Dr. Brian Sakamoto. TMK: 2-2-21:7 & 46 <br /> My wife and I purchased the subject property in 2003 with the intention of <br /> constructing a new building for my dental practice and other office and/or retail uses. In <br /> submitting our plans for Plan Approval and a building pemut, we were informed by your <br /> office in a letter, dated Apri12, 2007 that the operative rezoning ordinance (Ord. 93-101) <br /> had a time performance condition. (Exhibit A) Because the time limit expired, we were <br /> unable to have the plans processed. We are thus seeking amendment to that condition, as <br /> well as would like to have this letter serve as the annual report. <br /> BACKGROUND <br /> The subject contiguous parcels consist of a combined area of 20,812 squaze feet. <br /> They are located on the north side of Lazrihuli Street, approximately 155 feet east of the <br /> intersection of Lanihuli and Kinoole Streets, Waiakea, South Hilo. By approval of <br /> Ordinance No. 93-101 (Exhibit B), the subject site was rezoned on October 8, 1993 from <br /> Commercial-Office (CO-20) to Generai Commercial (CG-20). This approval was subject <br /> to a number of performance conditions, one of which required completion of the <br /> proposed commercial development within three (3) yeazs of receipt of final Plan <br /> Approval. <br /> Following this rezoning approval, final Plan Approval for a retaiUwazehouse <br /> building by the former owner January 17, 1995 (Exhibit C). Since that time, the former <br /> applicant/owner did not proceed with its project. We subsequently purchased the <br /> property in 2003 with the expectation of relocating my practice to this area as well as <br /> providing areas for other office and/or retail uses. A copy of the proposed site plan is <br /> enclosed as Exhibit D. 2000. Since issuance of the Plan Approval, however, no time <br /> extension requests were filed. <br /> Notwithstanding the inaction of the former landowner, we would like to finalize <br /> <br /> the project and fulfill the conditions of the zone change as soon as possible.
