WHEREAS, Grantee is qualified to receive funds <br /> available to Hawaii under the Act and its implementing <br /> regulations (28 C.F.R. Part 33) or guidelines (Office of <br /> Justice Programs, STOP Violence Against Women Formula and <br /> Discretionary Grant Program Guidance), and has applied to <br /> Agency for receipt of the same as a subgrantee; <br /> WHEREAS, Agency has reviewed Grantee's application <br /> for funds, and is satisfied that all of the requirements of the <br /> Act and its implementing regulations have been satisfied and <br /> that Grantee is capable of using the federal funds requested <br /> appropriately; <br /> WHEREAS, Grantee has demonstrated the capacity to <br /> provide the services, programs and activities described herein <br /> and is ready, willing and able to provide the required <br /> services, programs and activities; <br /> NOW THEREFORE, Agency and Grantee for and in <br /> consideration of the covenants, conditions, agreements, and <br /> stipulations hereinafter expressed, do mutually agree as <br /> follows: <br /> A.
