Re: Resolution Creating Positions
The Civil Case Number 98-244, United Public Workers (UPW) versus the County of Hawaii, et al.,
relating to the privatization of janitorial and ground maintenance work, has been settled. The
settlement calls for the County of Hawaii to hire UPW workers instead of contracting out for
janitorial and ground maintenance services. In order to comply with this settlement, the Department
of Parks and Recreation would like to create a Park Caretaker I (3/5T) position and a Park
Caretaker I (1/2T) position for its Parks Maintenance Division. The Park Caretaker I (3/5T) position
will be for the South Hilo district and the Park Caretaker I (1/2T) position will be for the Kona district.
Both will be used to perform the custodial, janitorial, and ground maintenance work in and around
the County facilities that the Department of Parks and Recreation currently occupies.
Enclosed is a resolution that creates a Park Caretaker I (3/5T) position and a Park Caretaker I
(1/2T) position for the Parks Maintenance Division.
Due to the urgency of creating these new positions for the Department of Parks and Recreation,
they request a waiver from the Finance Committee and have this resolution heard at the Council
meeting scheduled for October 17, 2007. Also, In the coming weeks, please expect other
transmittals of resolutions creating new positions for the other departments and agencies affected
by this civil settlement.

A. REQUEST:
Prepare a resolution to create two half time positions. One Park Caretaker I (3/5 Time) for the South Hilo
district and one Park Caretaker I (1/2 Time) postion for the Kona district.
B. BACKGROUND AND JUSTIFICATION (USE ADDITIONAL SHEETS AS NEEDED):
During FY 2007-08 the County of Hawaii settled a lawsuit with the United Public Workers Union (UPW). Civil
case #98-244 called for the County to hire UPW workers instead of contracting out for janitorial/grounds
maintenance services. As such, in order to be in compliance with Civil settlement #98-244 the Department of
Parks and Recreation would like to create 1 Park Caretaker I (1/2 Time) position for Kona and 1 Park
Caretaker I (3/5 Time) for South Hilo.
Please waive Finance Committee. Positions need to be created as soon as possible to be in compliance with
settlement agreement.

No, these are new duties and current staffing is not available to work at the different
facilities in the South Hilo and Kona districts. The legal settlement has ended our
ability to use contracts for this type work.

productivity measurements where possible.):
These positions are being created specifically for the need that has arisen from the
settlement. This new staffing will be in lieu of the contracted maintenance staff that
currently clean our facilities.

Under the general supervision of the Park Maintenance Supervisor II, this position is to provide for the care and Show
maintenance of designated Parks and Recreation Department facilities, offices, common areas, and grounds located
in the South Hilo district. This position may be assigned to a roving crew or designated facility. of time
1. Cleans and maintains assigned recreational facilities, offices, and their respective grounds. Includes, but not
limited to: meeting rooms, restrooms, pavilions, courts, dugouts, bleachers, parking lots, walkways, grass and
ornamental areas, kitchens, common areas, etc. Operates a variety of hand and power tools/equipment to include:
floor polishers, automatic floor scrubbers, vacuum cleaners, hand mowers, weedeaters, blowers, pressure
washers, sprayers, hedge trimmers, etc. Activities to include: sweeping, mopping, waxing, buffing, dusting, hosing
down, power washing, polishing, disposing of trash, raking, weedeating, mowing, edging, herbicide spraying,
trimming, pruning, fertilizing, irrigating, transplanting, sweeping, power blowing, debris removal, and other general
cleaning duties as required. Inspects assigned equipment to ensure safe and stable operating conditions; makes 65%
power tool adjustments; cleans after use and ensures regular servicing. (1,2,4)
2. Operates a light motorized vehicle to transport personnel, equipment, and materials. Cares for truck by washing 20a/0
and polishing; ensuring timely servicing, safety checks, etc. May occasionally operate a riding mower. (2,3,4)
3. Inspects assigned buildings and grounds to ensure that all safety, maintenance, and cleanliness standards are
being met. Submits work orders or reports to supervisor as needed to correct discrepancies. Performs light 5%
maintenance duties such as replacing light bulbs, toilet seats, etc. Undertakes minor painting and carpentry

DEPARTMENT OF PARKS AND RECREATION
Pursuant to Section 2(g) of Rule 4 of the Rules of Procedure of the Council of the County
of Hawaii, this written request is submitted with my approval that the above-referenced
matter be waived from the Committee on Finance to the full Council for immediate
action. In reviewing this matter, timely approval is crucial. It is therefore advantageous
that approval is granted and the matter placed onto the next Council agenda for review.
