I~~ J~ <br /> COUNTY OF HAWAII ~ STATE OF HAWAII <br /> ~h.a.N'~ <br /> 07 141 BILL NO. 145 <br /> ORDINANCE NO. <br /> <br /> AN ORDINANCE AMENDING CHAPTER 18, ARTICLE 4, DIVISION 1, SUBSECTION 18-90(H), <br /> <br /> HAWAII COUNTY CODE 1983 (2005 EDITION, AS AMENDED), RELATING TO PUBLIC <br /> <br /> TRANSPORTATION <br /> BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII: <br /> SECTION 1. Purpose and findings. The purpose of this ordinance is to extend the original <br /> two-year time period to run through December 31, 2009. The Hawaii County Transportation <br /> Administrator is seeking to amend chapter 18, article 4, division 1, subsection 18-90(h), of the Hawaii <br /> County Code 1983 (2005 Edition, as amended), to allow for an extension of time for the County of <br /> Hawai`i's transportation kokua zone, wherein riders boarding and alighting any regularly-scheduled <br /> bus route operated by the County of Hawaii, or its designee, shall ride free of charge. Subsection 18- <br /> 90(h)(4) specifically states "[A] designated transportation kokua area shall terminate two years after its <br /> implementation, unless extended or terminated by the Council." <br /> SECTION 2. Chapter 18, article 4, division 1, subsection 18-90(h), Hawaii County Code <br /> 1983 (2005 Edition, as amended), is amended to read as follows: <br /> "(h) Island-wide transportation free zone. <br /> (1) The purpose of this subsection is to provide the public with a transportation alternative to the <br /> private automobile. The provision of an effective public transportation system for the <br /> residents of the County of Hawaii will produce economic, social and lifestyle benefits for <br /> the residents of Hawaii County. The distances residents must travel for work, medical, <br /> education, and social needs will be alleviated by providing public transportation at no cost to <br /> the user. <br /> (2) The County of Hawaii shall be designated a transportation kokua zone. Riders boarding and <br /> alighting any regularly scheduled bus route operated by the County of Hawaii or its <br /> designee shall ride free of charge. <br /> (3) The transportation kokua zone shall not apply to County contracted shared-ride taxi services, <br /> County operated curb to curb van services, or County operated non-scheduled bus services. <br /> (4) [ <br /> «°~a°a The County wide transportation kokua zone <br /> shall terminate on December 31, 2009. <br /> (5) Within one year of the [a°'° °F ]kokua zone's effective date and again <br /> not later than ninety days prior to °o«,.° , December <br /> 31, 2009, the transit administrator shall report to the Hawaii County council on the impact <br /> of its implementation[, ° °.,,..,.,r..,,.°a <br /> x($31.,, <br /> SECTION 3.
