One condition (C) of approval <br /> of the rezoning was that development of the commercial area was to be completed within three <br /> (3) years of issuance of Final Plan Approval (FPA was required within one (1) year of the <br /> Ordinance effective date). Other conditions of the Ordinance approval include, but are not <br /> limited to, construction of curbs, gutters and sidewalks along the whole Lanihuli Street frontage. <br /> Although the original Final Plan Approval was issued within the timeframe required and a <br /> Building Permit was issued for the construction of the RetaiUWarehouse Building, it appears that <br /> actual construction never occurred. Compliance with the condition (C) has never been granted a <br /> time extension. <br /> This situation needs to be addressed by the landowner/petitioner in consultation with the <br /> Planning Departments' Planning Commission Division.
