BRS ] OKalaoa-REZ854.jwd-OS-23-07 <br /> COUNTY OF HAWAII PLANNING DEPARTMENT <br /> BACKGROUND REPORT <br /> <br /> RSIO KALAOA LLC <br /> CHANGE OF ZONE ORDINANCE N0.97-56 (REZ 854) <br /> <br /> AMENDMENT TO CONDITION D (SECURE FINAL SUBDIVISION APPROVALI <br /> RS10 KALAOA LLC has submitted a request to amend Condition D (time to secure <br /> Final Subdivision Approval) of Change of Zone Ordinance No. 97-56, which rezoned <br /> approximately 10.283 acres of land from anAgricultural - 5 Acre (A-Sa) to a Single Family <br /> Residential - 10,000 Square Foot (RS-10) district. The property is located on the makai side of <br /> Mamalahoa Highway between Kona Coastview (Nana Street) and Kona Palisades (Holoholo <br /> Street) Subdivisions, at Kalaoa 4`h, North Kona, Hawaii, TMK: 7-3-28: 82 through 102 (formerly <br /> 7-3-10:37). <br /> APPLICANT'S REQUEST <br /> 1. Request: The applicant has submitted a request fora 5-year time extension to comply <br /> with Condition D of Zone Ordinance No. 97-56 (REZ 854), which states: <br /> "D. Final Subdivision Approval of the proposed residential subdivision within the <br /> subject property shall be secured from the Planning Director within five (5) years <br /> from the effective date of this ordinance." <br /> The applicant also requested a 5-year time extension to comply with Condition C, but this <br /> condition does not have a time requirement and, as of this date, the applicant is in <br /> compliance with the requirements of Condition C. <br /> 2. Reasons for Request: The applicant is in the process of subdividing and developing a <br /> total of thirty four (34) residential lots. Increment 1 has been completed, which consists <br /> of twenty (20) lots. Increment 2 is pending until the applicant is able to obtain the <br /> required water commitments from the Department of Water Supply for the remaining <br /> lots. According to the applicant, they have graded the roadway to subgrade and have <br /> graded the lot pads for Increment 2.
