No. 1081/Bill No. 340 PLACE: Councilroom (new location) Ben Franklin Building 333 Kilauea Avenue, 2°" Floor Hilo, HI 96720 TIME: 2:00 p.m. Council Chair and Members Hawaii County Council Hilo, Hawaii 96720 Your Committee on Planning, to which was referred Bill No. 340, reports as follows: Bill No. 340, transmitted via Communication No. 1081 from Mayor Harry Kim, dated September 8, 2006, presents a Request for Change of Zone by James and Madeleine Budde at Anekona Estates Subdivision, Ouli, South Kohala, Hawaii, TMK: 6-2-11:20. Bill No. 340 seeks to amend Section 25-8-7 (North and South Kohala Zone Map), Article 8, Chapter 25 (Zoning Code) of the Hawaii County Code 1983 (2005 Edition), by changing the District Classification from Agricultural 5-acre (A-Sa) to Residential and Agricultural 2-acre (RA-2a) at Ouli, South Kohala, Hawaii. Communication No. 1081 reports that the Hawaii County Planning Commission, as required by Chapter 4, Sec. 6-4.3(C), Hawaii County Charter, considered the above request on August 25, 2006. The Commission concurred with the Planning Director's reasons for a favorable recommendation for approval of this matter. Communication No. 1081 transmits the following findings and recommendations: 1. Applicants are requesting a Change of Zone from Agricultural 5-acre (A-Sa) to Residential and Agricultural 2-acre (RA-2a) for approximately five acres of land to subdivide the property into two (2) lots approximately 2+ acres in size to construct a dwelling on the newly created lot. Applicants have also submitted a concurrent request for a State Land Use District Boundary Amendment from an Agricultural to a Rural district. 2. The subject property is located on the south side of Kanehoa Street and north of Keanuiomano Stream, Anekona Estates Subdivision, Ouli, South Kohala, Hawaii. 3. The Change of Zone request will conform to, among others, the Land Use (Single Family Residential) policies of the General Plan: • Rural-style residential-agricultural developments, such as new small-scale rural communities or extensions of existing rural communities, shall be encouraged in appropriate locations. • Review and amend land use ordinances and codes to include considerations for rural-style residential subdivisions in appropriate locations.
