wI/~~.~F~ <br /> / <br /> li- <br /> COUNTY OF HAWAII STATE OF HAWAII <br /> BILL NO. <br /> ORDINANCE NO. <br /> <br /> AN ORDINANCE AMENDING CHAPTER 25, HAWAII COUNTY CODE 1983 (2005 <br /> EDITION, AS AMENDED) RELATING TO ZONING. <br /> BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII <br /> SECTION 1. The county administers and enforces vazious regulations to control land use, <br /> including the subdivision code and zoning code. These regulations specify what developers can <br /> and cannot do in the interest of the public's health, safety, or welfaze. The county council finds <br /> that developments proposed in a particular area should be assessed considering a number of <br /> factors, including how much public infrastructure is challenged by recent or anticipated growth <br /> in the area. The county council finds that conditions of approval should be imposed to <br /> accommodate the impacts of development of planned unit and cluster plan developments which <br /> consist of seven or more lots, in order to manage growth and coordinate the delivery of <br /> government services in the county. <br /> SECTION 2. Chapter 25, azticle 6, division 1, section 25-6-4, Hawaii County Code 1983 <br /> (2005 edition, as amended), is amended to read as follows: <br /> "Section 25-6-4 Notice of action on P.U.D. application. <br /> (a) Upon acceptance of a P.U.D. application consisting of six or fewer lots, the director <br /> shall fix a date for the director's action on the application. Within ten days after <br /> receiving notice of such date, the applicant shall serve notice of the application on <br /> surrounding owners and lessees of record, as provided by section 25-2-4. The <br /> applicant shall also serve notice on owners and lessees of record of interests in other <br /> properties which the director may find to be directly affected by the P.U.D. permit <br /> sought. The applicant shall also post a sign for public notification on the property as <br /> provided by section 25-2-12. <br /> (b) For P U D applications consisting of six or fewer lots, the[Tke] director shall publish <br /> notice of the date of the proposed decision by the director and the date by which <br /> written comments must be received by the director in at least two newspapers of <br /> general circulation in the County, at least ten days prior to the director's proposed <br /> decision. <br /> (c) Within sixty days of acceptance of a P U D application consisting of seven or more <br /> lots the director shall refer the P U D application to the commission and the council <br /> for approval which approval maybe subiect to conditions in accordance with section <br /> 25-6-6 "Actions on P.U.D. permit applications." <br /> (d) The applicant shall post a sign for public notification on the property as provided by <br /> section 25-2-12." <br /> <br />
