Communication 331 <br /> <br /> Resolution 158 <br /> <br /> Page 3 of 5 <br /> <br /> this time, it will still take a couple of years to implement, but hoped the measure could address <br /> how this could be accomplished. <br /> Mr. Hoffmann asked that council members view Ms. Willes' testimony summation relating to <br /> Council responsibility and the public's demands and noted that a request was made by Director <br /> Yuen to Corporation Counsel for a legal opinion with respect to subdivisions and not PUD's, <br /> which is clearly the responsibility of the council. Mr. Hoffmann asked for a postponement of <br /> this matter to allow time to study the matter and make changes and also to allow the council to <br /> study the opinion of Corporation Counsel. <br /> This matter was postponed to the May 15, 2007 Planning Committee meeting by a unanimous <br /> vote. <br /> At the May 15, 2007 Planning Committee meeting Tim Reese presented testimony in opposition <br /> and Margaret Wille testified in support of Resolution 158. Both were present at the Hilo <br /> Council Chambers. Mr. Charles Flaherty and Mr. Raymond Bach testified in support of <br /> Resolution 158 and both were present at the Kona Council office. <br /> Council Chair Hoffmann presented a brief background regarding Resolution 158 noting several <br /> discussions he had with Planning Director Yuen and that the resolution is not an attempt to <br /> change the Subdivision Code, but to forwazd the resolution to the Planning Director and the <br /> Planning Commission to obtain suggestions and recommendations. Mr. Hoffmann stated this is <br /> not a change to any existing policies and procedures but to work with the administration to <br /> address planning and effective growth shortfalls in this county. Mr. Hoffmann noted that after <br /> submitting the Resolution in early Apri12007 the Planning Director requested an opinion from <br /> Corporation Counsel who opined this was probably not the right approach. Therefore, Mr. <br /> Hoffmann is asking for the approval of proposed amendments to Resolution 158 contained in <br /> Communication 331.2. A motion to amend Resolution 158 with Communication 331.2 was <br /> approved. <br /> Mr. Hoffmann said the proposed amendment seeks only to have the council provide <br /> recommendations prior to subdivision applications containing 7 or more lots aze decided. He <br /> stated he recognizes there maybe pitfalls relating to this which have been discussed with the <br /> Planning Director, however, he stated we must involve the general public and the policy making <br /> body of this county to provide better and more effective management over planning and <br /> development. Mr. Hoffmann said he believes this is a step forward and asks the Planning <br /> Department and the Planning Commission to give recommendations and suggestions on how to <br /> proceed. <br /> Council Member Higa noted that providing recommendations prior to the Planning Director <br /> approving a subdivision containing 7 or more lots is something the Council is able to do now. <br /> He said Council Members can get involved with applications in their district and not involve the <br /> entire Council. Mr. Higa stated he won't support this right now because what is being proposed <br /> by Mr. Hoffmann can be accomplished by bringing forth a resolution before the Council and <br /> referring it to the Planning Director with recommendations however, Mr. Hoffmann responded <br /> PC Report No. 32 <br /> <br />
