BRS ] OKalaoa-REZ854.jwd-OS-23-07 COUNTY OF HAWAII PLANNING DEPARTMENT BACKGROUND REPORT RSIO KALAOA LLC CHANGE OF ZONE ORDINANCE N0.97-56 (REZ 854) AMENDMENT TO CONDITION D (SECURE FINAL SUBDIVISION APPROVALI RS10 KALAOA LLC has submitted a request to amend Condition D (time to secure Final Subdivision Approval) of Change of Zone Ordinance No. 97-56, which rezoned approximately 10.283 acres of land from anAgricultural - 5 Acre (A-Sa) to a Single Family Residential - 10,000 Square Foot (RS-10) district. The property is located on the makai side of Mamalahoa Highway between Kona Coastview (Nana Street) and Kona Palisades (Holoholo Street) Subdivisions, at Kalaoa 4`h, North Kona, Hawaii, TMK: 7-3-28: 82 through 102 (formerly 7-3-10:37). APPLICANT'S REQUEST 1. Request: The applicant has submitted a request fora 5-year time extension to comply with Condition D of Zone Ordinance No. 97-56 (REZ 854), which states: "D. Final Subdivision Approval of the proposed residential subdivision within the subject property shall be secured from the Planning Director within five (5) years from the effective date of this ordinance." The applicant also requested a 5-year time extension to comply with Condition C, but this condition does not have a time requirement and, as of this date, the applicant is in compliance with the requirements of Condition C. 2. Reasons for Request: The applicant is in the process of subdividing and developing a total of thirty four (34) residential lots. Increment 1 has been completed, which consists of twenty (20) lots. Increment 2 is pending until the applicant is able to obtain the required water commitments from the Department of Water Supply for the remaining lots. According to the applicant, they have graded the roadway to subgrade and have graded the lot pads for Increment 2. They will commence construction once the water commitments have been secured.
