Thence along the Easterly side of Kukui Road along a curve to the left having a <br />radius of 620.00 feet, the chord azimuth and distance being: <br />4. 160° 49' 20" 12.50 feet to a nail (found); <br />5. 257° 15' 45" 81.64 feet along Lot 171, Naalehu Subdivision, <br /> Third Series to a pipe; <br />6. 163° 53' 30" 10.00 feet along Lot 171, Naalehu Subdivision, <br /> Third Series to a pipe; <br />7. 253° 53' 30" 35.05 feet along Lot 171 and Lot 173, Naalehu <br /> Subdivision, Third Series to a pipe; <br />8. 347° 26' 11" 175.40 feet along Lot 170-B to the point of <br />beginning and containing an area of 17,382 <br />square feet, more or less. <br />All as shown on the map attached hereto, marked Exhibit "A" and by reference <br />made part hereof. <br />SECTION 2. In accordance with Section 25-2-44, Hawaii County Code 1983 (2005 <br />Edition), the County Council finds the following conditions are: <br />(1) Necessary to prevent circumstances which maybe adverse to the public <br />health, safety and welfare; or <br />(2) Reasonably conceived to fulfill needs directly emanating from the land use <br />proposed with respect to: <br />(A) Protection of the public from the potentially deleterious effects of <br />the proposed use, or <br />(B) Fulfillment of the need for public service demands created by the <br />proposed use. <br />A. The applicant, successors or assigns shall be responsible for complying with all of <br />the stated conditions of approval. <br />-2- <br />
