vvwy <br /> f~„`V ....1,~0 <br /> COUNTY OF HAWAII STATE OF HAWAII <br /> ~II Of ~Mf~' <br /> RESOLUTION NO. 329 0'7 <br /> <br /> A RESOLUTION REQUESTING THE DIRECTOR OF THE DEPARTMENT OF <br /> PUBLIC WORKS TO CONSISTENTLY ENFORCE THE REGULATIONS WITHIN <br /> <br /> CHAPTER 3, HAWAII COUNTY CODE 1983 (2005 EDITION, AS AMENDED), <br /> <br /> RELATING TO SIGNS. <br /> WHEREAS, the purpose of chapter 3 of the Hawaii County Code 1983 (2005 Edition, <br /> as amended), hereinafter "the Code", relating to signs, is to protect the natural beauty of Hawaii <br /> Island; ensure public safety, health and welfare; give fair and equal opportunity to all; reduce <br /> visual clutter; and encourage and promote the visitor industry; and <br /> WHEREAS, there has been an increase in the number of illegal signs as defined by <br /> section 3-7(a) (Signs prohibited in all districts) of the Code; and <br /> WHEREAS, this proliferation of illegal signs, including but not limited to sandwich <br /> boazds and banners, has created a substantial increase in the number of complaints from residents <br /> and visitors; and <br /> WHEREAS, section 3-1(b) of the Code provides for the fair establishment and <br /> consistent enforcement of the aforementioned sign regulations; and <br /> WHEREAS, section 3-37(a) of the Code states the director of the department of public <br /> works, or a designated assistant, shall enforce the regulations within chapter 3 of the Code; and <br /> WHEREAS, to ensure compliance with section 3-7(a), of the Code (Signs prohibited in <br /> all districts), enforcement pursuant to section 3-37 of the Code (Enforcement), must be <br /> increased; now therefore, <br /> BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII that the <br /> director of the department of public works, or a designated assistant, consistently enforce any <br /> and all violations of section 3-7(a) of the Code and that fines for violations be aggressively <br /> pursued in accordance with section 3-38(c), of the Code (Administrative enforcement); and <br /> BE IT FURTHER RESOLVED, that this Council recognizes and supports the ongoing <br /> efforts of the department of public works and will strongly consider the appropriation of <br /> additional funding, if required, to carry out a more aggressive campaign to enforce the <br /> regulations within chapter 3 of the Code; and <br /> <br />
