<br /> <br /> HB2541 Page 1 of 2 <br /> <br /> <br /> Report Title: <br /> Association of Counties; Public Land Liability <br /> <br /> <br /> Description: <br /> <br /> Repeals the sunset dates of, thereby making permanent, laws that <br /> provide the state and county governments with liability protection <br /> for public use of certain state or county recreational areas. <br /> <br /> HOUSE OF REPRESENTATIVES 2541 <br /> <br /> TWENTY-THIRD LEGISLATURE, 2006 H ¦ B ¦ N O ¦ <br /> STATE OF HAWAII <br /> <br /> <br /> <br /> <br /> <br /> A BILL FOR AN ACT <br /> <br /> <br /> <br /> relating to liability. <br /> <br /> <br /> <br /> BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII: <br /> <br /> SECTION 1. The legislature finds that the statutes providing state <br /> and county immunity on certain public lands have proven to be <br /> beneficial to the State and county governments as well as the general <br /> public. The liability protections have reduced the exposure of the <br /> state and county governments to substantial damages and, as a result, <br /> allowed the state and county governments to keep recreational areas <br /> with potentially dangerous conditions open to the public. <br /> Furthermore, the warning signage required by the statutes has <br /> promoted public safety by informing users of the recreational areas <br /> of potentially dangerous conditions. <br /> <br /> The purpose of this Act is to repeal the sunset dates of.three <br /> statutes that provide the state and county governments with liability <br /> protection for public use of certain state or county recreational <br /> areas. <br /> <br /> SECTION 2.
