These improvements and five- <br /> foot road widening strip shall be dedicated to the County of Hawaii prior to issuance of a <br /> Certificate of Occupancy. In the event a property owner elects not to relinquish the five-foot <br /> strip, modified improvements shall be made within the existing right-of-way, meeting with the <br /> approval of the Department of Public Works. These modified improvements shall be completed <br /> and dedicated to the County of Hawaii prior to issuance of a Certificate of Occupancy." <br /> <br /> Re-lettered original Conditions "J" through "U" shall now read as Conditions "K" through "V". <br /> <br /> Condition S (formerly Condition "R") - amendment provides for cost of improvements outlined in <br /> Condition J be credited against all of applicant's fair share contributions. The last paragraph of Condition <br /> S shall reads as follows: <br /> <br /> "(S) In lieu of paying the fair share contribution, the applicant may contribute land and/or <br /> construct improvements/facilities related to parks and recreation, fire, police, solid waste <br /> disposal facilities and roads within the region impacted by the proposed development, subject to <br /> the review and recommendation of the Planning Director, upon consultation with the appropriate <br /> agencies and approval of the County Council. In either case, the cost of improvements outlined <br /> in Condition J shall be credited against all of the applicant's fair share contributions. Any and all <br /> balance shall be paid to the County of Hawaii and be divided appropriately between the police, <br /> fire, solid waste, and park and recreational categories." <br /> <br /> Your consideration is appreciated.
