No. 1101Bi11 No. 344 <br /> <br /> PLACE: Councilroom (new location) <br /> Ben Franklin Building <br /> 333 Kilauea Avenue, 2"" Floor <br /> Hilo, Hawaii <br /> TIME: 2:00 p.m. <br /> Council Chair and Members <br /> Hawaii County Council <br /> Hilo, Hawaii 96720 <br /> Your Committee on Planning, to which was referred Bill No. 344, reports as follows: <br /> Bill No. 344, transmitted via Communication No. ] 104 from Mayor Harry Kim, dated September 27, <br /> 2006, presents a Change of Zone Request by Jon Mitsuda at Waiakea, South Hilo, Hawaii, TMK: 2-4- <br /> 80:15 (formerly 2-4-3: portion of 4). <br /> Bill No. 344 seeks to repeal Ordinance No. 96-81 which amended Section 25-114 (City of Hilo Zone <br /> Map), Article 3, Chapter 25 (Zoning Code) of the Hawaii County Code, by changing the District <br /> Classification from Agricultural (A-3a) to Single Family Residential (RS-10) at Waiakea, South Hilo, <br /> Hawaii, covered by Tax Map Key: 2-4-80:15 (formerly 2-4-3: portion of 4). <br /> Communication No. 1101 reports that the Hawaii County Planning Commission, as required by Chapter <br /> 4, Sec. 6-4.3(C), Hawaii County Charter, considered the above request on September 7, 2006. The <br /> Commission voted to send a favorable recommendation to the County Council regarding applicant's <br /> request to repeal Ordinance No. 96-81 that reclassified approximately 1.952 acres of an approximately <br /> 7.871-acre property from Agricultural 3-acre (A-3a) to a Single Family Residential - 10,000 square feet <br /> (RS-10) district. <br /> Communication No. 1101 transmits the following findings and recommendations: <br /> l . The subject property is located at the west end of Ahe Street, adjacent to the Hoomalu Street <br /> Subdivision, Waiakea, South Hilo, Hawaii. <br /> 2. Applicant has submitted a request to repeal Ordinance No. 96-81, which reclassified <br /> approximately 1.952 acres of an approximately 7.871-acre property from A-3a to RS-10. The <br /> prior owner obtained the RS-10 Change of Zone for approximately 1.952 acres to allow <br /> subdividing that 1.952-acre portion into six 10,000 square foot lots, but subsequently decided not <br /> to proceed with the 6-lot subdivision. <br /> 3. The applicant purchased the two-lot subdivision on August 5, 2004 and has no intention of <br /> subdividing the RS-] 0 zoned portion of the property and is requesting a repeal of Ordinance No. <br /> 96-81 that will result with reversion of the RS-10-zoned area to its original Agricultural 3-acre <br /> (A-3a) district. <br /> At the October 30, 2006 meeting, no public testimony was presented on this matter. By fax dated <br /> October 27, 2006, Applicant Mr. Mitsuda notified the Committee that he is unable to attend today's <br /> PC Report No. 123 <br /> <br />
