinance of Formation establishing <br /> the District. <br /> <br /> 3. Bridge hereby consents to and expressly waives any and all claims based on any <br /> irregularity, error, mistake or departure from the provisions of the Code and any and all laws <br /> and requirements incorporated therein, and no step or action in any proceeding relative to the <br /> formation of the District shall be invalidated or affected by any such irregularity, error, <br /> mistake or departure. <br /> <br /> <br /> <br /> <br /> <br /> Comm.
