No. 1037/Bill No. 329 <br /> <br /> PLACE: Sheraton Keauhou Bay Resort & Spa <br /> TIME: 2:30 p.m. <br /> Council Chair and Members <br /> <br /> Hawaii County Council <br /> Hilo, Hawaii 96720 <br /> Your Committee on Planning, to which was referred Bill No. 329, reports as follows: <br /> BiII No. 329, transmitted by Council Vice Chair Virginia Isbell via Communication No. 1037, dated <br /> August 23, 2006, amends the Hawaii County Code 1983 (2005 Edition, As Amended) by Adding a New <br /> Chapter Relating to Adequate Public Facilities. <br /> BiII No. 329 adds requirements to the County Code which attempt to identify infrastructure and services <br /> necessary to support new development and establishes a policy for when and how these improvements <br /> and services will be constructed and maintained. Bill No. 329 provides that no new development be <br /> approved by the Planning Director unless road, water and sewer facilities are deemed to be adequate as <br /> required by this bill. According to Bill No. 329, all new development shall be served by "an adequate <br /> network of roads," "an adequate water system," and "an adequate sewer system." If these three <br /> infrastructure systems are deemed to be adequate, then new development may be approved. Conversely, <br /> if these three infrastructure systems are deemed to be inadequate, then "the new development in question <br /> shall not be approved." <br /> Bill No. 329 requires that capital improvement projects will increase infrastructure to support the new <br /> development, or that the developer shall fund infrastmcture improvements to ensure the adequacy of the <br /> system(s) to support new development, or that the County and the developer will enter into a binding <br /> agreement to ensure that adequate infrastructure systems are in place to support new development. <br /> At the September 19, 2006 Planning Committee meeting public testimony was presented by Anika Glass, <br /> Charles Flaherty, Brenda Ford, Cheryl King, 1. Curtis Tyler and Alex Leonazd. <br /> The majority of the public testifiers noted that Committee Vice Chair Hoffinann's concurrency bills (Bill <br /> 318 and 319) and Council Vice Chair Isbell's concurrency and adequate public facilities bills (Bill 328 <br /> and 329) be referred to the Planning Commission and the Planning Director.
