Taira <br /> Housing Administrator <br /> rte? <br /> SUBJECT: Sill 345 - Amending Chapter 25, Article 1, <br /> Subsection 25-1-5 (b), (Zoning Code) <br /> As requested, the Office of Housing and Community Development (OHCD) is <br /> providing the following for information for Bill 345 which is scheduled for <br /> today's Council meeting. <br /> As an advocate for Fair Housing and related mandates the OHCD feels that these <br /> issues should be considered. Legal exposure by the County passing or not <br /> passing Bill 345 should be discussed with the Office of the Corporation <br /> Counsel. <br /> For example: <br /> Title II of the Americans with Disabilities Act (ADA) imposes an <br /> affirmative duty on local governments to make reasonable accommodation (by <br /> modification or exception) in land use regulations and practices when such <br /> accommodation may be necessary to afford disabled persons an equal opportunity <br /> to housing. <br /> Title II, Part A of the Americans with Disabilities Act specifically <br /> prohibits state and local governments, their departments, agencies and any <br /> subdivision from excluding qualified individuals with disabilities from any <br /> services, programs or activities offered. <br /> In general, the OHCD would support the opportunity to produce more housing <br /> units, including special needs housing. <br /> Comm.
