Arakaki, Chair and Councilmembers Hawaii•:CouttYty Council x ~ Fr s, FROM: John Ray SUBJECT: Attached Resolution Re: Hamak Lands Under County Ownership and Waiver of Said Resolution from the Com~ittee on Finance to the Council Attached please find a new resolution requesting the mayor to submit a revised plan of disposition for the former Hamakua Sugar Company, Inc. lands now under county ownership. It is my sense that a new resolution is appropriate and should be waived by the Committee on Finance in order that appropriate action can be taken by the Council. As you know, at the September 15, 1998 meeting of the Committee on Finance, members took up consideration of my proposed amendment to Resolution 267-98 (Draft 2). Discussion that day focused on forging consensus for a disposition plan incorporating elements of Resolution No. 267-98, submitted by Mayor Yamashiro on May 1, 1998, and Resolution No. 309-98, submitted by Councilmember Dominic Yagong on August 17, ] 998, as well as testimony received from the public at hearings held on August 27-28, 1998 in Captain Cook, Kona and Honokaa, respectively. This prior discussion provides a foundation for the consideration of a newly drafted resolution, and the new resolution reflects those changes and corrections proposed at the Finance Committee's September 15'~ meeting. Moreover, a new resolution serves to preclude any legal or procedural argument as to the validity of earlier Council action on Resolution No. 267-98, as amended.
